On behalf of the Planning Division, I have reviewed the above building permit application. During
review of the subject submittal, it was found that the following information, corrections, or clarifications
need to be addressed. Please respond to the following items, so that I can complete my review:
1. Fence Signage: Hearing Examiner Condition No. 3 from the critical area variance approved under
PLN20150052 requires signs to be posted along the split -rail fence surrounding the house. Condition
No. 3 states:
3. Signs shall be installed on the fence delineating the setback area from the critical area
buffer. The signs shall be consistent with the requirements ofECDC 23.90.030.F.2.a.
Please provide details of signage consistent with Hearing Examiner Condition No. 3. There should be
at least three signs posted on the fence; two on the portion of the fence on the east side of the house
and one on south side of the house. Please indicate the locations of the signage on the site plan as
well.
2. Cost Estimate: Please provide a cost estimate for the mitigation plan implementation consistent with
the Hearing Examiner's Condition No. 4 from the critical area variance approved under
PLN20150052, which reads:
4. At time of building permit application, the applicant shall provide an updated estimate for the
cost ofplant materials, labor, monitoring, and maintenance. This shall be used as the basis
for maintenance bond which will be 15% of the estimate. The maintenance bond must be
secured prior to issuance of Certificate of Occupation.
3. Notice on Title: Hearing Examiner Condition No. 8 from the critical area variance approved under
PLN20150052 requires the conditions of approval be recorded on the property. Condition No. 8
provides:
8. The conditions of approval shall be recorded upon the property with express reference to the
restriction that no development activity or other disturbance of the area outside the rail fence
is allowed except as authorized by the City's critical area regulations. The recording
document shall be approved by planning staff and recorded prior to occupancy.
Additionally, a new code section in the recently updated critical regulations (ECDC 23.40.270.13),
sites with field -verified presence of critical areas and/or critical area buffers for which a permit
application is submitted shall as a condition of permit issuance, record a notice of the existence of the
critical area and/or critical area buffer against the property with the Snohomish County Auditor's
Office. Hearing Exarminer Condition No. 8 and the requirement for a Critical Area Notice on Title
are combined in the attached Notice of Presence of Critical Areas. Please sign and notarize this
document. Prior to issuance of the building permit, this form must be recorded with the Snohomish
County Auditor's Office. Options for recording include:
a. Provide the City processing fee of $100 plus the County recording fee of $77 ($73 for first page
and $1 for each additional page), for a total of $177, and the City will record the notice for you;
OR
b. Take the covenant to the County and record it for the County's recording fee of $73 for one page
plus $1 for each additional page, and return a copy of the recorded notice to the Edmonds
Planning Division with the Auditor's recording sticker on the copy.
4. Stepped Walls: The site plan and architectural plans show a stepped wall extending out from the
east side of the residence towards the stream, through the split -rail fence and into the buffer area.
This stepped wall must be removed from the plans. No wall should extend beyond the landing area
for the entrance to the house.
