He said that the proposed subdivision was to put a street up off to the side of these lots at the hammerhead turnaround. At that time, Heasked if the street would serve the lots on the south side. The sewer construction is placed on the south side. Mr. McGee said that this variance will definitely impact his view house. Ms. Stole asked Ms. Luster to clarify this inasmuch as it was her understanding that there were only three lots involved. Ms. Luster stated that it was her opinion that this only involved three lots and that if there were, indeed, six lots, she had been given misinformation. Chairwoman Alice Stole suggested a postponement of a decision on this variance request. Mr. Hugh Preston of 314 7th North stated that he owned the property to the east. He said it was his understanding that when Mr. Bennett made the agreement with the City that all of the roads would serve the three lots which his mother was selling in the area and that if Dr. McGee sold his property on the south side, he would also have to deed an appropriate amount of property on the south side to the City. As he understands it, it was strictly for the three lots which his mother owned at that time. Dr. McGee stated that he asked that question of the Planning De- partment when the land was ploted and that was not the answer fie got. Dr. McGee questioned whether tapes from the Planning Com- mission meeting were still available as that was over a year ago. He said that it was his understanding from that meeting that the road would serve all six lots. He said that this house would still come within six feet of the turnaround and is still over 50%. of the required setback. Mr. Clyde Hagland, designer, stated that if you design a house to fit the setback, the changes can some- times be very drastic and the shape of the house would be most difficult. This is a very odd lot and the grade problem itself presents a design difficulty. The public portion of the hearing was closed. Mr. Paul Roy and Mr. Bill Leraas questioned the fact that this was a minimum variance. Mr. Harold Hatzenbuhler said that he was not sure that this variance couldn't be reduced from the amount they are asking for. Ms`. Medina said that she could not visualize what is happening in this area and felt she could not make an in- telligent decision; therefore she would have to vote no. MR. PAUL ROY MOVED, SECONDED BY MS. Mr. Wayne Tanaka, City Attorney, cautioned the members of the Board to remember not to talk to people for and/or against this during the time this is being considered. V-26-79 A/B CONSTRUCTION COMPANY - Variance from required front yard setback at 18418 Olympic View Drive. Ms. Nancy Luster stated that the zoning in this area is RS-12 which requires a 25' front yard setback and the applicant is requesting a variance on this setback. Ms. Luster presented slides of this property showing the site plan and said that there are no buildable lots directly in front of this piece of property. She said that this variance would not amount to a rezone. This is view property and it does not appear that there is a possibility of another struc- ture obstructing the view of this property. She went on to say that this is at the end of an access easement and a large portion of the house will be located within the 25 foot setback. Ms. Luster stated that the staff has some concern because of the construction of the easement in that it could create some traffic and safety problems as far as maneuvering in and out of the area is concerned. The staff feels that a better design could be drawn up which would better suit this site and a design should be more reasonable as far as the amount of required setback is concerned. Ms. Luster said that the staff recommends denial of this variance request because of the amount of variance being requested, the location of the house to the easement, BOARD OF ADJUSTMENT Page moll- April 181 1979 I; f r B 0 and because it does not appear that this is a minimum variance as well as the fact that it appears there could be other op- tions in designing this so it would be more in keeping with this lot. The public portion of the hearing was opened. Mr. Ron Johnson of 212 Skyline Boulevard, Edmonds, spoke stating that this site is very difficult because of the easement and if you were to push the house further to the west, the structure would be much more difficult. He went on to say that the house as it sits now is 46 feet deep and that puts it within 48 feet of the embankment. The northeast corner of the house would be approximately 15 - 16 feet from the easement road. Mr. Johnson said that he has a recommendation from the engineers that the house be located as far away as possible from the embankment. Mr. Jerry Maury, owner of the property adjacent to the south at the end of the easement road, asked whether they were planning to build up to the asphalt road. Mr. Harold Hatzenbuhler stated that the easement line is another 5 feet from the road. Mr. Jerry Maury spoke again stating that he was concerned that this might cre- ate a fire hazard if they build too close to the asphalt, will there be a o�lo�gnn with fire trucks getting through. Ms. Valerie Olson of 1��2 Olympic View Drive,stated that she had a letter from the Engineering Department at the time this was all platted and there was to be a much larger turnaround at the end of the road. The letter stated that no building permits would be issued for Lot C until that turnaround was enlarged. She went on to say that, at the moment, water has flooded down that turnaround. Ms. Stole asked to see a copy of the letter and Ms. Olson gave her a copy of the letter from the Engineering Department which was signed by Dick Allen on August 10, 1971. There was no further audience participation and the public portion of .the hearing was closed. Mr. Harold Hatzenbuhler stated that he didn't feel this was a rea- sonable request. He said that he visited the site and the only way he could turn around is to back up in the driveway. He did not see how fire trucks could attempt to come down into that area. Chairwoman Alice Stole said that she would like to see this plan used, but she saw some problems which would have to be worked out, particularly in the area of fire protection. MR. MOTION CARRIED. V-27-79 JOHN JONES - Variance from required lot width at 7511 Lake Ballinger Way. RSW-12) Ms. Nancy Luster stated that this is a variance from the required lot width. The area is zoned RSW-12 and the code requires a 80 foot lot width. Ms. Luster stated that this property involves separate zoning. Lots 3 and 4 meet the minimum square footage requirements for the RSW-12 Zone. This variance would not amount to a rezone of this property and this request is in conjunction with the sub- division of the property. Because of the unique configuration of the overall piece of property, this would be the only reasonable way to subdivide this lot into four pieces. Ms. Luster went on to say that everything around this propertyis virtually built up, so that, too, dictates the manner in which the property can be subdivided. Ms. Luster_ stated that the exact variance request would be a 10 foot reduction in the overall lot width on Lot 4 and on Lot 3 a 4 foot request. The staff felt that this appears to be a reasonable variance and they do not feel the applicant created this situation. The staff recommended approval of this variance because it appears to be a mini- mum variance for this location, because this area was previously platted as 70 foot lot widths and it is not possible to get the now required 80 foot lot width.
