The Engineering Division would like to voice our concern over
the setback from the cliff of the future residences on Lots 1
and 2 (see attached sketch). We feel that careful consideration
must be taken in the placement of homes on these lots. In order
to guarantee the safety of the eventual owners of these homes,
an engineering/geological study is required in conjunction with
building permit applications, to be reviewed by the Engineering
Division. Also, a drainage plan per Ordinance No, 1924 will
be required prior to recording of this subdivision.

Acting Planning Division Manager Mary Lou Block showed slides of this site and stated
that the Shorelines Management Substantial Development Permit is required for any
subdivision of land within 200' of the shoreline and two of these three lots are
within that 200' restriction. Two structures currently were on the property. Ms.
Block noted that one of the conditions of the Planning Commission approval was that a
15' pedestrian easement be retained through the property in order to provide access
down the bluff at some future date, but it since had been discovered that the tide-
lands are not publicly owned so such an easement would be needless. She noted that
this area is designated "Urban" in the Shoreline Master Program and the proposed use
was consistent with that designation. She said the Engineering Division was concerned
about the setback on the cliff for future residents on Lots 1 and 2 and they suggested
the requirement of an engineering report for siting of structures in the bluff areas,
to be accomplished by a soils engineer. Ms. Block recommended approval, with the
elimination of the recommendation of a pedestrian access down the bluff. The public
portion of the hearing was opened, no one wished to speak, and the public portion of
MDTION: the hearing was closed. COUNCILMAN GOULD MOVED, SECONDED BY COUNCILMAN KASPER, TO
APPROVE SM -6-79, PURSUANT TO P.C. RESOLUTION 643 AND CONDITIONED UPON THE REQUIREMENTS
THEREIN. MOTION CARRIED.
Councilman Naughten complimented Public Works Director Fred Herzberg on the summary
maps regarding 196th St., but he noted that a gravel walkway was shown on the north
side of the road which the Council had not recommended. Mr. Herzberg said he had
added that, thinking it was the sense of the Council, and it would only be where
there was room for it.
There was no further business to come before the Council, and the meeting adjourned
to Executive Session at 9:55 p.m.

ownership interest in these lands, and the successors and
assigns of owners or other parties having any said interest,
hereby agree that the City of Edmonds shall be held harmless
in all respects from any and all claims for damages for in-
junctive relief which may be occasioned now or in the future
to adjacent land or improvements by reason of the construction,
operation and maintenance of the drainage system and hereby
waive and release the City of Edmonds from any and all claims
for damages, excluding damage caused solely by an act or
omission of said City and injunctive relief which the owners,
or their successors or assigns, may themselves have now or in
