The applicant wishes to subdivide her property via an existing access easement. This easement presently serves the applicant's property and adjoining property. The subdivision of the applicant's property creates three lots. The neighbor's property, with which the easement is shared, is undivided; however, it is en visioned that this property will also be subdivided in the future, creating an additional two lots. The total lots to be served thusly, in the future, would be 5 lots. The.lot width to length ratio and the lot width cannot be met-, for the proposed Lot 3 of the subdivision due to the existing configuration of the property. The net area proposed for Lot 3 is 13,423 square feet. The lot width at the proposed building line is 80.00 feet and within the requirements of the R.S. 12 zone. 2e The property does not greatly differ from other properties which have been developed in the area. The property is located within the plat of Maple -Manor. These lots were created prior to the adoption of the zoning plan for this area. Within this plat and surrounding areas most existing lots are substandard in width and do not conform to the lot to width ratio. The lots within the plat of Maple Manor are served by private roads. Due to the previous segregation of the surrounding properties, it is impossible to serve the property in any other fashion. Denial of this request for variances petitioned herein would deprive the owner of similar rights and privileges exercised by the owners of the surrounding properties. 3. Most properties directly impacted are homes already accessed via private.roads of similar nature. The Murphy property, which is westerly of and adjacent to the property, would receive the greatest impact. In the creation of the sub- division, additional easements will be deeded to the Murphy property. The proposed road improvements will be installed to serve a total of five lots. These improvements will serve three lots within this subdivision and the future subdivision of two lots within the Murphy property. The width to length ratio for Lot 3 should have no great effect on any surrounding properties inasmuch as the lot width at the proposed building line is 80.00 feet and the area of said Lot 3 is greater than that which is needed. Denial of the variances requested will deprive the applicant and the adjacent Murphy property of the full use and enjoyment of their property with no apparent remedy due to the lack of an alternative. 23106 • 100TH W. V4949 JANICE HOLMAN - Variance from lot width to depth ratio, to allow more than three homes on a private road, and from required lot width at 9307 Olympic View Dr. (RS42) The application was for several variances: (1) To allow four homes on a private road, rather than three; (2) To reduce the required width of Lot 3; (3) To reduce the width to depth ratio for Lot 3; (4) To reduce the pavement width to 16', rather than the required 18'; and (5) To locate the utility easement in road, rather than alongside the road. It was determined that the variance to reduce the required width of Lot 3 was not necessary because it is located on an easement, not Olympic View Dr. With regard to the first variance request, the applicants pointed out that the request is to allow four homes on a private road, but the property owners to the south plan to divide their property to provide one additional lot so ultimately there could be a request for five lots on a private road. Mr. Pearson showed slides of the site, noting that an existing house will be removed. He recommended approval of variances (1), (3), and (5). He did not recommend approval of reducing the pavement width, based on Engineering Division recommendation, and especially since more than the normal number of lots will be using it. The public portion of the hearing was opened. Jurgen Sauerland of Lovell-Sauerland & Associates said they planned to pave 18' and the sewer line is existing. He said this property is within the unrecorded plat of Maple Manor and the road at one time was to serve ten homes, but they were asking for a variance to serve only four homes. Also, that they were combining several parcels into the two lots plus the one lot needing the lot width/depth ratio variance. He noted that James Murphy who owns adjoining property has an easement over this property and sometime in the future will subdivide and will want to use this road. He said there was not much concern expressed by the neighbors to the east at the sub- division hearing, and he felt that since the road would serve only these parcels it would not detrimentally affect the surrounding neighbors. Chairman Roy read a letter in the file from Dudley Risley of 9207 Olympic View Dr. who objected to more than a three -lot subdivision of the property. Carter Robins of 9219 Olympic View Dr., adjacent to the proposed develop- ment, said all of the neighbors feel that more than three homes would be a detriment on this site. James Murphy of 9305 Olympic View Dr. noted that the objections were to more than three lots in the subdivision, and only three were proposed. Further, that all lots would be well above the 12,0004 sq. ft. required. The public portion of the hearing was then closed. Mrs. Derleth noted that access onto Olympic View Dr. from this road is difficult and this proposal will be adding more cars, and Olympic View Dr. itself is not very wide, but the Engineering Division had not commented on that so they apparently did not find it objectionable. MRS. MEDINA THEN MOVED, SECONDED BY MR. HATZENBUHLER, TO APPROVE V49499 WITH THE ACCESS ROAD BEING AN EASEMENT OF 20' MINIMUM, WITH 18' OF PAVEMENT, AND THAT ALL ENGINEERING REQUIREMENTS BE MET. MOTION CARRIED. A short recess was announced. 04349 BRACKETT'S LANDING - Conditional Use Permit for joint use parking at 313 AdmiralWay (CW)— Mr. Pearson said this application was to share parking between a restaurant (primary nighttime use) and retail and office space (primary daytime use). Up to 50% of the requirement for nighttime use can be satisfied by parking that normally would be occupied by daytime use. Mr. Pearson recommended approval of the permit, with the condition that they record a covenant on their property with the details of the proposed shared parking.
