A. Description of the Subject Property and Surrounding Area
The City is seeking a conditional use permit to stockpile up
to 5,000 cubic yards of fill in the unopened right-of-way of
88th Ave. W., in the vicinity of 205th P1. S.W.
Surrounding development is single-family residential.
B. Comprehensive Plan
As conditioned, the proposed use should not conflict with the
purposes of the Comprehensive Plan.
C. Zoning Ordinance
The surrounding area is all RS-12 zoning. As conditioned, the
proposed use should not conflict with the purposes of the
Zoning Ordinance and the RS-12 zone district.
D. Not Detrimental
As conditioned, the proposed use should not be significantly

approval of a conditional use permit to stockpile 5,000 cubic
yards of fill in the right of way of 88th Avenue West in the
vicinity of 205th Place S W., in the City of Edmonds, Washington.
A hearing on the request was held before the Hearing Examiner of
the City of Edmonds, Washington, on May 17, 1984.

After due consideration of the evidence presented by the Applicant;
evidence elicited during the public hearing; and, as a result of
the personal inspection of the subject property and surrounding
areas by the Hearing Examiner, the following findings of fact and
conclusions constitute the basis of the decision of the Hearing
Examiner.
FINDINGS OF FACT
1. The Applicant has requested approval of a conditional use permit
for the purpose of stockpiling 5,000 cubic yards of fill material

in the unopen right of way of 88th Avenue West, in the vicinity
of 205th Place S.W. in the City of Edmonds, Washington.
2. The subject property is right of way belonging to the City of
Edmonds. The surrounding properties are all zoned RS-12 as
established in the Edmonds Community Development Code (ECDC).
3. The material is sandy dirt that is being dredged by the Port
of Edmonds near the waterfront in the City of Edmonds. The
Port has indicated to the City of Edmonds that it will give
the material to the City free of charge. The City needs a
place to store the dirt material and the request for the
storage on the subject property has been made.
4. In the future, it is the intent of the City to improve 88th
Avenue West with an LID. The improvements would occur on the
avenue from Main Street to185th Street S.W. If the LID is
approved the fill material requested to be stored on the
unopen right of way of 88th Avenue West would be used for con-
struction purposes. This would reduce the cost of the LID to
the members of the district.
5. In order for a conditional use permit to be granted in the
City of Edmonds the criteria as set forth in Section 20.05.010
of the ECDC must be adhered to. These criteria are:
a. The proposed use must be consistent with the Comprehensive
Plan of the City of Edmonds;
b. The proposed use in its location must be consistent'with
the purposes of the zoning ordinance in which the pro-
perty is located; and,
C. The proposed use must not be significantly detrimental
to the public health, safety or welfare, nor injurious
to nearby private properties or improvements.
6. The Planning Department of the City of Edmonds recommended ap-
proval of the conditional use permit subject to the following
conditions:
1. As needed, temporary erosion control measures are to be
implemented.
2. All truck routes are to be kept clean.
3. Hours of operation should be limited to between 8 a.m. and
5 p.m., Monday through Friday.
4. The permit should not be transferable.
7. If granted the fill would be a 20-foot wide, 10-foot high, and
approximately 200-foot long mound that would be located on the
subject property. Representations were made by the Public Works
Department that the material is not oily or toxic.

B. Currently on site there are tree stumps and concrete slabs that
have been dumped there by other individuals. The City Public
Works Department has indicated that they will remove all stumps
and concrete slabs prior to the deposit of fill material on site.
9. Testimony was received from witnesses (Thompson)(Crystal Rae)
(Donald Rae) requesting that the City remove all tree stumps
and concrete slabs. According to the witnesses, these items
were a source of danger for the children in the area.
10. A witness (Goodman) questioned the costs of the proposed LID
on 88th Avenue West. The representative from the Public Works
Department was unable to give specifics as to the cost.

1. The application is -for the approval of a conditional use permit
for the purpose of stockpiling 5,000 cubic yards of fill in the
unopened right of way of 88th Avenue West, in the vicinity of
205th Place S.W. in Edmonds, Washington. The Applicant owns
the right of way.
2. The source of the proposed fill material is from the Puget
Sound and the shore near the Port of Edmonds Marina in Edmonds,
Washington. The material is a sandy, dirt loam and is not '
oily or toxic.`,.
3. In order for a conditional use permit to be granted in the
City of Edmonds the criteria as set forth in Section 20.05.010
of the ECDC must be met.
4. With conditions the proposed stockpiling will not conflict with �.
the purposes of the Comprehensive Plan. Specifically, the action
will not conflict with Section 15.15.000 Soils and Topography,
Section 15.25.000 Streets and Highways, and the general purposes
of the plan as set forth in Title 15 of the ECDC.
5. The surrounding areas are zoned RS-12. With conditions the
proposed use will not conflict with the zoning ordinances or
RS-12 zoned districts.
6. With conditions the proposed use will not be detrimental to
the public health, safety or welfare, nor injurious to private
properties or improvements.
7. The permit should not be transferable. The permit will be
issued to the City of Edmonds only. No other use of the pro-
perty may be used by other individuals.
8. The Planning Department of the City of Edmonds has recommended f,
approval of the conditional use permit subject to the conditions �a
listed in Finding #6.

DECISION
Based upon the preceding findings of fact and conclusions; the
testimony and evidence submitted at the public hearing; and, upon
the impressions of the Hearing Examiner at a site view, it is hereby
ordered that the conditional use permit request of the City of Edmonds
to stockpile 5,OOO cubic yards of fill in the unopened right of way
on 88th Avenue West, in the vicinity of 205th Place S.W., is granted
subject to the following conditions:
1. The Applicant is to establish the specific location of the
right of way on 88th Avenue West that will be used for stock-
piling purposes. All stockpiling must occur within this area.
Temporary erosion control measures are to be implemented if
needed.
2. All truck routes are to be kept clean and free from dirt.
3. The City is to ensure the safety of all the residents in the
area of the stockpiling. Special concern is to be made for
the safety of children during the time of stockpiling in order
to prevent any injury caused by machinery during the operation.
4. During the stockpiling operation and after the operation has
been completed, the City is to observe for any potential
cave-ins or slippage of the fill material. If the City ob-
serves any, they are to be corrected immediately.
5. The hours of operation for the stockpiling activity shall be
limited to 8 a.m. through 5 p.m., Monday through Friday.
6. The permit is not transferable. The City is the only Applicant
allowed to use the area for stockpiling purposes. If any other
individuals use the area for stockpiling or dumping the City is
to pursue all available legal recources against the individual.
7. All cement blocks and tree stumps must be removed prior to the
stockpiling activity. These blocks and stumps must be removed
by June 17, 1984.
8. There are to be no toxic wastes of any nature allowed to be
stockpiled on site.
9. The Applicant is to take measures necessary for barricading the
stockpile during and after the stockpiling process. Barricades
must be provided at all points of entry of the stockpile. The
City is to take all legal recourse to prevent the stockpile
from being used for motorcross or dirt -bike purposes, or any-
thing similar. If the stockpile area is used for such purposes
the conditional use permit will be reviewed.
10. A complete review of the conditional use permit will be made
within six months of the date of this decision. is
