A. Description of the Subject Property and Surrounding Area
The subject property is located at the western end of 173rd

St. S.W. The lot contains approximately 33,248 square
feet. There is an existing two story residence located on
the property. Apparently, back in the 1950's, an accessory

dwelling unit was put in the basement of the existing
residence.
The Applicant is seeking the a conditional use permit to
allow the basement of the existing home to continue to be
used as an accessory dwelling unit. The Applicant is
`
proposing to add a bedroom and bathroom onto to the house
for the downstairs accessory dwelling unit.
Surrounding development is single family residential.

The subject property is zoned RS-12, as are all the
adjacent properties.
The requested conditional use permit does not appear to
conflict with the purposes of the Zoning Ordinance or the
RS-12 zone.
D. Comprehensive Plan 6;
The subject property is designated as Low Density
Residential.
The proposed conditional use permit does not appear to
conflict with the purposes of the Comprehensive Plan.
E. Not Detrimental
The proposed use should not be significantly detrimental to
the public nor to nearby private property or improvements.
F. Transferability
The permit will not be transferable. t
G. Conformance to Chapter 20.21
1. Existing Residence - The residence has been used as a
single family residence for a period of at least three
years as a single family dwelling.
2. Area Used - The basement of the existing residence will

be used as the accessory dwelling unit.
3. Exterior Changes - An addition is planned off the north
side of the existing house. This addition would add a
bedroom and bathroom for the downstairs accessory
dwelling unit. A single water and electrical meter will I.
be used for the building.
4. Parking - A minimum of three parking spaces will be
provided on the property. Six parking spaces can be
found on the property.
5. Number of Units - Only one accessory dwelling unit will
be located on the site.
6. Occupancy - The Applicant intends to occupy the house
and her daughter will live in the basement accessory
dwelling unit.

7. Safety, Light, Ventilation, etc. - The Applicant will be
required to obtain a building permit and comply will all
conditions of the Uniform Building Code,• 1985 edition.
V. STAFF RECOMMENDATION:
The requested conditional use permit meets all the required
criteria for an accessory dwelling unit. Staff recommends approval
of CU-1-87, subject to the following conditions:
1. The Applicant shall obtain a building permit for the accessory
dwelling unit and comply with all permit conditions.
2. The permit is not transferable.

I hereby testify that the following facts are true:
1. I have occupied the above named residence since 1950,
except for a six year period from 1963 to 1970. My
husband, David Roy, and I intend to remain in the
primary dwelling.
2. The accessory unit is located in the downstairs area of
the dwelling.
3. There is only one electrical meter and water meter on
the property.
4. There is off-street parking for at least 6 cars.
5. When the property was purchased in 1950 it was a one
story, unfinished structure. We installed a complete
kitchen, bathroom, living room, dining room, bedroom,
laundry and storage facility. We lived downstairs for
five years while we built the upstairs. The area down-
stairs is a daylight basement. We moved into the upstairs
area in 1955.
6. We are in the process of adding an addition onto the house,
which will include a large bedroom and bath for the down-
stairs unit.

After due consideration of the evidence presented by the Applicant;
evidence elicited during the public hearing; and, as a result of the
personal inspection of the subject property and surrounding areas by
the Hearing Examiner, the following Findings of Fact and Conclusions
constitute the basis of the decision of the Hearing Examiner.
FINDINGS OF FACT
1. The Applicant has requested approval of a conditional use permit
for the allowance of an accessory dwelling unit at 7802 I-
173rd Street S.W., Edmonds, Washington, and more particularly
described as set forth above. (Staff report.)
2. The subject property is located at the western termination of
173rd Street S.W. It is a lot that contains approximately
33,248 square feet of land. Located on the lot is a two-story
residence that is the Applicant's home. The home was developed
in the 19501s. (Staff report.) L
3. The basement of the Applicant's residence has a kitchen and
other living facilities. It is the intent of the Applicant to
develop the area with an additional bedroom and bathroom. In
order for the Applicant to develop the basement with the I,
additional bedroom and bathroom, a conditional use permit for an
accessory dwelling unit is required. (Bowman testimony.) f�
4. Edmonds Community Development Code (ECDC) 21.05.015 defines
accessory dwelling units as a structure attached to or
constructed within a single-family dwelling that has living `
facilities for one individual or family separate from the I+
primary single-family dwelling, including at least, but not
limited to, a kitchen, bathroom, and sleeping quarters. The
addition as proposed by the Applicant qualifies as an accessory
dwelling unit. (Bowman testimony and ECDC.)
5. ECDC 20.21.005 requires that an accessory dwelling unit that
is used as a place of residence be regulated and that it be
developed with a conditional use permit. (Bowman testimony and
ECDC.)
6. In order for a conditional use permit to be granted in the
City of Edmonds, the criteria as set forth in ECDC 20.85.010
must be met. These criteria include:
A. The proposed use must be consistent with the Comprehensive
Plan of the City of Edmonds;

B. The proposed use in its location must be consistent with
the.purposes of the zoning ordinance in which the property
is.located; and,
C. The proposed use mush not be significantly detrimental to
the public health, safety or welfare, nor injurious to
nearby private properties or improvements.
(ECDC.)
7. In addition to the criteria as set forth in ECDC 20.05.010
accessory dwelling units) must also satisfy the criteria of ECDC
20.21.030. These criteria include:
A. Existing Residence.Lilt
The single family dwelling in which
such unit is to be must have been occupied for at
least three years since the date construction of that
single-family dwelling was completed.
B. Area Used. Accesso�ly dwelling units must be located within
or attached to single-family dwelling units. In no case
will an accessory d elling unit be allowed in a detached
structure such as a�guest house or garage.
C. Exterior Changes. The single family appearance and
character of the residence shall be maintained when viewed
from the surrounding neighborhood. Whenever possible, new
entrances should be placed on the side or rear of the .
building. Only one electric and water meter will be allowed
for the entire building, serving both the primary residence
and the accessory dwelling unit.
D. Parking. Three off'istreet parking spaces shall be provided
for a single-family residence with an accessory dwelling
unit.
E. Number of Units. Only one accessory dwelling unit shall
be approved for each single-family dwelling.
F. Occupancy. The primary dwelling or the accessory dwelling
unit shall be occupied by the owner of such residence or
unit, excluding lessees and renters, so long as the
accessory dwelling iunit is used for dwelling purposes
separate and distinct from the primary dwelling.
G. Non -transferability. The permit is not transferable to any
other site than thelsite described in the application.
H. Safety, Light, Ventlilation, Floor Area, etc. Accessory I
dwelling units shall comply, when such are applicable, with
the requirements of the Uniform Building Code,.Uniform Fire
•'Code', National Life Safety Code as well as any other
,z, form code adopted by the Community Development

8. The subject property is zoned RS-12. It has a Comprehensive
Plan designation of Low Density Residential. The requested
conditional use permit does not conflict with the purposes of
the zoning ordinance or the Comprehensive Plan of the City of
Edmonds. (Bowman testimony.)
9. The proposed accessory dwelling unit will not impact other
properties in the area. It has been used as an accessory
dwelling unit for some years and the Applicant's daughter is
living in the unit. (Willison testimony.)
10. The Applicant has occupied the main residence for a period of
over three years. It has been occupied as a single-family
dwelling. (Willison testimony.)
11. The requested accessory dwelling unit will be located within
the single-family residence on site. (Bowman testimony.)
12. The single-family appearance and character of the residence
will be maintained when viewed from the surrounding
neighborhood. (Bowman testimony.)
13. A minimum of three parking places will be provided on the pro-
perty. There is sufficient room for six parking places. (Staff
report.)
14. It is the intent of the Applicant to occupy the main residence
and her daughter will continue to live in the accessory dwelling
unit. (Staff feport.)
15. The Applicant will be required to obtain a building permit and
comply with all conditions of the Uniform Building Code. (Staff
report.)
16. The Planning Department of the City of Edmonds has recommended
approval of the conditional use permit subject to the following JJ
conditions:
1. The Applicant shall obtain a building permit for the f
accessory dwelling unit and comply with all permit
conditions.
2. The permit is not transferable.

17. A witness (Van Saun) submitted that the Applicant's intent
for the accessory dwelling unit could have an impact on the
valuation of the properties in the neighborhood. In addition,
the witness requested that the utility buildings in the front
portion of the Applicant's property be removed as a trade-off
for approval of the accessory dwelling unit. (Van Saun
testimony.)

18. A witness (Christothoulou) submitted that he was against rentals
in the neighborhood. He did state, however, that he was not
against Mrs. Willison's proposal. (Christothoulou testimony.)
19. A witness (Rabe) submitted that he is lives in the residence
that is closest to the Applicant's property. He indicated that
the accessory dwelling unit would not have an impact on the
traffic within the neighborhood. (Rabe testimony.)

1. The application is for the approval of a conditional use permit
for the allowance of an accessory dwelling unit at 7802 - 173rd
Street S.W., Edmonds, Washington.
2. In order for an accessory dwelling unit to be allowed within
the City of Edmonds a conditional use permit is required. The
criteria for the granting of a conditional use permit have been
reviewed and the application satisfies these criteria.
3. The criteria for the granting of an accessory dwelling unit
have been reviewed and the application satisfies the criteria as
set forth in ECDC 20.21.030. These criteria are identified in
the Findings of this document.
DECISION
Based upon the preceding Findings of Fact and Conclusions; the
testimony and evidence submitted at the public hearing; and, upon
the impressions of the Hearing Examiner at a site view, it is
hereby ordered that the requested conditional use permit for the
allowance of an accessory dwelling unit at 7802 - 173rd Street
S.W., Edmonds, Washington, is granted subject to the following
conditions:
1. The Applicant must obtain a building permit for the
accessory dwelling unit. In addition the Applicant
must comply with all building code requirements and
permit requirements of the City of Edmonds.
2. The`conditional use permit is not transferable.
