Application 1. Applicant: Richard A. Crosby (see Attachment 2) 2. Site Location: 702 - 9t' Avenue North (see Attachment 1) 3. Request: To divide one lot with a total gross area of approximately 34,593 square feet into two lots in the Single -Family Residential (RS-12) zone (see Attachments 2 and 3.) 4. Review Process: Following the Comment Period, Planning Staff makes an administrative decision. 5. Major Issues: a. Compliance with Edmonds Community Development Code (ECDC) Section 16.20.030, site development standards for the RS-12 zone. b. Compliance with Edmonds Community Development Code (ECDC) Title 18, public works requirements. c. Compliance with Edmonds Community Development Code (ECDC) Section 20.15B, Critical Areas. d. Compliance with Edmonds Community Development Code (ECDC) Section 20.75, subdivision requirements. e. F-00U17-7413 1 1 Based upon the Findings of Fact and Conclusions, Attachments and Exhibits submitted with the application and during the comment period, the following is the decision of the City of Edmonds Planning Division: The Subdivision is APPROVED with the following conditions: 1. Prior to recording the applicant must complete the following requirements: a) Civil plans must be approved prior to recording. In completing the civil plans you must address the following: (1) Show how you will control off -site drainage entering the site from the southeast corner (which is currently collected in a drainage ditch in the rear lawn of the existing house) and connect that drainage to the city storm sewer system. (2) Complete the Engineering Division conditions listed "Required prior to Recording" on Attachment 4, including payment of fees. b) If setbacks are to be included in the plat, the following must be done: (1) Please correct the setbacks to show: (a) On proposed lot 2, a 25-foot rear setback from the northern edge of the access easement (the south 15 feet); (b) A ten -foot setback around the 25'by 25' access easement S-05-36.doc/ May 27, 2005/ Staff Report Richard Crosby File No. S-05-36 Page 3 of 7 (2) Add to the face of the Plat "Setbacks shown are for reference only and vest no right." c) On the face of the plat, lot area for proposed lots 1 and 2 should show both gross area and the area with all vehicular access easements subtracted (net area). d) Add to the face of the Plat "Conditions of approval must be met and can be found in the final approval for the short subdivision and attachments thereto located in File S-2005-36 in the City of Edmonds Planning Division." e) Include on the plat all required information, including owner's certification, hold harmless agreement, and staff s approval block. f) Provide a maintenance agreement for the 25' by 25' access easement. g) Show all easements on the final plat, as shown on the preliminary plat. h) Make sure all documents to be recorded meet the Snohomish County Auditor's requirements for recording. i) Submit copies of the documents to be recorded for the Planning Division and Engineering Division's approval. Once approved, the applicant must record the documents with Snohomish County Auditor's office. j) Submit an updated copy of the title report (short plat certificate) with the documents proposed to be recorded. k) The name(s) shown on the signature block on the plat must match the names shown on the updated title. 2. After recording the plat, the applicant must complete the following: a) Provide the City Planning Division with two copies of the recorded plat, with the recording number written on them. The City will not consider the subdivision to have been completed until this is done b) Complete the Engineering Division conditions listed "Required with Building Permit" on Attachment 4. 1 11 IMM91131 A. Compliance with the Subdivision Ordinance 1. Environmental Resources a. The environmental resources include trees, most of which have been planted as part of the landscaping. The 14-inch cedar tree labeled as T12 appears to have a split trunk, so even though this is a native tree, it does not need to be preserved. The 18-inch Douglas fir labeled T13 on the plans appears to be in good shape, though it has some discharge of sap along its trunk. The site also appears to have a drain cut across the back yard of the existing house. A neighbor has stated that there is a culvert under the easement road (not shown on the City Storm Sewer System Map) and the water flows downhill onto this site. The ground is quite spongy in spots, and a small channel approximately one - foot wide and one -foot deep has been cut into the lawn to direct the water along the east side of the garage and into the drainage ditch that runs along Carol Way. Although the drainage ditch along Carol Way was moist for the length of the property during staffs April 28, 2005 site visit, downstream of the where the drainage channel from the subject property appears to join in (due north of the middle of the garage) there is running water. The City's Critical Areas Map does not show any stream in the vicinity. Because the ditch in the back yard appears to have been dug for the express purpose keeping the water away from the house and garage, it does not meet the definition of stream given in S-05-36.doc/ May 27, 2005/ Staff Report 2. Richard Crosby - File No. S-05-36 Page 4 of 7 Edmonds Community Development Code Section 23.40.320.MM. It is not exceptionally clear if the spongy area in the rear yard was created by the culvert under the road, or is a natural condition. The wet area is only about 250 square feet in size, with primarily grass growing, with some buttercups and dandelions in it. This area does not appear to meet the definition of a wetland that needs protection, but its function of holding and releasing storm water will need to be addressed. Also, the foundation of the new house should be protected from this drainage. b. The Engineering Division states in their requirements that access for the two lots shall be off Carol Way. The applicants have accommodated this requirement by proposing a shared access easement on the eastern side of proposed lot 1. A sidewalk is also required along Carol Way. It appears that the applicants are accommodating this by replacing the existing drainage ditch with a twelve -inch storm line, backfilling the ditch and placing the sidewalk and driveway over the fill. The house on proposed lot 1 will remain, and the topography will change very little. Proposed lot 2 will be graded slightly for the house and driveway. The lot is fairly level, and the proposed placement of the house on lot 2 is compatible with the existing topography. c. No hazardous conditions exist at this site. d. The proposal includes on -site detention and will connect to the public storm sewer system, which should minimize off -site impacts on drainage. The neighbor to the east has obtained a view easement across the north 45 feet of a portion of the subject property to protect their view, and the proposed placement of the new house respects that easement. The houses to the south sit close to Glen Street or 9t' Avenue N. so their view should not be as impacted as if they were close to their northern property lines. Lot and Street Layout a. This criteria requires staff to find that the proposed subdivision is consistent with the dimensional requirements of the zoning ordinance and also that the lots would ultimately be buildable. Based on a review of the project and the analysis in this section staff agrees that a two -lot short -plat is a reasonable use of the property. b. Lot Coverage of Existing Buildings on Proposed Lots: 1.) 35% maximum lot coverage is allowed. 2.) The existing house and garage will be retained on proposed lot 1, which will result in a 14.3 percent lot coverage for lot 1. 3.) Lot 2 will have a zero percent lot coverage. 3. Dedications a. See City Engineer's Report (Attachment 4). 4. Improvements a. See City Engineer's Report (Attachment 4). 5. Flood Plain Management a. This project is not in a FEMA designated Flood Plain. B. Compliance with the Comprehensive Plan 1. The Comprehensive Plan has the following stated goals and policies for Residential Development. B. Goal. High quality residential development which is appropriate to the diverse lifestyle of Edmonds residents should be maintained and promoted. The options available to the City to influence the quality of housing for all citizens should be approached realistically in balancing economic and aesthetic considerations, in accordance with the following policies: 13.3. Minimize encroachment on view of existing homes by new construction or additions to existing structures. BA. Support retention and rehabilitation of older housing within Edmonds whenever it is economically feasible. B.5. Protect residential areas from incompatible land. uses through the careful control of other types of development and expansion based upon the following principles: 13.5.a. Residential privacy is a fundamental protection to be upheld by local government. B.5.c. Stable property values must not be threatened by view, traffic or land use encroachments. B.5.d. Private property must be protected from adverse environmental impacts of development including noise, drainage, traffic, slides, etc. B.6. Require that new residential development be compatible with the natural constraints of slopes, soils, geology, vegetation and drainage. Compliance with the Residential Development goals and policies: The proposal will retain the existing housing stock, and also allow for one additional home. The proposed new house will be compatible with the natural constraints of slopes, soils, geology and drainage. Lot 1 will be significantly larger than required, which should enhance privacy. The neighbor has already protected his view through a view easement, and this is being respected by the proposal. In general, the proposed development meets the Comprehensive Plan policies. C. Compliance with the Zoning Code Staff finds this project to comply with the provisions of the Zoning Code as demonstrated in section II.A.2.b. D. Compliance with the Flood Plain Management Provisions The proposed project is not in a Flood Plain. E. Environmental Assessment: Is this site identified on the City's Environmentally Sensitive Areas Map (Shoreline area only)? No. 2. Is an Environmental Checklist Required for this application? No. Critical Areas Review number: CA-2004-120 2. Results of Critical Areas Review: The property does not appear to contain any critical areas as defined by ECDC 20.15B. As a result, a waiver from the requirement to complete a study was issued. G. Comments: No comments have been received. The following is a summary of the deadlines and procedures for filing reconsiderations and appeals. Any person wishing to file or respond to a recommendation or appeal should contact the Planning Department for further procedural information. '•�' r 1111111111111 1' 111 ii Section 20.100.010.G allows for City staff to reconsider their decision if a written request is filed within ten (10) working days of the posting of the notice required by this section. The reconsideration request must cite specific references to the findings and/or the criteria contained in the ordinances governing the type of application being reviewed. Section 20.105.040 and 20.105.020 describes how appeals of a staff decision shall be made. The appeal shall be made in writing, and shall include the decision being appealed along with the name of the project and the date of the decision, the name of the individual or group appealing the decision, their interest in the matter, and reasons why the appellant believes the S-05-36.doe/ May 27, 2005/ Staff Report Richard Crosby File No. S-05-36 Page 7 of 7 decision to be wrong. The appeal must be filed with the Community Development Director within fourteen (14) calendar days after the date of the decision being appealed. C. Time Limits for Reconsideration and Appeals The time limits for Reconsiderations and Appeals run concurrently. If a request for a reconsideration is filed before the time limit for filing an appeal has expired, the time "clock" for filing an appeal is stopped until a decision on the reconsideration request is completed. Once the staff has issued his/her decision on the reconsideration request, the time clock for filing an appeal continued from the point it was stopped. For example, if a request is filed on day 5 of the appeal period, an individual would have 9 more days in which to file an appeal after the staff issues their decision on the reconsideration request. Section 20.075.100 states, "Approval of a preliminary plat or preliminary short plat shall expire and have no further validity at the end of five years, unless the applicant has acquired final plat or final short plat approval within the five-year period."
