Reviewed By:• Gina Coccia, Associate Planner INTRODUCTION The purpose of the Land Clearing and Tree Cutting chapter (ECDC 18.45) is to provide regulations for the clearing of and for the protection and preservation of trees and associated significant vegetation. The site is forested with mature evergreens along the western half with a handful of trees dispersed along the eastern half where the home and driveway have been constructed (Attachment 3). The owner has requested to remove 12 evergreen (mostly fir) trees that remain along the eastern half of his property (Attachment 3). Some are in poor condition, one is completely dead, and most have sparse foliage and are receiving little light. These trees are labeled "A" through "L" on the enclosed map (Attachment 3) and are referenced in the attached report by Certified Arborist Anthony Moran of Superior NW Tree and Shrub Care, Inc. (Attachment 4). This site is located in a single-family neighborhood in northeast Edmonds. All of the properties in this neighborhood are also zoned Single -Family Residential (RS-8), whereas the properties across Olympic View Drive are located within the Lynnwood city limits (Attachment 1). The owner has indicated that one reason he would like to remove these trees is to eventually construct an accessory building on the flat portion of the property near the home. A building permit will be required to build an accessory building, because the property contains and is adjacent to a moderately steep slope (CRA20090092). Because the owner is proposing to remove trees on or near a slope, a tree cutting permit is required. Approval of a tree cutting permit requires compliance with Edmonds Community Development Code (ECDC) Chapters 18.45 (tree cutting), 20.02 (type II permits), 20.05 (conditional use permits), Title 23 (critical areas) and the Comprehensive Plan. Request: To remove 12 evergreen trees on a residential property (Attachments 2 and 3). b. Review Process: Administrative conditional use (CU) permit "Type II" decision subject to ECDC 20.02. Planning staff reviews the project and issues a decision. c. Owner/Applicant: Hasim Mujkanovic (Attachment 2). d. Tax Parcel Number: 00513100016105. e. Location: 17806 Olympic View Drive, Edmonds WA 98026 (Attachment 1). f. Zoning: Single -Family Residential (RS-8). g. Acreage / Square Footage: Approximately 0.65 acres or 28,314 square feet (Attachment 3). h. Existing Use: One single-family residential home. i. Proposed Use: No change — proposal is for tree removal only. j. Shoreline Management: The site is not subject to Shorelines of the State regulations. k. SEPA: The proposal is not subject to review under the State Environmental Policy Act. I. Comprehensive Plan Designation: "Single Family — Urban 1." m. Access / Street: Olympic View Drive is considered a "Minor Arterial' and provides access to the property via an existing driveway. 2. TECHNICAL COMMITTEE This application was reviewed by the Fire District, Building Division, Engineering Division, Parks and Recreation Department, and the Public Works Department. The Engineering Division provided comments which include the condition that all work take place on private property, including the staging of equipment for tree removal (Attachment 5). 3. APPLICATION AND STAFF REVIEW COMPLIANCE (ECDC 20.02 and ECDC 18.45) This application is processed pursuant to ECDC 20.02 ("Type II" staff decision with notice required). A complete application was received on May 7, 2010 and notice was published/posted/mailed on May 12, which satisfies the requirements of ECDC 20.02. No written public comments were received. 4. COMPREHENSIVE PLAN COMPLIANCE Page 82-83 of the Comprehensive Plan discusses goals and policies for vegetation and wildlife, including the following: 8.2. The removal of trees should be minimized particularly when they are located on steep slopes or hazardous soils... 8.3. Trees that are diseased, damaged, or unstable should be removed. 8.4. Grading should be restricted to building pads and roads only. Vegetation outside these areas should be preserved. Page 2 of 5 • • Mujkanovic Tree Removal PLN20100019 Most of the trees proposed to be removed are not on the steepest portion of the property. All of the trees proposed to be removed are damaged or diseased in some way, according to the arborist report. No grading is proposed. The trees in the western portion of the property, well outside the building footprint and road, will be preserved. The proposal appears to be in compliance with the Comprehensive Plan. 5. CRITICAL AREAS COMPLIANCE (ECDC Title 23) File CRA20090092 found that critical areas (geologically hazardous areas) exist on and adjacent to the property. Because there are slopes on the property, a tree cutting permit is required. ECDC 23.40.220(C)(7) describes allowed activities in critical areas, such as select vegetation removal. It says that "tree cutting shall be limited to pruning and crown thinning, unless otherwise justified by a qualified professional. Where pruning or crown thinning is not sufficient to address the hazard, trees should be removed or converted to wildlife snags." It goes on to say that, "the land owner shall replace any trees that are removed with new trees with a ratio of two replacement trees for each tree removed within one year in accordance with an approved restoration plan." In this case, the arborist suggest each tree is hazardous in some way, and that replacement should be through transplanting existing tress that are not receiving enough light from the dense canopy on the west side of the property to available room on the east side of the property. Because there are so many existing trees onsite, the arborist feels that the functions and values of the tree cover could be made up by transplanting some of the existing saplings. In this way, proposal generally complies with the intent of the critical areas code (Title 23) in that it would be also saving saplings that are not receiving enough light and allowing them to flourish elsewhere on the property. 6. PROPOSAL SUBMITTED a. The proposal is to remove 12 evergreen trees (mostly fir) that are in a weakened condition or dying. Most appear to be struggling to survive due to lack of light. The arborist notes that the lot is heavily wooded and that there are numerous evergreen saplings available onsite for transplant, and that no additional trees should be brought onsite for replacement purposes. This recommendation was made because the existing mature trees are so plentiful and provide too much shade for new trees to grow. Some existing saplings have been recommended to be transplanted onsite which would encourage their growth and help make up for the trees that will be removed. b. The trees will be removed using "low impact hand techniques" (rigging, brushing, and chunking) and no heavy equipment is proposed to be taken off of paved surfaces. This will limit any detriment to the site and adjacent sites. c. The brush is proposed to be chipped and the chips will be used as mulch. The consulting arborist feels that the removal of the slated 12 trees will have minimal impact on the surrounding environment, slope stability and no detrimental impact to the immediate tree canopy. d. Tree "L" is considered dead and may therefore be removed immediately. e. The applicant has requested the removal be phased — some trees removed in 2010, some in 2011, and the remainder in 2012 (Attachment 3). This approach is acceptable (as long as the dead tree is removed immediately so as not to cause harm or damage property). f. Trees that will be transplanted on site should be transplanted during each phase of removal and inspections should occur after each phase of removal and transplantation to ensure that the transplanted trees are healthy and thriving. The majority of the trees on site are being retained; the trees proposed to be removed are reasonably necessary to achieve the proposed future accessory building while making room for the transplanted saplings to flourish. Due to the sheer volume of trees onsite, the trees are being retained to the maximum extent feasible. h. Although slopes are present onsite (26-41%), no wetlands or streams were observed (CRA20090092). Trees along the western half of the property will be retained, which will contribute to noise and wind protection as well as continue to reduce air pollution by producing pure oxygen from carbon dioxide. The proposal, with conditions, is found to be compliant with ECDC Chapters 18.45, 20.02, 20.05, Title 23, and the Comprehensive Plan. DECISION; Q Based on the Findings of Fact, Conclusions, and Attachments to this report, the following decision is issued by the City of Edmonds Planning Division. The Tree Cutting permit as proposed is APPROVED with the following conditions: 1. All work shall take place on private property, including the staging of equipment for tree removal. 2. Low impact development techniques shall be used: no heavy equipment shall be taken off paved surfaces and hand techniques shall be implemented. 3. Tree removal shall be preformed by a Certified Arborist and shall follow the recommendations of the arborist report submitted by Superior NW Tree & Shrub Care, Inc. (Attachment 4). 4. The evergreen saplings referenced in the arborist report shall be transplanted onsite in lieu of tree replacement (Attachment 4). 5. At the owner's request, tree removal may be phased so that trees A, B, C, and D may be removed in 2010, trees L, E, K and H may be removed in 2011, and trees J, I, G, and F may be removed in 2012. Tree L should be removed immediately, however, because the arborist feels it is dead. 6. The owner shall call the Planning Division at 425.771.0220 and request an inspection once each phase of work has been completed (including transplanting) so that we may close out this file. Transplanting replacement trees shall be done within one year of each phase of tree removal. 7. The owner shall pay the remaining balance ($33.88) from publishing this file's notice in the Everett Herald at his earliest convenience (Attachment 6). APPEALS AND RECONSIDERATIONS: Any person wishing to file or respond to an appeal should immediately contact the Planning Division at 425.771.0220 for procedural information. Pursuant to ECDC 18.45.060, "Any person aggrieved by the decision of the staff regarding a clearing permit may appeal such decision to the hearing examiner within 10 working days of the date of the decision. The appeal shall comply with the provisions of Chapter 20.06 ECDC." Therefore, appeals (including the $365 appeal fee) must be received by the Planning Division no later than 4:00 PM on June 18, 2010. Description: This is a large, heavily wooded property that makes up the north end of a small forest complex.. The first set of trees that are to be removed (A, B, and C) are not part of the forest system. Only one is in the back of the home, the other two stand alone in front. The `D' cedar will most likely be removed at a later date and it is also not part of the system. The remaining ones are understory trees in poor condition that have been subordinated. These also will probably be removed at a later date. Each of the trees in the following list was each measured at the standard height of 54" above grade (DSH) and their heights approximated. They are designated on the accompanying plot plans with blue circles. A) Fir 22" DSH, 90' tall. This tree is standing midway up the incline behind the home on the north side. It is in decline and is symptomatic of Armillaria. B) Fir 28" DSH, 95' tall standing 4' to the left of the driveway at the NE corner of the property. Client is concerned with proximity of roots to drive and to water main which appears to run about five feet out along the south side of the tree. Tree has an active tear plane from the base to the separation point. Tree is buttressing but does have decay down center of plane. E) Fir 4" DSH, 32' tall rear right side 3' from the north fence line in the middle level. Tree is subordinated by larger firs within 5' to either side and is in advanced decline. F) Fir 6" DSH, 36' tall standing right of center in the upper plateau. Tree is subordinated and exhibiting symptoms of decline including sparse foliage and poor color. G) Fir 5" DSH, 45' tall standing left of center in the upper plateau. Tree is subordinated and exhibiting symptoms of decline including sparse foliage and poor color. This tree has a large basal wound that extends two thirds around its circumference. There is active decay in the wound that was probed to more than half way through the diameter. Tree is subordinated and exhibiting symptoms of decline including sparse foliage and poor color. No heavy equipment will be taken off of paved surfaces. The brush will be chipped and the chips used as mulch. The removal of the trees will have minimal impact on the surrounding environs, no impact on slope stability, and no detrimental effect on the immediate tree canopy. Description: This is a large, heavily wooded property that makes up the north end of a small forest complex.. The first set of trees that are to be removed (A, B, and C) are not part of the forest system. Only one is in the back of the home, the other two stand alone in front. The `D' cedar will most likely be removed at a later date and it is also not part of the system. The remaining ones are understory trees in poor condition that have been subordinated. These also will probably be removed at a later date. Each of the trees in the following list was each measured at the standard height of 54" above grade (DSH) and their heights approximated. They are designated on the accompanying plot plans with blue circles. A) Fir 22" DSH, 90' tall. This tree is standing midway up the incline behind the home on the north side. It is in decline and is symptomatic of Armillaria. B) Fir 28" DSH, 95' tall standing 4' to the left of the driveway at the NE corner of the property. Client is concerned with proximity of roots to drive and to water main which appears to run about five feet out along the south side of the tree. This tree has a large basal wound that extends two thirds around its circumference. There is active decay in the wound that was probed to more than half way through the diameter. J) Madrone 12" DSH, 50' tall, 8' spread standing 20' north of the south fence line on the middle plateau. This tree has a basal wound that is one third of its circumference. There is active decay in the wound that was probed to more than half way through the diameter. K) Fir 5" DSH, 38' tall standing 15' south of `J' 4' north of the south fence line. Tree is subordinated and exhibiting symptoms of decline including sparse foliage and poor color. L) Fir 7" DSH, 55' tall standing 30' north of the south fence line 10' west of the edge of the middle plateau. Tree is dead. Same ' o During review and inspection of the subject site, it was found that the site may contain (or be adjacent to) critical areas, including Geologically Hazardous Areas (Erosion Hazard Area and Landslide Hazard Area), pursuant to Chapter 23.40 of the Edmonds Community Development Code (ECDC). Geologically hazardous areas include areas susceptible to erosion, land sliding, earthquake, or other geological events. They pose a threat to the health and safety of citizens when incompatible development is sited in areas of significant hazard. Such incompatible development may not only place itself at risk, but also may increase the hazard to surrounding development and use. The LiDAR map (attached) indicates that there is a steep slope (approximately 41%) just east of the house (10'/24'). The site is comprised of a rolling slope of 26-27% across the entire property rolling from west to east. The western half of the property is primarily forested with mature evergreens, which should enhance slope stability. Soils on the property are identified as Alderwood gravelly sandy loam series, which classifies the site as a potential erosion hazard. The slopes present above 15% qualify as potential .geologically hazardous areas." This review applies to the entire subject parcel. Depending on the location and project proposed relative to the identified critical areas, certain studies and reports may be required. Please contact the Planning Division at 425.771.0220 if/when you have a specific development proposal for this site to discuss the various permits that will be required, including a tree cutting permit. Mr. Mujkanovic asked about the possibility of removing trees in the back yard in order to build a smoke house for curing meats as part of a proposed home occupation. Please be aware that building permits are required for building an accessory building. A home occupation permit (business license) is required by the City Clerk's office for running a home -based business. The home occupation code does not allow customers or employees to visit the property. Also, home occupations shall not produce odors or smoke or other impacts adverse to a residential area. Please review the attached home occupation handout (ECDC 20.20) for further details. Please be aware that tree removal on sites containing a critical area require a tree cutting permit prior to removal. Also, a tree cutting permit would be required due to the large size of the property per ECDC 18.45.030.A (0.65 acres in the RS-8 zone). As part of a tree cutting permit, a licensed geotechnical engineer would need to determine that the slope would remain stable if the trees were removed and Page 1 oN AONw discuss the potential for replacement trees. Below you will find the specific critical areas code that must be complied with regarding removal and replacement of trees in critical areas (ECDC 23.40.220.C.7.B). The City's Comprehensive Plan contains goals and policies for vegetation that will be considered with any tree cutting proposal. Below you will find some goals and policies related to tree removal and tree retention in Edmonds. ECDC 23.40.220.C.7.b. The removal of trees from critical areas and buffers that are hazardous, posing a threat to public safety, or posing an imminent risk of damage to private property; provided, that: i. The applicant submits a report from an ISA- or ASCA-certified arborist or registered landscape architect that documents the hazard and provides a replanting schedule for the replacement trees; ii. Tree cutting shall be limited to pruning and crown thinning, unless otherwise justified by a qualified professional. Where pruning or crown thinning is not sufficient to address the hazard, trees should be removed or converted to wildlife snags; iii. All vegetation cut (tree stems, branches, etc.) shall be left within the critical area or buffer unless removal is warranted due to the potential for disease or pest transmittal to other healthy vegetation or unless removal is warranted to improve slope stability; iv. The land owner shall replace any trees that are removed with new trees at a ratio of two replacement trees for each tree removed (two to one) within one year in accordance with an approved restoration plan. Replacement trees may be planted at a different, nearby location if it can be determined that planting in the same location would create a new hazard or potentially damage the critical area. Replacement trees shall be species that are native and indigenous to the site and a minimum of one inch in diameter at breast height (dbh) for deciduous trees and a minimum of six feet in height for evergreen trees as measured from the top of the root ball; v. if a tree to be removed provides critical habitat, such as an eagle perch, a qualified wildlife biologist shall be consulted to determine timing and methods of removal that will minimize impacts; and vi. Hazard trees determined to pose an imminent threat or danger to public health or safety, to public or private property, or of serious environmental degradation maybe removed or pruned by the land owner' prior to receiving written approval from the city; provided, that within 14 days following such action, the land owner shall submit a restoration plan that demonstrates compliance with the provisions of this title; Comprehensive Plan (Land Use Element) • "The removal of trees should be minimized particularly when they are located on steep slopes or hazardous soils. Subdivision layouts, buildings and roads should be designed so that existing trees are preserved. • "Natural vegetation should be preserved wherever possible to reduce erosion and stabilize slopes, particularly on the downhill property line." • "Woodlands help stabilize soils on steep slopes, and act as barriers to wind and sound. Natural vegetation provides habitat for wildlife. Plants replenish the soil with nutrients. They generate oxygen and clean pollutants from the air." • "Grading should be restricted to building pads and roads only. Vegetation outside these areas should' be preserved." For all of the reasons above, tree removal on this property is not encouraged. Allowed Activities and Exempt Development Proposals... Page 2 of 4 Certain activities are allowed in or near critical area buffers as specified in ECDC 23.40.220. Similarly, certain development proposals may be exempt from Critical Areas requirements (ECDC 23.40.230). If you have any questions about whether your proposed development qualifies as an allowed or exempt activity, please contact a Planner for more information. General Critical Areas Report Requirements... Critical Areas Reports identify, classify and delineate any areas on or adjacent to the subject property that may qualify as critical areas. They also assess these areas and identify any potential impacts resulting from your specific development proposal. If a specific development proposal results in an alteration to a critical area the critical areas report will also contain a mitigation plan. You have the option of completing the portion of the study that classifies and delineates the critical areas and waiting until you have a specific development proposal to complete the study. You may also choose submit the entire study with your specific development application. • Please review the minimum report requirements for all types of Critical Areas which are listed in ECDC 23.40.090.D. There are additional report requirements for different types of critical areas (see below). • Note that it is important for the report to be prepared by a qualified professional as defined in the ordinance. There are options on how to complete a critical areas study and an approved list of consultants that you may choose from. The determination of "suitable slope stability" will be made by both the Planning and Engineering divisions of the City of Edmonds. • In areas where the slope stability is not suitable, projects within Erosion Hazard Areas will require a report by a licensed Geotechnical Engineer or other qualified professional. • Note that it is important for the report to be prepared by a qualified professional as defined in the ordinance. • Report requirements are given in ECDC 23.80.050, and more generally in ECDC 23.40.090.D • Development standards are given in ECDC 23.80.060 and 23.80.070. Study Requirement for Landslide Hazard Areas... I am attaching the tree cutting handout that explains the requirements, as well as a sample plot plan so that you can see what the plot plan will need to look like and how the required information is displayed. The Engineering Division also noted that a site plan is required (memo attached). Property within an Environmentally Sensitive Area, (ESA); as shown on the City ESA Map, or portions of lots that are located within 25 feet of any stream or wetland area; 2. Property which has slopes that exceed 25% percent or 15% percent if subject to earth subsidence provisions of Chapter 19.05 ECDC; 3. Clearing on any lot, developed or undeveloped, which can be divided to create more than one additional lot. APPLICATION REQUIREMENTS The permit application shall contain the following information: 1. The name, address and telephone number of the applicant; 2. Written consent of owner(s) if applicant is not the owner; 3. Vicinity map and plot plan; 4. Adjacent property owners list within 300 feet; 5. A statement of purpose regarding tree removal; 6. Tree cut list, specify species and diameter; 7. Schedule of work; 8. Future landscaping proposal and timetable for replanting. 9. Environmental checklist (verify with a planner that SEPA review is required) PLOT PLAN REQUIREMENTS: 1. Two plot plans to scale; 1"-20' recommended; 2. Topographical information; existing and proposed grades; tree driplines; 3. Location of existing and proposed structures, driveways and utilities; 4. Areas to be cleared, proposed use for each area; 5. Designation of diseased or damaged trees greater than 6 inches in caliper; 6. Designation of trees to be removed and trees to be retained; 7. Designation of wetlands, streams, and other water courses. DEVELOPMENT STANDARDS 3/19/2009 page 2 • #P46 • The following development standards shall be met; 1. No clearing is allowed on a site for the sake of preparing that site for sale or future development. Trees shall be retained to the maximum extent feasible. 2. No trees or ground cover shall be removed from a Native Growth Protection Easement or environmentally sensitive area unless it can be demonstrated that the removal will enhance the site. 3. The City may restrict the date or season in which land may be cleared when such restrictions are necessary for the public health, safety and welfare, or for the protection of the environment. 4. No ground cover or trees within 25 feet of the annual high water mark of watercourses or within 15 feet from the top of banks shall be removed. No mechanical equipment shall operate in such areas unless specifically allowed by the City. 5. The City may require the applicant to relocate or replace trees, provide erosion control methods, hydroseed exposed slopes or protect the site as needed. 6. No land clearing or tree cutting shall be conducted in a wetland, except for the installation of roads and utilities where no other alternative exists, and then only with an approved development plan. 7. Protection measures shall be imposed for all trees which are to be retained on -site during the construction process. TREE DRIPLINE STANDARDS The tree dripline area is the ground surrounding the trunk measured from the outside edge of foliage in all directions. Tree dripline areas shall be protected. No fill, excavation or equipment shall be placed in dripline areas of trees that are to be retained. 2. Rope barriers or hay bales shall be installed to protect roots. 3. Rock walls shall be constructed around the tree, equal to the dripline, when existing grade levels are lowered or raised by the proposal. 4. No ground level impervious surface shall be installed within the dripline area. CONDITIONS OF APPROVAL OF CLEARING/TREE CUTTING PERMIT A permit will be issued if a City site inspection reveals that the plan is in compliance with the provisions of Chapter 18.45 of the ECDC. 2. The permit is valid for one year from the date of issuance. The City may restrict the timing of work to specific dates, times or seasons to protect the environment. No work may commence on the permit until the appeal period of 10 working days from the date of issuance has expired. Upon receipt of a written request, a permit may be extended for six months. Once land clearing or tree cutting has started, it must be completed within 30 days. 3/ 19/2009 page 3 • #P46 9 3. The permit may be revoked or suspended by the City upon discovery that incorrect information was supplied or upon any violation of the provisions of Chapter 18.45 ECDC. 4. Approved plans may not be amended without written authorization from the City of Edmonds. CONDITIONS OF DENIAL The permit will be denied if the proposed plan calls for the unnecessary removal of trees or other vegetation. NATIVE GROWTH PROTECTION EASEMENTS A Native Growth Protection Easement is a restrictive area where no native, pre -development vegetation shall be disturbed or removed EXCEPT for removal pursuant to an enhancement program or to remove dead or diseased vegetation, when necessary. The purpose of this type of easement is to protect steep slopes, control erosion, mitigate landslide or seismic hazards, and protect creeks, wetlands, riparian corridors and wildlife. Native growth protection areas are normally defined during the development review process and shown on recorded plats, short plats or approved site development plans. BONDING The applicant shall post a performance bond with the Planning Department in the amount to cover installation of all temporary erosion control measures and the clearing work to be done on the property. The bond must include the cost of any proposed re -vegetation. Bond forms are available from the Planning Department. VIOLATIONS Any violation of the provisions of this chapter shall constitute a misdemeanor. A separate offense shall be charged for each day the violation exists, not to exceed a fine of $1,000 per day and/or $500 per tree to a maximum of $10,000. The removal of the trees will have minimal impact on the surrounding environs, no impact on slope stability, and no detrimental effect on the immediate tree canopy. Description: This is a large, heavily wooded property that makes up the north end of a small forest complex.. The first set of trees that are to be removed (A, B, and C) are not part of the forest system. Only one is in the back of the home, the other two stand alone in front. The `D' cedar will most likely be removed at a later date and it is also not part of the system. The remaining ones are understory trees in poor condition that have been subordinated. These also will probably be removed at a later date. Each of the trees in the following list was each measured at the standard height of 54" above grade (DSH) and their heights approximated. They are designated on the accompanying plot plans with blue circles. A) Fir 22" DSH, 90' tall. This tree is standing midway up the incline behind the home on the north side. It is in decline and is symptomatic of Armillaria. B) Fir 28" DSH, 95' tall standing 4' to the left of the driveway at the NE corner of the property. Client is concerned with proximity of roots to drive and to water main which appears to run about five feet out along the south side of the tree.
