Existing Use: I" Security Bank currently operates a bank and drive-thru at the subject site. H. Proposed Use: The applicant is proposing to remove the existing bank and drive-thru and construct a new 2,474 square foot bank branch with 18 parking spaces. Two existing curb cuts will also be removed. Drive-thru facilities are now prohibited in the BP zone; therefore, that feature will not be rebuilt. I. Review Process: The hearing examiner shall review and decide on the conditional use permit application as a Type III-B decision as set forth in ECDC 20.01.003. III. SEPA THRESHOLD DETERMINATION The proposal is exempt from State Environmental Policy Act review pursuant to WAC 197-11- 800(1)(a)(iii) because the new building is less than 4,000 square feet and less than 20 parking spaces are being provided. IV. PUBLIC NOTICE A "Notice of Development Application and Public Hearing" was published in the Herald Newspaper and was posted at the subject site, Public Safety Complex, Development Services Department, and Library by September 22, 2010. This notice was also mailed to residents within 300 feet of the site by September 22, 2010, using a mailing list provided by the applicant with the initial submittal of the application. [Attachment 6] V. NATURAL ENVIRONMENT A. Critical Areas: A Critical Areas Checklist was submitted in 1992 (CRA-1992-0092) and a waiver from further study was issued at that time. B. Topography, Soils, Wildlife, and Vegetation: The subject site is essentially flat and contains mature vegetation and trees on the western portion of the property. Typical urban landscaping is also present. VI. NEIGHBORHOOD CHARACTERISTICS The subject site comprised of three smaller parcels and is triangular in shape; it is bounded by Edmonds Way on the south and Paradise Lane on the north. Adjacent to the west are single family zoned and developed parcels as are those parcels to the north across Paradise Lane. The parcels along Edmonds Way to the east are zoned Planned Business (BP) and Neighborhood Business (BN). While some of these parcels do have businesses on them, others are currently underdeveloped with older single family residences and thus are candidates for redevelopment. Further back from Edmonds Way, on both the north and the south, are single family residential areas. VII. COMPREHENSIVE PLAN The Comprehensive Plan identifies the subject site (and those along to Edmonds Way) as "Planned Business/Neighborhood Business" within the Westgate Corridor (see inset on the next page). The parcels to the west and north are identified as "Single Family Urban 1" while those along Edmonds Way are also "Planned Business/Neighborhood Business" within the Westgate Corridor. The City of Edmonds Comprehensive Plan has a vision for business and commercial development along Edmonds Way, excerpts of which are included below (pg 74): E. The Westgate Corridor is generally located between the 100th Avenue W (9th Avenue S)/ Edmonds Way intersection and where Edmonds Way turns north to enter the downtown area. Page 2 of 7 0 Security Bank (CUP) File No. PLN-2010-0060 By virtue of this location, this corridor serves as both a key transportation corridor and as an entry into the downtown. Long-established neighborhoods lie near both sides of the corridor. The plan for this corridor is to recognize its multiple functions by providing opportunities for small-scale businesses while promoting compatible development that will not intrude into established neighborhoods. E.2. Permit uses in planned business areas that are primarily intended to serve the local neighborhood while not contributing significantly to traffic congestion. E.4. Use design review to encourage the shared or joint use of driveways and access points by development onto SR-104 in order to support the movement of traffic in a safe and efficient manner. Site access should not be provided from residential streets unless there is no feasible alternative. E.S. Use design review to ensure that development provides a transition to adjacent residential neighborhoods. Make use of natural topography to buffer incompatible development whenever possible. The site is currently occupied by a branch of 1" Security Bank with a drive-thru window so replacing it with a new bank will not result in a change of use on the site. Two curb cuts are proposed to be removed, however, one from Edmonds Way and one from Paradise Lane. This should help ease congestion along Edmonds Way and reduce traffic onto Paradise Lane. There are currently several parking spaces adjacent to the bank within the Paradise Lane right-of-way that will also be removed which will greatly improve traffic movement in that area. It is uncertain why those spaces are there but all spaces for the new bank must be located on the bank property. The drive-thru feature may not be rebuilt when the site is demolished in order to comply with requirements for the BP zone. (see Section VIH.A). According to the applicant, the new bank is proposed to include modulated facades, a pitched roof, and stepped parapet heights with a mix of residential exterior finishes. This appearance should provide a suitable transition to the residential areas to the west and north. While new landscaping and appropriate street trees will be installed along Edmonds Way and Paradise Lane, the existing trees on the western portion of the site should be retained to the maximum extent feasible and protected during the development process in accordance with Page 3 of 7 0 Security Bank (CUP) File No. PLN-2010-0060 ECDC 18.45.050. These trees currently provide the residential areas to the west and north with a mature, natural buffer to the traffic and commercial activity on Edmonds Way. VIII. APPLICABLE DEVELOPMENT CODES A. ECDC 16.53 (Planned Business — BP) Pursuant to ECDC 16.53.010.C.3, financial institutions are a primary use that requires a conditional use permit. The applicant has filed the subject application for a conditional use permit in compliance with ECDC 20.05. It should be noted that drive-in/drive-thru businesses are now a prohibited use according to ECDC 16.53.010.E.2, which is why the drive-thru aspect of the bank may not be re-established once the current building is removed. The BP zone requires 15' landscaped setbacks from R-zoned parcels according to ECDC 16.53.020.C: "The required setback from R zoned property shall be permanently landscaped with trees and ground cover and permanently maintained by the owner of the BP FS— co PS-6 13TH WAY �V N lot. " The site's western setback is adjacent to residentially -zoned property. A 15' setback area must be maintained in this location and be appropriately landscaped. Per ECDC 20.13.020.C, the existing trees should serve as the bulk of the landscaped buffer and be retained as well at the northeast corner of the site along Paradise Lane (ECDC 20.13.020.C). The building shown on the elevations (Attachment 4) scales to approximately 23 feet. The height requirement will be verified at building permit. The site is currently made up of three smaller parcels. In order to satisfy code requirements for the new construction, the three parcels must be combined or the interior lot lines removed prior to redevelopment on the site. B. ECDC 17.50 (Off -Street Parkinm) According to ECDC 17.50.020.13.4, banks require 1 parking space per 200 square feet of gross floor area. Since the proposed building will be 2,474 square feet, 12.37, or a rounded 12 parking spaces, are required. Eighteen spaces are shown on the site plan (Attachment 3); compliance will be verified at building permit. Within the parking lot area, Type V landscaping is required at the amounts identified in ECDC 20.13.030.E. Page 4 of 7 I" Security Bank (CUP) File No. PLN-2010-0060 C. ECDC20.05 (Conditional Use Permits) Pursuant to ECDC 20.05.010, no conditional use permit may be approved unless all of the following findings can be made: 1. That the proposed use is consistent with the Comprehensive flan. Refer to Section VII of this report for a discussion on consistency with the Comprehensive Plan. Staff feels the proposal is consistent the Planned Business designation within the Westgate Corridor. The proposal will also be reviewed against the General Design Objectives of the Comprehensive Plan (pgs 90 — 98) at building permit. 2. That the proposed use, and its location, is consistent with the purposes of the zoning ordinance and the purposes of the zone district in which the use is to be located, and that the proposed use will meet all applicable requirements of the zoning ordinance. Financial institutions (banks) are a permitted use in the BP zone if a conditional use permit is first obtained. Refer to Section VIII.A of this report for a discussion on how the proposal meets the development standards of the BP zone. 3. That the use, as approved or conditionally approved, will not be significantly detrimental to the public health, safety and welfare, and to nearby private property or improvements unless the use is a public necessity. The proposed bank does not appear to be detrimental to the public health, safety and welfare of the nearby property owners. The proposed bank replaces an existing bank and will provide for roughly the same volume of activity as the existing bank provides. The proposed building and site design will provide safe access to and from the building and adjacent areas. Two curb cuts will be eliminated as will several nonconforming on -street parking spaces on Paradise Lane. The existing drive -up window will also be eliminated with the redesign and so the parcel will come into compliance with the BP zone requirement that prohibits drive-thrus. 4. The hearing examiner shall determine whether the conditional use permit shall run with the land or shall be personal. If it runs with the land and the hearing examiner finds it in the public interest, the hearing examiner may require that it be recorded in the form of a covenant with the Snohomish County auditor. The hearing examiner may also determine whether the conditional use permit may or may not be used by a subsequent user of the same property. The applicant did not make any requests with regard to transferability. If a different bank would want to use the property in the future, staff feels the conditional use should be transferable. D. ECDC 20.10 (Design Review) Since SEPA was not required for the project, general design review will be completed by staff with the associated building permit. This will include review of the building and site design against the requirements of the Comprehensive Plan and development code (Chapter 20.11) along with analysis of landscaping and street trees (Chapter 20.13). Type III landscaping is shown on the site plan (Attachment 3) along Edmonds Way and Paradise Lane with Type I along the western property line of the site. The Edmonds Street Tree plan indicates that the applicable street trees along Edmonds Way are: Liriodendron tulipifera / Tulip Tree Page 5 of 7 I" Security Bank (CUP) File No. PLN-2010'-0060 Cercidiphyllum japonicum / Katsura Tree Quercus rubra / Red Oak These trees must be 3" caliper unless otherwise approved. While a specific street tree is not called out for the Paradise Lane side of the development, selecting one of the above species for use in the Type III landscaping areas along Paradise Lane is encouraged. The seating area at the southeastern corner of the site will be reviewed with the building permit. E. ECDC 20.60 (Signs) According to ECDC 20.60.025.A.1, "ft]he maximum total permanent sign area for allowed or permitted uses in the BN, BC, BD and CW zones shall be one square foot of sign area for each lineal foot of wall containing the main public entrance to the primary building...." Signage in the BP zone is treated like the BN zone. A maximum of three signs are permitted for the site according to ECDC 20.60.025.A.4. Window signs are exempted from the above requirements but must meet the requirements of ECDC 20.60.035. Compliance with the sign code will be reviewed at building permit. IX. TECHNICAL COMMITTEE This application was evaluated by the City's Building and Engineering Divisions as well as the Public Works and Parks and Recreation Departments and Fire District #1. [Attachment 7] Public Works and Parks and Recreation had no comments on the proposal whereas Building and the Fire District noted that they had no comment at this time but would during review of the subsequent building permit. Engineering encourages the applicant to implement low impact development techniques such as pervious pavements into the project design. X. PUBLIC COMMENTS As of the date of this staff report, no public comments have been received about the proposal. XI. RECOMMENDATION Based on the analysis and attachments in this report, staff feels that the proposal is consistent with the conditional use criteria for approval listed in ECDC 20.05 and recommends that the Hearing Examiner GRANT a conditional use permit for a financial institution for I" Security Bank at 620 Edmonds Way with the following conditions: A. This application is subject to the applicable requirements contained in the Edmonds Community Development Code (ECDC) and it is the responsibility of the applicant to ensure compliance with the various provisions contained in these ordinances. B. The applicant shall apply for a lot line adjustment or lot combination in order to remove the interior lot lines that currently exist between the three parcels that make up the project site. The adjustment/combination must be approved by the City prior to issuance of a building permit for the new bank. C. The trees on the western portion of the site shall be retained to the maximum extent feasible and protected during the development process in accordance with ECDC 18.45.050. D. The applicant is encouraged to implement low impact development techniques such as pervious pavements into the project design. E. This conditional use permit should be transferable. Comprehensive Plan: E. Goals for Westgate Corridor E.1. Our site sits on a peninsula of land just before Edmonds Way starts to drop down the hill. This particular location is the perfect location for a gateway to the downtown area. Our design provides for a true gateway by locating a plaza space at the SE tip of our property. This plaza will be a combination of landscape, hardscape and most importantly a monument sign which will share double duty as identifying "welcome to downtown Edmonds" and business identification. In addition, our building has a unique and creative glass faced elevation which acts as a back drop to the plaza and is situated to address the traffic on Edmonds Way. Landscaping along Edmonds way will meet the code requirements which included street trees. E.2. 1" Security Bank is a local community bank. The bank has been located at this location since 1995 and serves a large number of residents within the surrounding neighborhood area. To help with ferry traffic congestion our new site plan reduces the number of curb cuts from four to two. Most importantly we are removing the one on Edmonds Way this is closest to the intersection of Edmonds Way and Paradise Lane. This will significantly improve traffic congestion. E.3. We are providing a new sidewalk that leads from the sidewalk along Edmonds Way up to the new front door and across our site to the Paradise Lane. Location of local transit stops are unknown at this time. E.4 As stated in E.2. We have reduced the number of curb cuts from the site from four to two. The design of the parking lot reuses existing curb cuts and keeps them at opposite ends of the parking lot, so it minimizes people cutting through the parking lot to access roads on either side of the site. E.5 Our project is residential in scale at just over 2,400 sf. We will have landscaping around the entire perimeter of the site including the 15' buffer on the west side next to the residence. The design of the building includes modulation of the facades, a pitched roof, stepped parapet heights and will have a mixture of residential exterior finishes. All of these elements will help the bank identify and fit in with its surrounding neighbors some of which include additional commercial buildings along the other side of Edmonds Way.
