SUMMARY OF APPLICATION: The applicant is proposing a lot line adjustment between two parcels located at 20002 and 20018 Maplewood Drive (Parcel 1 and Parcel 2, respectively) — see Attachments 1 and 2. Each lot currently contains a single family dwelling and associated structures. B. DECISION: Based on the Findings of Fact, Conclusions, and Attachments to this report, the following decision is issued by the City of Edmonds Planning Division. The lot line adjustment, as proposed, is APPROVED with the following conditions: 1. The applicant shall take the map to the Snohomish County Auditor's Office for recording. Please make sure that all documents to be recorded meet the Snohomish County Auditor's requirements for recording, including all signatures in black ink. 2. After recording the lot line adjustment, the applicant must provide the City of Edmonds Planning Division with ONE (1) copy of the recorded map (with the recording number shown). The City will not consider the lot line adjustment to have been completed until this is done. 3. The applicant must file new deeds for each of the parcels with Snohomish County, as appropriate, and must provide the City of Edmonds Planning Division with ONE (1) copy of each new deed. The City will not consider the lot line adjustment to have been completed until this is done. GENERAL INFORMATION 1. Reguest: To adjust lot lines between adjacent parcels addressed as 20002 and 20018 Maplewood Drive. Both parcels are zoned Single Family Residential (RS-12). 0 Review Process: A lot line adjustment is a Type I permit pursuant to ECDC 20.01.003 — the director reviews the project and issues an administrative decision pursuant to ECDC 20.75.050(C). 3. Owner/Applicant: Thomas J. and E. Kristine Jurich. 4. 5. Tax Parcel Numbers: 00506700001600 (Parcel 1) and 00506700001502 (Parcel 2). Location: 20002 and 20018 Maplewood Drive, Edmonds WA' 98026. 6. Zoning: Single Family Residential (RS-12). City of Edmonds Zoning Map, December 31, 2009 F 7. Acreage / Square Footage: 11,567 square feet conveyed from Parcel 2 to Parcel 1. 8. Existing Use: Each parcel has on it a single family dwelling and associated structures. 9. Proposed Use: No change. 10. Shoreline Management: The proposal is not subject to Shorelines of the State regulations. 11. Access: Both parcels will continue to take access from Maplewood Drive. 12. Dedications: No dedication of land is required by the City Engineer with the lot line adjustment. 13. Improvements: No improvements are required by the City Engineer with the lot line adjustment. B. SEPA THRESHOLD DETERMINATION Review by the State Environmental Policy Act (SEPA) is not required with this application because the proposal is to adjust the property line between two adjacent lots and is exempt under WAC 197-11-800 (1)(b)(i) (Categorical Exemptions). No comments or conditions were requested. D. NEIGHBORHOOD CHARACTERISTICS This site is located in a single family neighborhood near at the top of the `Bowl' in central Edmonds. All nearby parcels are zoned Single Family Residential (RS-12) and developed with single family residences. E. COMPREHENSIVE PLAN COMPLIANCE The Comprehensive Plan designation for these parcels is "Single Family — Resource". There is no proposed change to the existing designation; the current proposal meets the intent of the Comprehensive Plan. F. ZONING CODE COMPLIANCE (ECDC 16.20) 1. Lot Area: Minimum lot area is 12,000 square feet. Existing Lot Area Proposed Lot Area Parcel 1 28,807 square feet 40,374 square feet Parcel 2 23,577 square feet 12,010 square feet 2. Lot Width: Minimum lot width for RS-12 is 80 feet. Lot width for Parcel 1 will become 110.62 feet while lot width for Parcel 2 will become 89.38 feet. 3. Setbacks: Shifting the lot line between Parcel 1 and Parcel 2 will result in slightly different side setbacks. The RS-12 zone requires a minimum ten (10) foot side setback. With the adjustment, Parcel 1 will have a 25 foot side setback from the south property line while Parcel 2 will have a 10 foot side setback from the north property line. The rear setback on Parcel 2 will be reduced from approximately 180 feet to a minimum of about 31 feet (the zone requires at least 25 feet). All other setbacks will remain unchanged. 4. Lot Coverage / Floor Area: There is a maximum 35% structural lot coverage for the zone. Even with the proposed change, both lots will have well less than 35% coverage. 5. Corner Lot Determination: Neither lot is a corner lot. 6. Flag Lot Determination: Neither lot is a flag lot. The proposal appears to meet the intent of the zoning ordinance. G. LOT LINE ADJUSTMENT COMPLIANCE ECDC (ECDC 20.75.050) The lot line adjustment shall be approved unless the proposed adjustment will: 1. Create a new lot, tract, parcel, site, or division; 2. Reduce the setbacks of existing structures below the minimum required by code or make existing nonconforming setbacks of existing structures more nonconforming than before; 3. Reduce the lot width or lot size below the minimum required for the applicable zone; Page 3 of 4 Jurich Lot Line Adjustment File: PLN-2010-0077 4. Transform a nonbuildable lot, tract, parcel, site or division into a buildable lot, tract, parcel, site or division; 5. Would otherwise result in a lot which is in violation of any requirement of the ECDC. The proposal will not create a new lot, tract, parcel, site or division; Parcel 2 will remain but be smaller while Parcel 1 will become larger relative to its current size (this change may anticipate a future short plat of Parcel 1). Regardless, both lots will be compliant with the minimum lot size for the zone. The proposal will reduce the side setbacks between the existing structures on the parcels but in each case the minimum 10 foot side setback distance will be maintained. As proposed, both adjusted parcels will meet minimum lot width and lot size requirements. The proposal is not transforming a nonbuildable lot into a buildable lot — both currently have access and are developed with single family dwellings. There is no indication that this proposal is in violation of the Edmonds Community Development Code. III. APPEALS Type I permit decisions may be appealed by a party of record to Snohomish County superior court within 21 days of the date of the decision pursuant to ECDC 20.07.006. IV. LAPSE OF APPROVAL Section 20.75.050.F states, "An application for a lot line adjustment shall expire one year after a complete application has been filed with the city. An extension up to an additional year may be granted by the Edmonds planning manager or his/her designee upon a showing by the application of reasonable cause." V. NOTICE TO THE COUNTY ASSESSOR The property owner may, as a result of the decision rendered by the staff, request a change in the valuation of the property by the Snohomish County Assessor's Office.
