I have determined that the application is complete and have reviewed the lot
line adjustment application pursuant to Chapters 20.01 and 20.75 of the
Edmonds Community Development Code'.

A. SUMMARY OF APPLICATION: The applicant is proposing a lot line adjustment
between two parcels located at 15730 and 15806 75t" Place West (Lot A and Lot B,
respectively) — see Attachments 1 and 2.
B. DECISIONS: Based on the Findings of Fact, Conclusions, and Attachments to this report,
the following decision is issued by the City of Edmonds Planning Division. The lot line
adjustment, as proposed, is APPROVED with the following conditions:
1. Provide the City a clean copy of the lot line documents for endorsement.
2. The applicant shall take the map to the Snohomish County Auditor's Office for
recording. Please make sure that all documents to be recorded meet the Snohomish
County Auditor's requirements for recording, including all signatures in black ink.
3. After recording the lot line adjustment, the applicant must provide the City of Edmonds
Planning Division with ONE (1) copy of the recorded map (with the recording number
shown). The City will not consider the lot line adjustment to have been completed
until this is done.
4. The applicant must file new deeds for each of the parcels with Snohomish County, as
appropriate, and must provide the City of Edmonds Planning Division with ONE (1)
copy of each new deed. The City will not consider the lot line adjustment to have been
completed until this is done.

B. SEPA THRESHOLD DETERMINATION
Review by the State Environmental Policy Act (SEPA) is not required with this application
because the proposal is to adjust the property line between two adjacent lots and is exempt
under WAC 197-11-800 (1)(b)(i) (Categorical Exemptions).

C. TECHNICAL COMMITTEE
This application was reviewed by the City's Engineering Division, the Public Works
Department, and Fire District #1. No comments or conditions were requested.
D. NEIGHBORHOOD CHARACTERISTICS
This site is located in a single family neighborhood in northernmost Edmonds. All nearby
parcels are zoned Single Family Residential RS-12 or RS-20 and developed with single
family residences.
E. COMPREHENSIVE PLAN COMPLIANCE
The Comprehensive Plan designation for these parcels is "Single Family — Resource". There
is no proposed change to the existing designation; the current proposal meets the intent of the
Comprehensive Plan.
F. ZONING CODE COMPLIANCE (ECDC 16.20)
1. Lot Area: Minimum lot area is 12,000 square feet.

While Lot A is currently nonconforming with respect to lot area, it would be developable
in any case according to ECDC 17.40.030. With the additional square footage, the lot
will become conforming with respect to area and width.
2. Lot Width: Minimum lot width for RS-12 is 80 feet. Both Lots A and Lot B will
maintain the 80' minimum lot width — Lot A on the eastern portion of the parcel, Lot B
on the west.
3. Setbacks: The RS-12 zone requires a minimum ten (10) foot side setback. With the
adjustment, Lot A will have a greater amount of area with which to construct a new
dwelling unit. Lot B, on the other hand, will have less of a northern side setback;
however, the existing residential structure will still be in excess of the minimum required
10 feet (approximately 20 feet). A portion of an existing rockery will be located within
the proposed north side setback on Lot B but the top the structure is less than 3' above
original grade as indicated in the associated topographic survey (Attachment 3). All
other setbacks will remain unchanged; however, it is noted that there appear to be
encroachments on the northern boundary line of Lot A as well as a boundary line
agreement between Lot A and its northern abutter that could affect future redevelopment
of Lot A. That said, the northern property line of Lot A is not affected by the proposed
adjustment.
4. Lot Coverage / Floor Area: There is a maximum 35% structural lot coverage for the
zone. Even with the proposed change, both lots will have well less than 35% coverage.
5. Corner Lot Determination: Neither lot is a corner lot.
6. Flag Lot Determination: Neither lot is a flag lot.
The proposal appears to meet the intent of the zoning ordinance.

G. LOT LINE ADJUSTMENT COMPLIANCE ECDC (ECDC 20.75.050)
The lot line adjustment shall be approved unless the proposed adjustment will:
1. Create a new lot, tract, parcel, site, or division;
2. Reduce the setbacks of existing structures below the minimum required by code or make
existing nonconforming setbacks of existing structures more nonconforming than before;
3. Reduce the lot width or lot size below the minimum required for the applicable zone;
4. Transform a nonbuildable lot, tract, parcel, site or division into a buildable lot, tract,
parcel, site or division;
5. Would otherwise result in a lot which is in violation of any requirement of the ECDC.
The proposal will not create a new lot, tract, parcel, site or division; Lot B will remain but be
smaller while Lot A will become larger relative to its current size.
The proposal will reduce the northern side setback of Lot B but the minimum 10 foot side
setback distance will be maintained.
As proposed, both adjusted parcels will meet minimum lot width and lot size requirements.
The proposal is not transforming a nonbuildable lot into a buildable lot — both currently have
access to 751h Place West and are or could be developed with single family dwellings.
There is no indication that this proposal is in violation of the Edmonds Community
Development Code.
Type I permit decisions may be appealed by a party of record to Snohomish County superior
court within 21 days of the date of the decision pursuant to ECDC 20.07.006.
Section 20.75.050.17 states, "An application for a lot line adjustment shall expire one year after a
complete application has been filed with the city. An extension up to an additional year may be
granted by the Edmonds planning manager or his/her designee upon a showing by the application
of reasonable cause."
The property owner may, as a result of the decision rendered by the staff, request a change in the
valuation of the property by the Snohomish County Assessor's Office.

2. Notification and Covenant of Notification. The above referenced site
(hereinafter "subject site") lies within an area which has been identified by the City
of Edmonds as having a potential for earth subsidence or landslide hazard. The
risks associated with development of the site have been evaluated by technical
consultants and engineers engaged by the applicant as a part of the process to
obtain a building permit for the subject site. The results of the consultant's reports
and evaluations of the risks associated with development are contained in building
permit file number (insert number) on rile with the City of
Edmonds Building Department. Conditions, limitations, or prohibitions on
development may have been imposed in accordance with the recommendations of

the consultants in the course of permit issuance. The conditions, limitations, or
prohibitions may require ongoing maintenance on the part of any owner or lessee or
may require modifications to the structures and earth stabilization matters in order
to address future or anticipated changes in soil or other site conditions. The
statements and conditions proposed by the OWNERS' geotechnical engineer,
geologist, architect and/or structural engineer are hereby incorporated by reference
from the contents of the file as fully as if herein set forth. Any future purchaser,
lessee, lender or any other person acquiring or seeking to acquire an interest in the
property is put on notice of the existence of the content of the file and the City urges
review of its contents. The file may be reviewed during normal business hours or
copies obtained at the Building Department, City of Edmonds, 121 Sth Avenue
North, Edmonds, Washington 98020.
3. Indemnification and Hold Harmless. The undersigned OWNERS
hereby waive any and all liability associated with development, stating that they
have fully informed themselves of all risks associated with development of the
property and do therefore waive and relinquish any and all causes of action against
the City of Edmonds, its officers, agents and employees arising from and out of such
development. In addition, the OWNERS on behalf of themselves, their successors in
interest, heirs and assignees, do hereby promise to indemnify and hold harmless the
City of Edmonds, its officers, agents and employees from any loss, claim, liability or
damage of any kind or nature to persons or property either on or off the site
resulting from or out of earth subsidence or landslide hazard, arising from or out of

arising out of any false, misleading, or inaccurate information provided by the
OWNERS, their employees, or professional consultants in the course of issuance of
the building permit.
4. I_nsurance Requirement. In addition to any bonding which may be
required during the course of development, the Community Services Director
has/has not (strike one) specifically required the maintenance of an insurance policy
for public liability coverage in the amount and for the time set forth below in order
to provide for the financial responsibilities established through the indemnification
and hold harmless agreement above:
5. Covenant to Touch and Concern the Land. This covenant of
notification and indemnification/hold harmless touches and concerns the subject
tract and shall run with the land, binding, obligating and/or inuring to the benefit of
future owners, heirs, successors and interests or any other person or entity
acquiring an interest in property, as their interest may appear. This provision shall
not be interpreted to require a mortgagor or lender to indemnify the City except to
the extent of their loss nor to obligate, such persons to maintain the insurance above
required.
