Dear Mr. Miller,
I am following up regarding the two maple trees that were cut in the steep slope critical area on
your property at 1304 Olympic Avenue on or about June 9, 2011. As I understand it, work
similar to this had occurred in the past based on maintaining tree heights in accordance with a
view covenant from 1952. As indicated in the Edmonds Community Development Code
(ECDC), it is not that tree work and other alterations in critical areas are strictly prohibited;
rather, because the work was proposed in a critical area, a permit is required. In this instance, the
resident at 1304 Olympic notified the City of the work and, on inspection, the City issued a stop -
work order and indicated that a permit was required.
Mr. Van Schilling, acting as the agent for the post -event permit, submitted application materials
on January 4, 2012. Additional clarification is required in order to process the application,
however. Please address the following comments in a written response and/or by providing
updated plans, as appropriate:
1. Signature on Land Use Application. Mr. Schilling submitted a land use application
on January 4; however, it is lacking your signature as the Property Owner. You could
submit a second application form with your signature or simply come to City Hall and
sign the existing form.
2. Restoration plan. Because the two maple trees were cut within a steep slope critical
area, replacement vegetation must be installed according to the ECDC
23.40.220.C.7.b. Two trees must be replaced for each one cut. As it is, two maples
were cut so four trees would have to be installed in their place. Given the location,
vine maples or a similar lower -growing native species would probably be appropriate.
Working with a certified arborist or landscape architect, submit a plan showing where
the replacements will be installed along with a cost -estimate for the work.
If I do not receive a response from you by Monday, March 5, 2012, the permit will be forwarded
to Code Enforcement for additional action.
