SUMMARY OF APPLICATION: The request is to shift lot lines between two existing lots to make one larger (19011 Olympic View Drive) and one slightly smaller (unaddressed parcel to the south at the corner of Olympic View Drive and 190th Place SW), B. DECISION OF LOT LINE ADJUSTMENT: Based on the Findings of Fact, Conclusions, and Attachments to this report, the following decision is issued by the City of Edmonds Planning Division. The lot line adjustment, as proposed, is APPROVED 1. The shed shown as 'to be removed' on Lot 1 near Lot 2 shall be removed prior to final approval of this lot line adjustment. 2. Submit signed and notarized documents to the Planning Division for final review and endorsement. 3. Once the documents have been endorsed by the City, the applicant shall take the signed documents up to the Snohomish County Auditor's Office for recording. Please make sure that all documents to be recorded meet the All Edmonds Community Development Code (ECDC) citations can be accessed online at . . ........ . ....... . .. Page 2 of 6 8. Existing Use: 19011 Olympic View Drive (Lot 1) is developed with single-family home. Lot 2 (unaddressed parcel) is vacant. 9. Proposed Use: No changes are proposed at this time. Any future projects will have to meet applicable City codes in effect at the time of development. 10. Access: 19011 Olympic View Drive takes access off of 1901h Place SW. The vacant lot to the south could take access either from Olympic View Drive or 190th Place. 11. Dedications: No dedication of land is required by the City Engineer with the proposed lot line adjustment. 12. Improvements: No improvements are required by the City Engineer with the proposed lot line adjustment. B. SEPA THRESHOLD DETERMINATION State Environmental Policy Act (SEPA) review is not required for lot line adjustments. C. TECHNICAL COMMITTEE This application was reviewed by the City's Planning and Engineering Divisions as well as the Public Works Department. Staff noted that the initial survey submitted on April 6, 2012 (Attachment 2), showed the south property line of Lot 2 incorrectly in that it did not match the County Assessor's plat records nor the submitted boundary line adjustment certificate. (Attachments 3 — 5) The Applicant submitted an updated survey on July 25, 2012, showing the corrected south lot line for Lot 2. (Attachment 6) On a related note, it is unknown why the 190th Place SW physical street location was constructed partially outside the platted right-of-way shown on the Edmonds Seaview Tracts (comparing Attachments 3 and 6) but the right-of-way location (and adjacent private property lines) can only be changed through a process of street vacation and dedication. This is not a process that will be undertaken with the current application and regardless of the road's location, the City maintains and uses the road through prescriptive rights. D. NEIGHBORHOOD CHARACTERISTICS The surrounding area is zoned and developed single-family residential. The area was annexed by the City of Edmonds in 1963 and many of the homes in the vicinity were originally built in the County prior to annexation. E. COMPREHENSIVE PLAN COMPLIANCE The Comprehensive Plan designation for these parcels is "Single Family — Resource." There is no proposed change to the existing designation. The current proposal meets the intent of the Comprehensive Plan. Page 3 of 6 F. ZONING CODE COMPLIANCE (ECDC 16.20) 1. Lot Area: L The minimum lot area in the RS-12 zone is 12,000 square feet. Lot Width: The minimum lot width of the RS-12 zone is 80 feet. As proposed, both lots satisfy this requirement. 3. Setbacks: Within the RS-12 zone the property line setbacks are: Zone Street Setback Side Setback Rear Setback RS-12 25 feet 10 feet 25 feet The existing house on Lot 1 appears to meet RS-12 setback requirements (an existing shed is 'to be removed'). Lot 2 is currently vacant. All future development on either lot will have to comply with the setback requirements applicable at that time. 4. Lot Coverage / Floor Area: The maximum structural lot coverage for the RS-12 zone is 35%. The current structural lot coverage for Lot 1 is approximately 4,000 square feet which will cover a total of 7.5% of the proposed lot. Lot 2 is vacant. All future development on either lot will have to comply with the lot coverage requirements. 5. Corner Lot Determination: Lot 2 is a corner lot. Lot 1 would be considered an irregular lot — it has frontage on both Olympic View Drive and 190th Place SW but does not sit at the intersection of the two roads. 6. Flag Lot Determination: Neither lot is considered a flag lot. Page 4 of 6 The proposal meets the intent of the Zoning Ordinance. G. ENVIRONMENTAL ASSESSMENT Both parcels appear to have some moderately steep slopes throughout but a critical area determination has yet to be completed for either parcel. Regardless, it does not appear that the proposed lot line adjustment will have a negative impact on the environmental amenities on the subject properties. H. LOT LINE ADJUSTMENT COMPLIANCE ECDC (ECDC 20.75.050) A lot line adjustment shall be approved unless the proposed adjustment will: 1. Create a new lot, tract, parcel, site, or division, The proposal will not create a new lot, tract, parcel, site, or division. The two existing lots will simply change size and dimension. 2. Reduce the setbacks of existing structures below the minimum required by code or make existing nonconforming setbacks of existing structures more nonconforming than before; The proposal will not reduce the setbacks of existing structures or make existing structures more nonconforming. A shed near the proposed Lot 2 is shown to be removed and this has been made a condition of approval. 3. Reduce the lot width or lot size below the minimum required for the applicable zone, The minimum lot width is 80 feet within the RS-12 zone. Both lots will continue to meet this requirement and both will be in excess of the 12,000 square foot minimum lot size. 4. Transform a nonbuildable lot, tract, parcel, site or division into a buildable lot, tract, parcel, site or division; The proposal does not transform a nonbuildable lot into a buildable lot. S. Would otherwise result in a lot which is in violation of any requirement of the ECDC. There is no indication that this proposal is in violation of the Edmonds Community Development Code. Type I permit decisions may be appealed by a party of record to Snohomish County Superior Court within 21 days of the date of the decision pursuant to ECDC 20.07.006. The property owner may, as a result of the decision rendered by the staff, request a change in the valuation of the property by the Snohomish County Assessor's Office.
