Good morning,
This email is being sent in follow-up to your request to defer construction of the access for Lots A &
B to the time of building permit issuance. The following Edmonds Community Development Code
(ECDC) sections apply to your request -
ECDC 20.75.120.A Review of Improvement Plans – Timing
ECDC 20.75.130.D Installation of Improvements – Short Subdivision – Deferred Installation
ECDC 20.75.120.A states “Timing. If improvements are required as a condition of preliminary
approval of a subdivision, the applicant shall submit the improvement plan to the director of public
works for review and approval, allowing sufficient time for proper review before expiration of the
preliminary plat approval.”
ECDC 20.75.130.D states “Short Subdivision – Deferred Installation. If the community development
director determines that installation of improvements will not be needed at the time of the approval
of the final plat of the short subdivision, the improvements shall be installed or guaranteed by bond
before issuance of any development permit for any lot shown on the preliminary plat. This condition
shall be stated on the final plat, and shall be binding on all later owners of lots created by the
subdivision.”
After further review of your request, it has been determined that if deferral is to be allowed for the
subject project then deferral of all improvements would make the most sense, versus just deferral of
the access. Deferral of only the access is problematic in that the installation of the detention system
requires significant cuts to the existing steep slope and exposes the site to an increased risk for
erosion hazards. Should you decide to move forward with deferring the improvements the following
will be required:
1)A letter to the City clearly explaining why you are requesting to defer installation of all the
improvements for the subject property.
2)A complete set of civil construction plans, including all elements that need to be constructed
as conditions of short plat approval. This would include design of the retaining wall as
construction of the access road could not occur without a retaining wall.
3)Acknowledgement/Agreement by the applicant that a condition will be placed on the face of
the short plat recording documents stating that all required improvements shall be installed
as a condition of building permit approval for Lot A. A performance bond will need to be
posted for all required improvements prior to the issuance of said building permit. A
building permit for Lot B shall not be issued until all required improvements have been
constructed.
4)A similar statement shall also be recorded as a separate document against each of the
properties – Lot A and Lot B.
