Since the parcel is within the Elm Place PRD, design review and replacement are required. A. Introduction The applicant is proposini to remove one large ceda tree at 610 Elm Way. The tree is in the front yard near the house and has numerous overhanging branches and an extensiv above -ground root syster Smaller landscaping trees and shrubs are proposed as replacements. While trees on individual lots are regulated througl ECDC 18.45, changes to landscaping within planned residential developments are subject to design review accordin to ECDC 20.13. The subject application does not trigger SEPA review; therefore, the proposal may be approved by staff as a Type I Decision, subject to the requirements of ECDC 20.01.003. The subject site is addressed as 610 Elm Way within the Elm Place Planned Residential Development. The site is zoned Single -Family Residential, RS-6. (Attachments 1— 3) 2. The landscaping for the site was approved by the Architectural Design Board as part of the planned residential development process in 1983 (PRD-1-83 and P-9-83)., While Norway Maple, Sweet Gum and Oak trees were originally planned for the PRD, it appears that red maples and cedars were used throughout the development as both street trees and ornamental plantings. 3. The cedar tree in question is near the house, has numerous overhanging branches, and an extensive above -ground root system. (Attachment 4) 4. Removal of the cedar tree will eliminate the somewhat hazardous nature of the tree and allow for the installation of smaller plantings more appropriate to the size of the space available in the front yard of 610 Elm adjacent to Elm Way. (Attachment 5) C. Technical Review This project was reviewed by the Engineering Division who requested additional information regarding the location of the tree and the existing on -site utility lines (Attachment 6). In response, the applicant provided drawings showing the location of the cedar and the utility lines which run between the tree and the house (Attachment 7). The Engineering Division proposed a condition that the utility lines be 'potholed' or exposed prior to work on the tree roots to ensure that any work on the roots minimizes potential disturbance to the utility lines (Attachment 8). D. Decision Based on the findings, conclusions and attachments to this report, staff finds that the design review for file number PLN-2012-0032 is APPROVED with the following conditions: 1. Pothole utilities that will be disturbed prior to removing roots. Contact utility purveyors immediately if there is any utility line damage during the project. 2. Tree shall be felled onto private property. 3. Vehicles and equipment shall be located on private property. Should it be necessary to utilize the City right-of-way to perform any of this work, the contractor shall apply for and obtain a right-of-way construction permit in advance of starting work. 4. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 5. It is quite overgrown for the space and only 6 feet from the house. Because of its size and root structure, the ground currently slopes toward our house. The roots are very large and have disrupted the common path between our house the home next door. We fear that the root system is, or could be, detrimental to our home's foundation, and that the size of the tree could become a liability. Our landscape proposal was approved by the Elm Place Grounds Committee and also the Board of Directors, which fully supports removing this tree. Please see the attached letters from these committees. If removing the cedar is approved by the city, we would like to plant some smaller trees including Japanese stewartia, Japanese maple, Japanese snowbell, Cornelian cherry, dwarf crabapples and viburnum "mariesii."
