RE: COMMENTS ON 1ST DRAFT RECORDING DOCUMENTS
FOR LINDBERG SHORT PLAT, FILE NO. PLN20130031
The Planning and Engineering Divisions have reviewed the above draft recording documents,
and it was found that the following information, corrections, or clarifications will need to be
addressed before review can continue:
1. COVER LETTER
Provide a cover letter describing how each of the conditions of the preliminary short plat
approval have been met. The original preliminary decision from 2013 and the minor
change decision from 2018 are attached. Also address how each of the following
corrections are closed.
2. CONFORMANCE WITH COUNTY REQUIREMENTS
All pages of the final recording documents must comply with the Snohomish County
Auditor's recording requirements, which are available for your reference via the following
link: https:Hsnohomishcountywa.gov/278/Recording. It appears that the recording
documents may not meet all of the requirements, including the minimum required margins.
It is the applicant's responsibility to ensure compliance with the Auditor's recording
requirements in order to avoid issues at the time of recording by the City Clerk.
3. NAME OF SHORT PLAT AND PLN NUMBER
Name of short plat (Lindberg) and PLN file number (PLN20130031) shall be shown at the
top of the recording documents.
4. MAYOR SIGNATURE BLOCK
Remove the Mayor's signature block from Sheet 1.
5. LEGAL DESCRIPTIONS
Legal descriptions shall be provided for the original parcel and each new lot created by the
subdivision on the face of the recording documents.
6. Please add a "Stormwater Provisions" section. Use the following template to describe the
storm system locations and the benefitting party: "A stormwater management facility is to
be constructed on Lot _ for the benefit of Lots , and a facility was constructed on
Lot/Tract/Parcel for the benefit of Lot (and so on as needed) as approved
by the City of Edmonds. The approved plans are on file with the City of Edmonds under
file number PLN20130031. Consistent with this approval, Lot A has been allotted
sf of new impervious surface area for future site improvements and Lot B has been
allotted sf of new impervious surface area for the house, patio, walkway and
driveway, and Lot C has been allotted sf' (these impervious surface values should
come from the stormwater report)
7. Please provide provisions and maintenance responsibilities for parcel C.
8. The following is to be added in lieu of a separate recorded covenant for the stormwater
facilities. Please revise to add the location of each system (Lot/Parcel) at the beginning and
then just add the rest of the verbiage.
• contains a stormwater management facility referred to as
an "LID BMP," which was installed to mitigate the stormwater quantity
and quality impacts of some or all of the impervious or non-native
pervious surfaces on the property. "Low impact development" means
development conducted in a way that seeks to minimize or completely
prevent alterations to the natural hydrology of the site. Low impact
development includes site planning and design to reduce alterations of
natural soil and vegetation cover, minimize impervious surfaces, and
specific practices that help to replicate natural hydrology such as
permeable pavements, green roofs, soil amendments, bioretention systems,
and dispersion of runoff.
• The Owners shall maintain the size, placement, and design of the LID
BMP as depicted on the approved civil construction plans and design
details shall be maintained and may not be changed without written
approval either from the Engineering Division of the City of Edmonds or
through a future development permit from the City of Edmonds. Chemical
fertilizers and pesticides shall not be used where LID BMP is located. All
costs of maintenance and repair shall be the sole responsibility of the
Owners.
• The Owners shall inspect LID BMPs annually for physical defects. After
major storm events, the system shall also be checked to ensure that the
overflow system is working properly. The Owners also shall maintain all
LID BMPs so they function as designed on a year-round basis.
9. The engineering requirements, contained within the Planning Division Findings,
Conclusions, and Decision establish the requirement for a storm drainage system on Lot C.
Please add the following to indicate your intent to construct the storm drainage system on
Lot C in conjunction with the building permit phase.
"Construction of a storm water management system has been deferred to coincide
with future development approval of Lot C. The storm drainage system shall be
designed in accordance with City of Edmonds Storm Water Management Codes
and Regulations effective at the time of development. The storm drainage system
shall be reviewed for compliance at the time of building permit submittal for lot C
and constructed in conjunction with the approved building permit."
10. Sheet 2 — The preliminary short plat map showed fencing encroaching on the outer
boundaries of the project site (at least south edge of Lot B). RCW 58.17.255 requires
disclosure of the encroachment:
Survey discrepancy — Disclosure.
Whenever a survey of a proposed subdivision or short subdivision reveals a
discrepancy, the discrepancy shall be noted on the face of the final plat or short
plat. Any discrepancy shall be disclosed in a title report prepared by a title
insurer and issued after the filing of the final plat or short plat. As used in this
section, "discrepancy" means: (1) A boundary hiatus; (2) an overlapping
boundary; or (3) a physical appurtenance, which indicates encroachment, lines of
possession, or conflict of title.
If the fencing is still there, add a Disclosure under Notes which substantially reads:
"Evidence of land occupation such as fences, structures, paved or graveled surfaces,
landscaping, etc. may not coincide with the deeded boundary lines, as shown on this
drawing. There are areas on this survey appearing to have discrepancies between the
deeded boundary lines and certain evidence of occupation. The owner or potential
purchaser should consult with legal counsel wherever discrepancies exist to determine how
best to interpret their property rights and address potential boundary disputes.
This survey discloses factors of record and on the ground affecting the subject property
boundary, but it does not purport to legally resolve related property line disputes. Where
ambiguities are noted, the owner or potential purchaser should consult with legal counsel to
determine how best to interpret their property rights and address any potential property line
disputes."
Please make the above changes and submit your updated recording documents to the planner on
duty, Monday — Friday between 8:00 am and 4:30 pm (8:30 am to 12:00 pm only on
Wednesdays).
