RE: COMMENTS ON 2ND DRAFT RECORDING DOCUMENTS
FOR SOUNDVIEW LANE SHORT PLAT, FILE NO. PLN20130020
The Planning and Engineering Divisions have reviewed your revised draft recording documents
submitted on December 8, 2017, and it was found that the following information, corrections, or
clarifications will need to be addressed before review can continue:
1. New comment — As you are aware, the house plans that you have submitted for the building
permit application on Lot C (Application No. BLD20171033) require additional vehicular
access easement area to the west of Tract X. Please either extend Tract X to the west or create
a separate vehicular access easement on Lot B or C, including new easement and maintenance
provisions, in order to allow for turnaround from the driveway on Lot C in compliance with
Engineering Division requirements. In adjusting for this, please be sure to keep the net area of
Lots B & C above the minimum required 12,000 square feet. This may cause the need to very
slightly shift the line between Lots B and C. In addressing this comment, corrections may
need to be made to the following:
a. New lot legal descriptions of Lots B and C on Sheet 1.
b. Legal description of Tract X on Sheet 1.
c. Ingress, egress and utilities easement (Tract X) description and/or addition of a new
easement description on Sheet 2 if a separate access easement is provided.
d. Lot areas on Sheet 3. Include gross and net areas as applicable.
e. Map on Sheet 3.
f. Map and easement details on Sheet 4.
g. Map on Sheet 5.
2. New comment — Since the documents will not be able to be recorded until 2018, please correct
all references to the year within the signature lines and tax statement from 2017 to 2018.
3. December 21, 2017 — comment not addressed.
8/18/2017 comment - Please add a "Stormwater Provisions" section that states: "A
stormwater management facility is to be constructed within Tract X for the benefit of Lots B
and C and the access road improvements, as approved by the City of Edmonds. The approved
plans are on file with the City of Edmonds under file number PLN20130020. Consistent with
this approval, Lot B has been allotted 3500sf of new impervious surface area for future site
improvements, Lot C has been allotted 3500sf of new impervious surface area for future site
improvements, and 6590sf has been allotted for the right-of-way and shared access road
improvements."
4. New comment — For clarity, Sheet 2 Easement titles shall match easement titles stated on
Sheet 3. For example, Sheet 2 states "Storm Drainage Services Easement and Maintenance
Agreement", but Sheet 3 refers to the drainage easement as "Drainage Easement". Please
revise plan sheets to match.
5. December 21, 2017 — Easement and maintenance provisions have been added, however, the
language states that Lot A has ownership and maintenance responsibilities. Lot A does not
take access of Tract X and it does not look as though any utilities within the Tract serve Lot
A. Please revise accordingly.
8/18/2017 comment - Sheet 2 — Add Tract X Easement Maintenance Provisions.
6. December 21, 2017 — Language was provided, but Detail X is still stated throughout without a
specific detail being provided within the survey documents. Item number 1 states the
improvements are shown on Sheet 5, however, Sheet 5 does not show the privately owned
infrastructure. Please revise accordingly.
8/18/2017 comment - Add details within the recording documents for the privately owned and
maintained infrastructure located within the Soundview Lane right-of-way and provide the
following Private Storm System Declaration of Covenant:
Soundview Lane LLC short plat and subsequent property owners, herein `Owners',
hereby agree to the following: (1) the improvements described in Detail X are located
within City of Edmonds right-of-way (ROW), (2) the City of Edmonds has no
responsibility for the maintenance of the private improvements located within the City of
Edmonds ROW, and (3) maintenance of the private improvements described in Detail X
shall be the responsibility of the `Owners'. No enlargement, alteration, modification, or
removal of the improvements described in Detail X except routine maintenance is
permitted without prior approval from the City of Edmonds. The `Owners' of the real
property described in Detail X hereby holds the City of Edmonds harmless from all
improvements, costs, expenses, losses and damages, including the cost of defense
incurred as the result of the existence, operation or use of the improvement described in
Detail X. In the event the City of Edmonds determines that the improvements described
in Detail X have become a public health or safety hazard or if the `Owners' of the real
property described in Detail X fail to comply with any City of Edmonds order or any
portion of the Edmonds Code, the City of Edmonds shall remove, repair, or alter said
improvement(s) without notice to said `Owners'. Said `Owners' shall compensate the
City of Edmonds within thirty (30) days for the costs of such removal, repair or
alteration.
7. December 21, 2017 — A sewer easement has been identified, however, it does not line up with
the existing sanitary sewer line located on 7311 Sound View Drive. If an easement does not
exist, then a separate easement document would need to be recorded and referenced by this
short plat.
8/18/2017 comment - Sheets 3 & 4 — Show existing sanitary sewer easement across 7311
Sound View Drive and reference the recording number.
New comment — Sheet 5 — Add note that pavement areas shown within the right-of-way are
approximate only.
9. Note that the final recording documents must be signed by your surveyor and all signatures on
the final documents must be made in black ink. It is suggested, however, that you submit the
revised recording documents to staff for a third review prior to obtaining all required
signatures.
Please make the above changes and submit your updated recording documents to a Planner,
Monday, Tuesday, Thursday, and Friday between 8:00 am 4:30 pm or Wednesday 8:30 am to 12:00
pm.
