FOR SOUNDVIEW LANE SHORT PLAT, FILE NO. PLN20130020
The Planning and Engineering Divisions have reviewed your revised draft recording documents
submitted on February 12, 2018, and it was found that the following information, corrections, or
clarifications will need to be addressed before review can continue (applicable comments from
staff s December 21, 2017 letter are included for reference with new comments provided in italics):
1. February 27, 2018 This item appears to have been adequately addressed; however, please
note that staff has not yet fully reviewed your resubmittal on the associated building permit
application (BLD20171033). It is up to the applicant to ensure that the appropriate
easements are reserved to accommodate for the future development plans of each lot.
2. February 27, 2018 — Dates appear to have been updated, however, taxes for 2018 will need to
be paid and therefore the Treasurers Certificate should be updated to reflect this.
12/21/2017 comment — Since the documents will not be able to be recorded until 2018, please
correct all references to the year within the signature lines and tax statement from 2017 to
2018.

6. February 27, 2018 — It seems as though we have some miscommunication on what is needed
to respond to this comment. Please call me if that would be helpful. The Declaration of
Covenant provided on Sheet 2 needs to specifically refer to the privately owned and
maintained storm filter installed within the City right-of-way. This could be shown as "Detail
"X"" within the plan set. Currently Sheet 5 has been labeled as Detail X, which includes
much more than the privately owned and maintained storm filter. Please revise plans to
clearly indicate the infrastructure this Declaration of Covenant applies to.
Also, if Sheet 2 is revised, please correct the typo found under number I of the Declaration of
Covenant. "Locate" should be revised to read "Located".
12/21/2017 comment - Language was provided, but Detail X is still stated throughout without
a specific detail being provided within the survey documents. Item number 1 states the
improvements are shown on Sheet 5, however, Sheet 5 does not show the privately owned
infrastructure. Please revise accordingly.
8/18/2017 comment - Add details within the recording documents for the privately owned and
maintained infrastructure located within the Soundview Lane right-of-way and provide the
following Private Storm System Declaration of Covenant:
Soundview Lane LLC short plat and subsequent property owners, herein `Owners',
hereby agree to the following: (1) the improvements described in Detail X are located
within City of Edmonds right-of-way (ROW), (2) the City of Edmonds has no
responsibility for the maintenance of the private improvements located within the City of
Edmonds ROW, and (3) maintenance of the private improvements described in Detail X
shall be the responsibility of the `Owners'. No enlargement, alteration, modification, or
removal of the improvements described in Detail X except routine maintenance is
permitted without prior approval from the City of Edmonds. The `Owners' of the real
property described in Detail X hereby holds the City of Edmonds harmless from all
improvements, costs, expenses, losses and damages, including the cost of defense
incurred as the result of the existence, operation or use of the improvement described in
Detail X. In the event the City of Edmonds determines that the improvements described
in Detail X have become a public health or safety hazard or if the `Owners' of the real
property described in Detail X fail to comply with any City of Edmonds order or any
portion of the Edmonds Code, the City of Edmonds shall remove, repair, or alter said
improvement(s) without notice to said `Owners'. Said `Owners' shall compensate the
City of Edmonds within thirty (30) days for the costs of such removal, repair or
alteration.

10. New Comment (February 27, 2018) Within the Development Services Director's signature
block on Sheet 1, insert the word "is" as follows: "...preliminary approval and is authorized
for recording... "
11. New Comment (February 27, 2018) — Please address the following discrepancies in the legal
descriptions and map:
a. There appears to be an error in the legal descriptions and/or length of the westernmost
line of Lot C as indicated on the map. This line is labeled as being 77.5' long; however, it
scales out as being shorter and is referenced in the legal descriptions for Lot B and Lot C
as being 71.8'. Please correct this discrepancy.
b. There appears to be an error in the bearing of the westernmost 15' line segment of Tract
X. The bearing is stated as 06°04'29" within the legal description of Tract (as shown
on both Sheets I and 2), but 06°04'28" on the map.
c. Please have your surveyor double check all legal descriptions, easement descriptions, and
the maps to ensure consistency between all descriptions and the maps.
Please make the above changes and submit your updated recording documents to a Planner,
Monday, Tuesday, Thursday, and Friday between 8:00 am 4:30 pm or Wednesday 8:30 am to 12:00
