McDonalds Edmonds Way Lot Combination File Number: PLN20130021 Date of Report: rremen 13, 2013 Reviewed By: Li Lien Senior Planner L INTRODUCTION The subject application was submitted by Tim Hanson and Associates, Inc. on behalf of Archland Property I for a lot line adjustment to combine four existing parcels into one parcel at 10124 Edmonds Way. The purpose of the proposed lot line adjustment is to remove all interior property lines between the four existing parcels as part of the redevelopment of the site. McDonald's currently operates in an older restaurant at the site. The existing structure will be demolished and a new McDonald's restaurant building will be constructed pursuant to conditional use permits (CUP) granted for the facility on May 10, 2013 (PLN20130003 — drive through and PLN20130006 — extended operating hours). The location of the new restaurant would straddle two parcel lines (Parcel 2 and Parcel 3), so the four parcels are being combined into a single parcel. The subject land use application is included as Attachment 1, and the proposed lot combination is shown on the lot line adjustment map (Attachment 2). The existing interior lot lines between Parcels 1, 2, 3 and 4 will be removed to create one parcel as shown on the map. It. FINDINGS AND CONCLUSIONS A. GENERAL INFORMATION 1. Request: The applicant is proposing to eliminate the interior boundary lines among four parcels addressed as 10124 Edmonds Way in order combine the four parcels into a single parcel. Three of the four parcels (Parcels 1— 3) are located in the Neighborhood Business, BN, zone and Parcel 4 is located in the RS-8 zone (Single- family residential). See the Zoning and Vicinity Map for reference (Attachment 3). 2. Review Process: A lot line adjustment (lot combination) is a Type I permit pursuant to ECDC 20.01.003. The director reviews the project and issues an administrative decision pursuant to ECDC 20.75.055.C. 3. Owner: Archland Property I (Parcels 1 — 2) McDonald's Corporation (Parcels 3 — 4) 4. Applicant: Tim Hanson, Tim Hanson and Associates, Inc. 5. Tax Parcel Numbers: 00610700200200 (Parcel 1), 00610700200301 (Parcel 2), 00610700200504 (Parcel 3), and 00610700200501 (Parcel 4) 6. Location: 10124 Edmonds Way, Edmonds WA 98020 7. Zoning: Neighborhood Business (BN, Parcels 1 — 3) and Single-family (RS-8, Parcel 4) 8. Acreage / Sguare Footage: The proposal will combine the area of Parcels 1, 2, 3 and 4 into one parcel. The area of the resulting parcel will be 83,011 square feet. 9. Existing Use: Parcels 1 - 3 are currently developed as one commercial site with a McDonald's restaurant. Parcel 4 is vacant. 10. Proposed Use: The use of the site will not change with the subject proposal; however, McDonald's Corporation plans to remove the existing McDonald's restaurant building and construct a new building further east on the site as indicated on the site plans associated with the redevelopment and approved under file numbers PLN20130002 (Design Review), PLN20130003 (Conditional Use for drive -through) and PLN20130006 (Conditional Use for extended operating hours). B. TECHNICAL COMMITTEE This application was reviewed by the City's Engineering Division and the Public Works Department. The Public Works Department did not have any comments on the proposal (Attachment 4). Engineer approved the proposal with the conditional that the 10-foot sanitary sewer easement (AFN 1858336) that encumbers Parcels 3 and 4 is proposed or approved to be changed with this lot combination. (Attachments 5). C. NEIGHBORHOOD CHARACTERISTICS This property is located in the Neighborhood Business (BN) zone. The neighborhood around the site consists of commercial development along Edmonds Way in what is known as the Westgate neighborhood. Surrounding uses include shopping centers (Bartell's, Starbucks, Subway, etc.) and grocery stores (PCC and QFC) along with numerous neighborhood commercial businesses. A single family residential (RS-8) neighborhood surrounds the BN zone and is directly west and south of this site. Access for the proposed development will remain off of Edmonds Way (SR-104) while one of the three entrances will be eliminated. Edmonds Way (State Route 104) is considered a "Principal Arterial." D. COMPREHENSIVE PLAN COMPLIANCE The Comprehensive Plan designation for Parcel 1 is "Westgate Corridor." The Comprehensive Plan describes Westgate Corridor areas as: Goals for the Westgate Corridor. The Westgate Corridor is generally located between the I00th Avenue W (9th Avenue S)/Edrnonds Way intersection and where Edmonds Way turns north to enter the downtown at -ea. By virtue of this location, this corridor serves as both a key transportation corridor and as an entry into the downtown. Long-established neighborhoods lie near both sides of the corridor. The plan for this corridor is to recognize its multiple functions by providing opportunities for small-scale businesses while promoting compatible development that will not intrude into established neighborhoods. The Comprehensive Plan designation for Parcels 2 and 3 is "Community Commercial." The Comprehensive Plan describes the Community Commercial areas as: Goals for Community Commercial Areas. Community commercial areas are comprised of commercial development serving a dual purpose: services and shopping for both local residents and regional traffic. The intent of the community commercial designation is to recognize both of these purposes by permitting a range of businesses and mixed use development while maintaining a neighborhood scale and design character. (2012 Comprehensive Plan, page 74) Parcel 4 is designated as "Single Family Urban." The Single Family Urban portion of the property is undeveloped and this portion of the property will remain undeveloped according to the plans approved under PLN20130002, PLN20130003, and PLN20130006. E.. LOT COMBINATION COMPLIANCE (ECDC 20.75.055) Pursuant to ECDC 20.75.055.C, lot combinations hall be approved as a matter of right unless the Development Services Director finds that the combination of lots would: 1. Not result in legal conforming lot; and/or The parcel resulting from the lot combination will be a legal conforming lot. All development on the lot will be on the BN zoned portion and the RS-8 zoned portion of the lot will remain undeveloped. Not be in compliance with the goals and objectives of the city's comprehensive plan. The director shall, as part of his decision, determine whether or not the lots, as combined, negatively impact compliance with the city's urban density requirements as established pursuant to the State Growth Management Act, comprehensive plan and the Snohomish County planning policies. The parcel resulting from the lot combination and redevelopment of the site will remain consistent with the City of Edmonds Comprehensive Plan, the Snohomish County Planning Policies and the State Growth Management Act. Based on the Findings, Conclusions, and Attachments to this report, the following decision is issued by the City of Edmonds Planning Division. The lot combination, as proposed, is APPROVED with the following conditions: 1. As shown on the survey prepared by Timothy Hansen included as Attachment 2, Parcel 3 and Parcel 4 are encumbered by a 10-foot sanitary sewer easement (AFN 1858336). No changes to the easement are proposed or approved with this lot combination. 2. Prior to submitting documents to the Planning Division for "Final Review," please make the following changes: a. On all sheets, revise to state the file number as PLN20130021. b. Include all required information, including owner's certification and staff s approval block. 3. As part of the submittal to the Planning Division for "Final Review," provide evidence that the individual(s) who will be signing the recording documents are authorized to sign on behalf of the property owner. 4. Submit a revised title report as part of the submittal for "Final Review." 5. After the above changes have been made, submit revised documents to the Planning Division for "Final Review." Once "Final Approval" has been issued from the City, the applicant shall take the documents to the Snohomish County Auditor's Office for recording. Please make sure that all documents to be recorded meet the Snohomish County Auditor's requirements for recording, including all signatures in black ink. 6. After recording the lot combination, the applicant must provide the City of Edmonds Planning Division with two (2) copies of the recorded map (with the recording number shown). The City ivill not consider the lot combination to have been completed until this is done. Pursuant to ECDC 20.75.055.D, decisions on lot combinations may be appealed within 10 working days of mailing the decision and posting thereof in accordance with the provisions of Chapter 20.06 ECDC. The property owner may, as a result of the decision rendered by the staff, request a change in the valuation of the property by the Snohomish County Assessor's Office.
