A. INTRODUCTION
The subject application is to legalize an Accessory Dwelling Unit (ADU) within a portion of the
existing single-family residence addressed 7808 202na Place SW (Attachments 1 — 3). The site is
located within the Single -Family Residential, RS-8, zone (Attachment 4). It is due to a recent code
violation that the existence of this unit was realized and compliance was required. Regardless of the
fact that the ADU is already in existence, the unit must be found to comply with the applicable ADU
review criteria, and permit approval must be obtained in order to correct the violation.
Approval of an ADU requires compliance with Edmonds Community Development Code (ECDC)
Chapters 16.20 and 20.21. Pursuant to ECC 20.01, an ADU is a Type II decision requiring public
notice.
B. COMPLIANCE WITH ECDC CHAPTER 16.20
The subject site is located within the Single -Family Residential, RS-8, zone (Attachment 4). The
purposes of the RS — Single -Family Residential zones are to reserve and regulate areas primarily for
family living in single-family dwellings and to provide for additional non-residential uses which
complement and are compatible with single-family dwelling use. Pursuant to ECDC 16.20.010.1),
an Accessory Dwelling Unit (ADU) is an allowed secondary use with a conditional use permit. The
proposal is required to comply with the purposes of the single-family residential zone and the criteria
outlined in Chapter 20.21. Based on staff's review of the specific ADU criteria (as described in
Section C of this report), staff feels that the proposal is in compliance with the purposes of the
single-family zone.
C. COMPLIANCE WITH ECDC CHAPTER 20.21
Section 20.21.030 of the Edmonds Community Development Code provides the criteria by which
Accessory Dwelling Units (ADUs) are to be reviewed. In order for the permit to be approved, all of
the criteria must be met. The criteria for approval are as follows: (1) Land Use Permit; (2) Number
of Units; (3) Size; (4) Location and Appearance; (5) Parking; (6) Occupancy; and (7) Safety, Light,
Ventilation, Floor Area, and Similar Factors. The ADU criteria were crafted to ensure that ADUs
would comply with Chapter 16.20 of the Edmonds Community Development Code. Detailed
explanations of staff s review of each criteria follows.

1. Land Use Permit Required
Pursuant to ECDC 20.21.030.A, a land use permit is required for approval of an attached ADU.
An application for a land use permit for the subject ADU was submitted to the City on March 27,
2013 by Cheryl Dillon (Attachment 1). The application became procedurally complete on April
24, 2013 pursuant to ECDC 20.02.002. Staff sent a request for additional information on July 17,
2013 (Attachment 5), and Ms. Dillon submitted revised plans on September 9, 2013, which were
further revised at staff's request and replaced with a new site plan and floor plans on September
23, 2013 (Attachment 2).
2. Number of Units
The proposal will result in only one ADU. This is in compliance with the number of units
allowed per ECDC 20.21.030.B.
3. Size
According to ECDC 20.21.030.C, "In no case shall an accessory dwelling unit be (1) larger than
40 percent of the livable floor area of the principal dwelling, (2) nor more than 800 square feet,
(3) nor have more than two bedrooms; provided, if the accessory dwelling unit is completely
located on a single floor, the planning manager may allow increased size up to 50 percent of the
floor area of the principal dwelling in order to efficiently use all floor area, so long as all other
standards set forth in this chapter are met."
The first floor plan is shown on the site plan and the second floor plan was provided as a separate
sheet, both of which are included as Attachment 2. According to the site/floor plans for the
residence and ADU (Attachment 2), the ADU is proposed to be 33 feet by 19 feet for a total area
of 627 square feet. The area of the main residence is stated as 1,532 square feet. This was
verified using the dimensions indicated on the plans as being the area of the livable portion of the
house including the bedroom within the upper floor, but excluding the solarium and the ADU.
With the area of the ADU, the total livable area within the entire residence is 2,159 square feet.
The proposed ADU (627 square feet) would comprise 29% of the total livable floor area (2,159
square feet) of the primary dwelling. The following table describes both the maximum size that
Accessory Dwelling Units are allowed to be as well as the proposed size for this application:

Since the applicant is requesting approval of an ADU that is less than 40% of the livable area of
the residence, less than two bedrooms, and no more than the maximum allowable size of 800
square feet, staff has determined that the application meets the size criteria.
4. Location and Appearance
According to Chapter 20.21.030.D of the Edmonds Community Development Code:
The single-family appearance and character of the residence shall be maintained when
viewed from the surrounding neighborhood. The design of the accessory dwelling unit shall
be incorporated into the design of the principal dwelling unit and shall be designed to
maintain the architectural design, style, appearance, and character of the main building as a
single-family residence using matching materials, colors, window style, and roof design. The
primary entrance to the accessory dwelling unit shall be located in such a manner as to be

unobtrusive when viewed from the street. Whenever possible, new entrances should be placed
at the side or rear of the building. Only one electric and one water meter shall be allowed for
the entire building, serving both the primary residence and the accessory dwelling unit.
Accessory dwelling units must be located within or attached to single-family dwelling units.
The proposed ADU will be located within a portion of the existing residence. The entire building
was constructed together out of similar materials and was designed in a manner so that the portion
of the building that is now being converted into the ADU was originally incorporated into the
design of the principal dwelling. The front of the residence faces 202nd Pl. SW, and the ADU
will be accessed via an existing door located underneath the existing carport. There is also a
secondary entrance to the ADU located on the western side of the residence, which will not be
significantly visible from the street. These entry doors are in locations that are typical of a single-
family residence and do not draw additional attention to the residence as containing an ADU. No
exterior changes to the building are proposed as part of the ADU proposal.
Staff finds that the proposed ADU maintains the architectural design, style, appearance, and
character of the main building and would not compromise the sign -family appearance of the
residence; therefore, the subject application complies with the location and appearance criteria.
5. Parldn�
ECDC 20.21.030.E states that one off-street parking space in addition to the two off-street
parking spaces normally required for the principal dwelling shall be required to be provided for
the Accessory Dwelling Unit. Therefore, a total of three on -site parking spaces are required; two
of which may be tandem spaces. As depicted on the site plan (Attachment 2), the residence has
an attached two car carport (24' by 19') that is accessed from a driveway directly off of 202°d Pl.
SW. Additionally, a driveway runs along the western side of the property to a carport and shop at
the rear of the site. There is sufficient space for three off street parking spaces; therefore, the
application complies with ECDC 20.21.030.E.
6. Occupancy
ECDC 20.21.030.17 states that as a condition of approval, the homeowner will be required to sign
before a notary, an affidavit regarding their occupancy of one of the units for a minimum of six
months of each calendar year. The applicant has submitted a notarized affidavit to the City that
meets this requirement (Attachment 6). The applicant must also file the required covenant with
the County Auditor following approval of the ADU, which has been added as a condition of
approval. This covenant will be provided to the applicant for a signature and recording during the
required building/compliance permit application review.
7. Safety, Light, Ventilation, Floor Area, and Similar Factors
ECDC Chapter 20.21.030.G states that as a condition of approval, the applicant is required to
apply for a Compliance Permit and inspection by a City Building Inspector to ensure that the
Accessory Dwelling Unit meets the requirements of all life -safety codes and standards. Any
conditions or corrections resulting from the inspection must be complied with per code
requirements. Any approval of an ADU shall be conditioned to require compliance with the
Building Division's inspection requirements. This has been made a condition of approval for the
ADU permit.
D. TECHNICAL REVIEW
The subject proposal has been reviewed by the Building Division, Engineering Division, Public
Works Department, Parks Department and Snohomish County Fire District No. 1. All comments are
included in Attachment 7. The Building Division commented that the ADU must meet the minimum

housing standards as shown by, but not limited to, the list found in City handout #P 1, alterations
made to the structure shall be by building permit, and a compliance permit is required even if no
alterations are performed. These comments have been included as a condition of approval. The
Engineering Division, Public Works Department, and Parks Department had no comments.
Snohomish County Fire District No. 1 requested a condition that interconnected smoke alarms with
battery backup and carbon monoxide alarms are installed, which has been added as a condition of
approval.
As always, any affected divisions/departments may have comments related to the proposal as part of
their respective reviews of any associated building permit application(s).
E. PUBLIC COMMENTS
A "Notice of Application" dated May 8, 2013 with a comment period ending on May 22, 2013 was
mailed to property owners within 300 feet of the subject site based on the adjacent property owners'
list submitted by the applicant and was posted on the site, at the Public Safety Complex,
Development Services Department, and Library on May 8, 2013. The notice of application was also
published in the Herald Newspaper on May 8, 2013. All public notice materials, including the
notice, adjacent property owner' list, declarations of mailing and posting, and an affidavit of
publication are included as Attachment 8.
No public comment letters were received on the subject proposal..
F. DECISION
Based on statements of fact, conclusions, and attachments in this report, the application for a
Conditional Use Permit for an Accessory Dwelling Unit at 7808 — 202,,d Pl. SW is GRANTED,
subject to the following conditions:
1. A building permit and/or compliance permit must be obtained from the Building Division
and final inspection must be made and occupancy approval granted by the City Building
Inspector prior to the area being used as an ADU. Specific comments from the Building
Division will be addressed during review of the applicable building/compliance permit
application.
2. The ADU must meet the minimum housing standards as shown by, but not limited to, the
list found in City Handout #Pl. Compliance with applicable standards will be verified by
the Building Division during their review of the associated building permit application(s).
3. Interconnected smoke alarms with battery backup and carbon monoxide alarms must be
installed as required by Snohomish County Fire District No. 1.
4. This permit shall expire automatically if any of the following issues arise:
a. The Accessory Dwelling Unit is substantially altered and is thus no longer in
conformance with the plans and drawings reviewed and approved by the permitting
authority and Building Official.
b. The subject site ceases to maintain the required number of parking spaces.
c. The property owner ceases to reside in either the primary residence or the Accessory
Dwelling Unit, the owner -occupied unit is rented, or the current (or future) owner fails
to file the affidavit required under ECDC 20.21.025.A.1.
5. The Accessory Dwelling Unit Covenant must be filed with the Snohomish County Auditor.
This covenant may be obtained from the Planning Division during the associated
building/compliance permit application review. Prior to occupancy of the Accessory

Dwelling Unit, the applicant must either (fees stated below are based on current fees and
are subject to change):
a. Provide the City processing fee of $20 plus the County recording fee of $72 for one
page, for a total of $92, and the City will record the covenant for you; OR
b. Take the covenant to the County and record it for the County's recording fee of $72
for one page plus $1 for each additional page, and return a copy of the recorded
covenant to the Edmonds Planning Division with the Auditor's recording sticker on
the copy.
6. The Accessory Dwelling Unit permit shall not be transferable to any site other than the
subject site described in the application. The Accessory Dwelling Unit permit is
transferable to new owners of the subject property unless there is a violation of any
conditions of approval listed above. New owners must file a notarized Accessory Dwelling
Unit Affidavit with the City of Edmonds Planning Division.

became procedurally complete pursuant to Edmonds Community Development Code (ECDC) Section
20.02.002 on April 24, 2013. However, during staff s continued review of your application, it was
determined that additional information/clarification is necessary. Please provide responses to the
following items at your earliest convenience so that staff s review of the proposal can continue:
1. Thank you for providing a plot plan with your submittal; however, the plot plan provided is not
drawn to scale and does not indicate all minimum required items. Please refer to the enclosed
sample plot plan and checklist (Handout #B57) for additional guidance on how to draw a plot
plan. Please provide a revised plot plan that includes the following:
a. The plot plan must be drown to scale, preferably a scale of 1"=20'.
b. Refer to enclosed Handout #B57 for guidance on how to draw a plot plan. For your revised
plot plan, please indicate all property lines and show all existing and proposed improvements
drawn.to scale. The plot plan must include a scaled depiction of the existing residence; front
porch, carport, shop, driveway, screened garbage area, etc. All improvements must.be drawn
to scale including dimensions so that staff can verify compliance with applicable
requirements.
c. It must be shown that a minimum of three parking stalls are provided on site. This cannot
include any parking within the city's right-of-way. Indicate the dimensions of all paved
parking areas located on the property.
d. Indicate any proposed changes to the footprints of the existing structures, driveway, etc.
e. Indicate the location of the proposed ADU and its main entrance.
2. Thank you for providing a floor plan with your submittal; however, the floor plan must be drawn
to scale and does not indicate all minimum required items. Please provide a revised floor plan
that includes the following:
a. The floor plan must be drawn to scale, preferably a scale of/4"=1'.
b. Indicate all interior walls in order to show all rooms and spaces within the home.
c. Indicate all windows and doors within the proposed ADU.
d. Indicate all smoke detectors.

e. It appears that there is a bedroom within the upper floor of the residence. As such, please
include floor plans for both the lower floor and the upper floor and include an indication of
whether the upstairs bedroom (and any other rooms, within the upper floor) will be utilized by
the occupant of the main residence or the ADU.
f. On the upper and lower floor plans, provide a clear indication of which portion of the
residence will comprise the ADU.
g. The upper and lower floor plans must be drawn to scale and must include a clear indication of
the livable area of both the primary dwelling and of the ADU. It must be clearly shown that
the ADU does not exceed 800 square feet, does not contain more than two bedrooms, and
does not exceed 40% of the livable area of the principal dwelling.
3. Are any changes proposed to the exterior of the existing building? If any exterior building
modifications are proposed, please indicate them on your building elevation drawings and on
your plot plan.
4. Refer to enclosed Handouts #P 1 and #1357 for additional guidance on the required plot plan and
floor plans.
Please submit the above information to the Planning Division as soon as possible so that staff may
continue processing your application: Please keep in mind that a complete response to this information
request must be received within 90 days or the application will lapse for lack of information (ECDC
20.02.003.13). Thus, your application will expire if the requested information is not received within 90
days. However, due to the fact that the subject application was submitted in response to a violation, a
complete response is due by August 14, 2013.
