Replacement planting is required according to Chapter 20.13 of the Edmonds Community Development Code (ECDC). A. Introduction The applicant is proposing to remove five trees at the Madrona Court site. \ Replacement landscaping is required according to ECDC 20.13. While trees on individual lots are regulated through ECDC 18.45, changes to landscaping on multifamily- and commercially -zoned sites are subject to design review according to ECDC 20.13. The subject application does not trigger SEPA review; therefore, the proposal may be approved by staff as a Type I Decision, subject to the requirements of ECDC 20.01.003. !:. Page 1 of 3 File No. PLN20130049 Madrona Court Landscape Plan Modification B. Findings and Conclusions 1. Madrona Court is located at 23713 & 23715 84th Ave. W. The site is zoned Residential Multifamily, RM-1.5 (Attachment 1). 2. The applicant is proposing to remove five Leyland Cypress trees and has indicated a desire not to replant (Attachment 2). The subject trees are shown in photos in Attachment 3. 3. The buildings currently on the site were approved in 1999 (BLD19990108 and BLD19990109); landscaping was also approved at that time (Attachment 4). The subject trees were not on the originally approved landscaping plan but in any event have now become too big for their location. 4. While the five cypress should be removed, replanting is required according to ECDC 20.13. The location calls for Type III landscaping as noted in ECDC 20.13.030.C(1) and (2). Attachment 5 describes the proposed replanting and Attachment 6 shows the landscaping that currently exists at the site as well as the location of proposed removal and replanting. C. Technical Review This project was reviewed by the Engineering Division who indicated that a right-of-way permit will be required if tree removal equipment will be staged on 84t" Avenue West. b 1. Based on the findings, conclusions and attachments to this report, staff finds that the design review for file number PLN20130049 is APPROVED with the following conditions: 1. Fell trees onto private property. 2. Vehicles and equipment shall be located on private property. Should it be necessary to use the City right-of-way to perform any of the approved work, the contractor shall apply for and obtain a right-of-way construction permit in advance of starting work. 3. Contractor/owner is responsible for keeping all debris on site and preventing any silt - laden runoff from leaving the site and/or entering the city storm system. 4. The applicant may remove the five subject trees and install the landscaping as shown on Attachment 6. The five replacement trees shall be installed in the same vicinity within the south setback area from where the subject trees are being removed. 5. Call (425) 771-0220, Attachment 1 PLN20130049 R—Led Un 8,22/12 B - Land Use: volicadon Page I Rod Ellestad 23715 84"' Avenue West Unit 101 Edmonds, WA 98026 425-231-9931 July 18, 2013 To whom it may concern: As a representative of the Madrona Court Homeowners Association at 23713/23715 84`h Avenue West, I am requesting permission to remove five Leyland Cypress trees from the south side of building 23715 We (the HOA) have been informed by several arborists that they are too big for the area, have been planted too closely together (which prevents the sun from getting to the lower branches) and planted too close to our building. They have already caused damage to the fence that surrounds the property and the HOA is worried about the damage they will cause to our property and the neighboring buildings. We have also been informed by (several) arborists that the trees roots will eventually cause damage to the foundation of the building. In addition to the problems with the fence and foundation, we anticipate that the roots will cause damage to our utility lines and sewer pipes as the roots could infiltrate the pipes (if the shallow roots are not ground out). Enclosed are photos of the unsightly trees and the damage they have done to the fence. As you can see, they are very unattractive and deter from our otherwise well manicured grounds. They have many dry branches, one tree is scalped on the east side, other trees are leaning toward buildings/utility boxes, and one is leaning into the sidewalk. The HOA is concerned with our liability if nothing is done. Because the neighboring property has a full buffer and we already have a variety of plants that enhance the appearance of the property, the HOA is hoping it will not be necessary to replant. Our neighbor's building is very close and the area between them is quite narrow. In addition we have a lot of vegetation (trees, bushes and ground cover) that is acting as a buffer between the sidewalks and the building. A check is enclosed with this letter for the permit.
