PROPOSAL: File No. PLN20130077. The applicant is proposing to remove an existing fir
tree located near the northeastern corner of the existing building addressed
23631 Edmonds Way. Replacement planting is required.
A. Introduction
The applicant is proposing to
remove an existing fir tree from
the eastern side of the site
addressed 23631 Edmonds Way.
The site contains an existing
commercial building. According
to Snohomish County Assessor
records, the subject site was
developed in 1961, which was
well before the property's
annexation into the City of
Edmonds in 1994 and before
current landscaping
requirements. The tree
proposed for removal is located
within one to two feet of the
northeastern corner of the
existing building and within
approximately six inches of the
building's eaves. The property
owner has stated that the tree is
causing maintenance concerns
for the building.

While trees on individual lots are regulated through ECDC 18.45, changes to landscaping on
multifamily -zoned and commercially -zoned sites are subject to design review according to ECDC
20.13. The subject application does not trigger SEPA review; therefore, the proposal may be
approved by staff as a Type I Decision, subject to the requirements of ECDC 20.01.003.
B. Critical Areas
A Critical Areas Checklist for the subject site was reviewed in 2000 under File No. CRA20000177.
The subject property does not appear to contain any critical areas as defined by ECDC 23.40
a result, a waiver from the requirement to complete
a study was issued. Therefore, no additional critical �` ?
areas study is required for the subject application.
C. Findings and Conclusions
1. The applicant submitted a land use
application, cover letter, and site plan on
December 13, 2013 (Attachments 1 through
3, respectively).
2. The application became procedurally
complete pursuant to ECDC 20.02.002 on
January 10, 2014.
3. The subject site is zoned Community
Business, BC (Attachment 4). The adjacent
property to the south is similarly zoned, and
the adjacent properties to the west and
north are zoned Community Business -
Edmonds Way, BC-EW. The adjacent
property to the east is zoned Multi -Family
Residential, RM-1.5.
4. The site was developed in 1961(according to
Snohomish County Assessor records) with a
commercial building. This was well before
current landscaping requirements and
before the property was annexed into the
City of Edmonds in 1994.
5. The applicant is proposing to remove an
existing evergreen tree located near the
northeastern corner of the existing building
(Attachments 1, 2, and 3). The inset
photographs to the right show the very close
proximity of the tree to the building.
6. According to the applicant's cover letter
(Attachment 2), the tree is causing concerns
over future maintenance of the building.

7. Upon inspection of the subject site, it was
found that the trunk of the tree proposed for
removal is located within approximately one
to two feet of the northeastern corner of the
existing building, and within only
approximately six inches of the building's
eaves. A portion of the crown of the tree
extends over the roof of the building. This
tree is very tall, and it appears that the tree is
growing too large for its current location
immediately adjacent to the corner of the
building.
8. The inset photograph to the right is a view
looking towards the east from Edmonds Way.
The tree proposed for removal is indicated
with an arrow.
9. Current landscaping requirements are
contained within ECDC Chapter 20.13. Although the current landscaping requirements
are different than the landscaping requirements that were in place at the time of
original development of the site, any proposed changes to existing landscaping are
subject to the current code requirements of ECDC 20.13. As such, pursuant to ECDC
20.13.030.A, Type I landscaping is required along the eastern side of the site since the
adjacent property to the east is zoned Multi -Family Residential, RM-1.5. Type
landscaping calls for two rows of evergreen trees, a minimum of 10 feet in height and
planted at intervals of no greater than 20 feet on center. Type I landscaping also calls
for shrubs, a minimum of three and one-half feet in height planted in an area at least
five feet in width, and other plant materials, planted so that the ground will be covered
within three years.
10. The applicant has proposed replacement of the tree proposed for removal with five
evergreen trees to be planted at the northeastern corner of the site, near the same area
as the tree to be removed (Attachment 3). The applicant's cover letter (Attachment 2)
states that the replacement trees will be evergreen and will be 10 feet in height and
planted in two rows no greater than 20 feet on center.
11. Although no shrubs are proposed to be planted, the five proposed replacement trees
are consistent with Type I landscaping requirements, and will bring the eastern side of
the site closer into compliance with the Type I landscaping requirements. This will help
to compensate for the loss of the existing evergreen.
D. Public Comments
Administrative design review is a Type I decision subject to the requirements of ECDC 20.11
(General Design Review) and 20.01 (Staff Decision — No Notice Required). Therefore, no public
notice was required for the subject application.

E. Technical Review
The subject proposal was reviewed by the Engineering Division, who stated that they have no
issues with the removal of the identified tree (Attachment 5).
F. Decision
Based on the findings, conclusions and attachments to this report, staff finds that the design
review for file number PLN20130077 is APPROVED with the following conditions:
1. The tree shall be fell onto private property.
2. Vehicles and equipment shall be located on private property. Should it be necessary to
utilize the City right-of-way to perform any of this work then the contractor shall apply
for and obtain a right-of-way construction permit in advance of starting work.
3. Contractor/owner is responsible for keeping all debris on site and preventing any silt
laden runoff from leaving the site and/or entering the city storm system.
4. Five replacement trees shall be installed near the location of the removed tree as
indicated in the cover letter (Attachment 2) and site plan (Attachment 3). The
replacement trees must be evergreen and shall comply with the minimum size at
installation specified in ECDC 20.13.015.B, which is six feet minimum height for
evergreen trees.
