A. INTRODUCTION
The applicant is proposing to convert the lower level of an existing single-family residence located
at 7717 — 205t' Place SW into an Accessory Dwelling Unit (Attachments 1 — 6). Approval of an
Accessory Dwelling Unit (ADU) requires compliance with Edmonds Community Development
Code (ECDC) Chapters 16.20 and 20.21. Pursuant to ECC 20.01, an ADU is a Type H decision
requiring public notice.
B. COMPLIANCE WITH ECDC CHAPTER 16.20
The subject site is located within the RS-8 Single -Family Residential zone (Attachment 7). The
purposes of the RS — Single -Family Residential zones are to reserve and regulate areas primarily for
family living in single-family dwellings and to provide for additional non-residential uses which
complement and are compatible with single-family dwelling use. Pursuant to ECDC 16.20.010.13,
an Accessory Dwelling Unit (ADU) is an allowed secondary use with a conditional use permit. The
proposal is required to comply with the purposes of the single-family residential zone and the criteria
outlined in Chapter 20.21. Based on staff's review of the specific ADU criteria (as described in
Section C of this report), staff feels that the proposal is in compliance with the purposes of the
single-family zone.
C. COMPLIANCE WITH ECDC CHAPTER 20.21
Section 20.21.030 of the Edmonds Community Development Code provides the criteria by which
Accessory Dwelling Units are to be reviewed. In order for the permit to be approved, all of the
criteria must be met. The criteria for approval and detailed analysis of each criterion follow:
1. ECDC 20.21.030.A — Permit Required
Permit Required. Any person who occupies or permits another person to occupy an attached
accessory dwelling unit as a place of residence shall first obtain a permit. The permit shall be
reviewed and processed as a Type H decision (Staff decision — Notice required).
An application for a land use permit was submitted to the City on December 31, 2013
(Attachment 1). The application was determined to be complete on January 23, 2014
(Attachment 8).
In accordance with ECDC 20.03, a "Notice of Application" dated February 5, 2014 with a
comment period ending on February 19, 2014 was mailed to property owners within 300 feet of
the subject site based on the adjacent property owners' list submitted by the applicant, posted on
the site and at the Public Safety Complex, Development Services Department, and Library on
February 5, 2014. The notice of application was also published in the Herald Newspaper on
February 5, 2014. Public notice documentation is provided in Attachment 13.
2. ECDC 20.21.030.B — Number of Units
A single-family dwelling may have no more than one accessory dwelling unit per lot.
The proposal will result in only one ADU and therefore is in compliance with the number of units
allowed per ECDC 20.21.030.13 (Attachment 4).
3. ECDC 20.21.030.0 - Size
Size. In no case shall an accessory dwelling unit be (1) larger than 40 percent of the livable floor
area of the principal dwelling, (2) nor more than 800 square feet, (3) nor have more than two
bedrooms,-, provided, if the accessory dwelling unit is completely located on a single floor, the
planning manager may allow increased size up to 50 percent of the floor area of the principal
dwelling in order to efficiently use all floor area, so long as all other standards set forth in this
chapter are rnet.
The existing primary residence has 2,473 square feet of livable floor area while the ADU is
proposed to consist of 1,187 square feet (Attachment 3). Consequently, the proposed ADU would
comprise 48% of the total livable floor area of the primary dwelling. The proposed ADU is
located completely on the lower floor of the existing residence. A mechanical/workshop area on
the lower floor will not be used by the occupants of the ADU (Attachment 6). Since the proposed
ADU is below 50% of the floor area of the principal dwelling and located on a single floor, the
applicant is allowed to increase the floor area of the ADU in order to efficiently the floor area.
The following table describes both the maximum size that Accessory Dwelling Units are allowed
to be as well as the proposed size for this application:

The proposed ADU consists of two bedrooms. Since the proposed ADU is below 50% of the
floor area of the principal dwelling and located on a single floor, the applicant is allowed to
increase the floor area of the ADU in order to efficiently the floor area. Staff has determined that
the application meets the size criteria.
4. ECDC 20.21.030.D — Location and Appearance
The single-family appearance and character of the residence shall be maintained when viewed
from the surrounding neighborhood. The design of the accessory dwelling unit shall be
incorporated into the design of the principal dwelling unit and shall be designed to maintain the
architectural design, style, appearance, and character of the main building as a single-family
residence using matching materials, colors, window style, and roof design. The primary entrance
to the accessory dwelling unit shall be located in such a manner as to be unobtrusive when

viewed from the street. Whenever possible, new entrances should be placed at the side or rear of
the building. Only one electric and one water meter shall be allowed for the entire building,
serving both the primary residence and the accessory dwelling unit. Accessory dwelling units
must be located within or attached to single-family dwelling units.
The principal dwelling faces east and fronts on 205 Place SW with primarily the first level of the
home visible from street view (Attachment 5). The ADU will be located in the lower level of the
home and accessed from the rear of the house. The appearance of the existing residence will not
change with the conversion of the lower level into and ADU.
Staff finds that the proposed ADU maintains the architectural design, style, appearance, and
character of the main building and would not compromise the sign -family appearance of the
residence; therefore, the subject application complies with the location and appearance criteria.
5. ECDC 20.21.030.E —Parkin
Parking. One off-street parking space in addition to the parking spaces normally required for the
principal dwelling shall be required to be provided for the accessory dwelling unit, but in no
event less than three spaces per lot.
The exiting residence has a single -car carport located on the west side of the residence with space
for a tandem parking space outside of the carport. In order to the create the third parking space
required for an ADU, the applicant is proposing create the additional parking space in the yard
just east of the existing driveway (Attachment 3). The applicant is proposing to use grass pavers
to create the additional parking space. A condition of approval is that the addition of the third
parking space must be applied for and constructed with the building compliance permit for the
ADU. Creating the additional parking space may also require a right-of-way construction permit
and encroachment permit.
With the addition of the third off-street parking space; the application will comply with ECDC
20.21.03 O.E.
6. ECDC 20.21.030.F — Occupancy
Occupancy. Either the primary dwelling or the accessory dwelling unit shall be owner -occupied.
"Owner -occupied" shall mean a property owner who makes his or her legal residence at the site,
as evidenced by voter registration, vehicle registration, or similar means, and actually resides at
the site more than six months out of any given year, and at no time receives rent for the owner -
occupied unit. The owner(s) shall not rent the designated owner -occupied unit at any time during
the pendency of the ADUpermit; any such rental shall void the permit. The owner(s) shall not
rent any portion of the owner -occupied residence either during the owner(s) ' occupancy or while
the owner is absent from the owner -occupied unit for any period. In no event shall the total
number of occupants exceed one family as defined in this code; provided, however, that if the
accessory dwelling unit is occupied by a nurse or other caregiver assisting a disabled person who
is an occupant of the principal residence, or the principal residence is occupied by a
nurse%aregiver and the accessory dwelling unit is occupied by a disabled person under the
nurse's care, the occupancy limit of one family may be increased by one additional unrelated
person to a total of one family related by genetics, adoption or marriage plus one unrelated
person, or a total of six unrelated persons. In no event shall the total number of occupants exceed
one family as defined in this code.
The applicant has submitted a notarized affidavit to the City that meets this requirement
(Attachment 9). The applicant must also file the Covenant required by ECDC 20.21.025.A.2 with
the County Auditor following issuance of the ADU building compliance permit.

7. ECDC 20.21.030.G — Safety, Light, Ventilation, Floor Area, and Similar Factors
Safety, Light, Ventilation, Floor Area and Similar Factors. Accessory dwelling units shall comply
with all applicable requirements of the Uniform Housing Code and the Uniform Building Code
adopted by ECDC Title 19 and shall comply in all respects with the provisions of the Edmonds
Community Development Code. No permit for an accessory dwelling unit shall be issued to a
nonconforming structure unless that structure is brought into conformance with the then current
provisions of this code.
A condition of approval for this ADU has been added that requires compliance with the Building
Division's inspection and compliance requirements.
D. PUBLIC COMMENTS
No public comment letters were received on the subject proposal.
F. TECHNICAL REIVEW
The subject application was reviewed by Snohomish County Fire District #1 as well as the Building
and Engineering Divisions.
The Fire District did not have any comments on the proposed ADU (Attachment 10).
The Building Division noted that an ADU compliance building permit must be obtained and all work
and inspections approved prior to occupancy as an ADU (Attachment 11).
Engineering Division approved the ADU with conditions which have been incorporated into the
conditions of approval (Attachment 12).
G. DECISION
Based on statements of fact, conclusions, and attachments in this report, the application for a
Conditional Use Permit for an Accessory Dwelling Unit at 7717 — 205t' Place West is GRANTED,
subject to the following conditions:
1. This permit shall expire automatically if any of the following issues arise:
a. The Accessory Dwelling Unit is substantially altered and is thus no longer in
conformance with the plans and drawings reviewed and approved by the permitting
authority and Building Official.
b. The subject site ceases to maintain the required number of parking spaces.
c. The property owner ceases to reside in either the primary residence or the Accessory
Dwelling Unit, the owner -occupied unit is rented, or the current (or future) owner fails
to file the affidavit required under ECDC 20.21.025.A.1.
2. A building permit and/or compliance permit must be obtained from the Building Division
and final inspection must be made and occupancy approval granted by the City Building
Inspector prior to the area being used as an ADU. Specific comments from the Building
Division will be addressed during review of the applicable building permit application.
3. Approval of the building permit may require an associated right-of-way construction permit
and/or an encroachment permit for work in the right-of-way related to creating the required
third parking space.
4. The applicant is encouraged, wherever feasible, to incorporate pervious pavements, rain
gardens, and/or other low impact development techniques into the project design.

5. Approval of the ADU shall not be interpreted to mean approval of the improvements as
shown on the preliminary plans.
6. The Accessory Dwelling Unit Covenant required under ECDC 20.21.025.A.2 must be filed
with the Snohomish County Auditor. This covenant may be obtained from the Planning
Division with issuance of the building compliance permit. Prior to occupancy of the
Accessory Dwelling Unit, the applicant must either:
Provide the City processing fee of $20 plus the County recording fee of $72 for one
page, for a total of $92, and the City will record the covenant for you; OR
b. Take the covenant to the County and record it for the County's recording fee of $72
for one page plus $1 for each additional page, and return a copy of the recorded
covenant to the Edmonds Planning Division with the Auditor's recording sticker on
the copy.
7. The Accessory Dwelling Unit permit shall not be transferable to any site other than the
subject site described in the application. The Accessory Dwelling Unit permit is
transferable to new owners of the subject property unless there is a violation of any
conditions of approval listed above. New owners must file a notarized Accessory Dwelling
Unit Affidavit with the City of Edmonds Planning Division.

J. APPEALS
A party of record may submit a written appeal of a Type II decision within 14 days of the date of
issuance of the decision. The appeal shall be made in writing and shall include all required
information stated in ECDC 20.07.004.D as well as the applicable fee. The appeal will be heard at
an open record public hearing before the Hearing Examiner according to the requirements of ECDC
Chapter 20.06 and Section 20.07.004.

Please accept my application for an Accessory Dwelling Unit in the subject property basement. Attached
are the following:

Please note the basement was remodeled by the former owners and set up for an ADU in accordance
with ECDC Chapter 20.21 but not permitted for an ADU. I included copies of the signed Construction
Progress Card and Electrical Contractor Work Permit for reference to the previous work constructed
under permit # BLD20130583. The purpose of my application is to follow through and complete the ADU
permit process. To my knowledge, the remaining work to complete the requirements, are as follows:
® Install a parking pad. I propose to use a low impact, permeable paver system (hollow concrete paver
with grass). Any encroachment on right-of-way is mitigated as the system is easily removed and
replaced in the event of future utility work or street improvements. Also note due to the layout of
the cul-de-sac, shape of the existing asphalt driveway and additional gravel space on the opposite
side of the asphalt, I am proposing a unique shape for the parking pad. There will be a total of 141.4
square feet. So in terms of square footage it is equivalent to the 8 % x 16 % rectangular pad (140.25
square feet). This shape is more aesthetically pleasing and does not disturb the curb and gutter.
The soil will be excavated between 9 to 12-inches below grade (depending upon paver thickness)
and compacted. A construction grade geotextile fabric (such as Mirafi 180N or equivalent) will be
placed on the compacted soil followed by 4 to 6-inches of compacted 3/4-minus crushed rock. One
inch of sand will be used to level the paver/grass system. The pavers will be backfilled with topsoil
and seeded.
® Install sheetrock on the bottom of the stairwell to complete the fire -smoke barrier between the
upper and lower floors.

Please note we are requesting that the planning manager allow increased size up to 50 percent of the
floor area of the principle dwelling unit. This is so all of the floor area is efficiently used. The ADU is
located in the basement and it would be impractical to eliminate space. The total floor space is
estimated to be 2,473 square feet with the basement estimated at 1,187. Deducting the mechanical
workshop (19'x7') puts the ADU at 1,054 square feet. We respectfully request this consideration as the
ADU is located on one floor, has only two bedrooms and we believe meets all other requirements after
proposed tasks are completed.

Hi Kemen,
Please find attached our revised ADU parking proposal drawing. The layout adds parking space #3 to the east of
the existing asphalt and stacks spaces #1 and #2 on the existing asphalt. I included dimenstions as requested by
Engineering. Please note the space is laid out with string if Engineering would like to come by and look at it.
Also please note the following:
® Impervious surfaces added after 1977 total 1,461 square feet (reference attached drawing)
® We intend to apply for an encroachment permit and propose grass pavers for Pad #3
® The basement workroom will not be used by the ADU renters
® The exterior look of the house will not change as a result of the ADU (record photo attached per earlier
request)
I spoke a couple of times with Engineering. It is my understanding it may be possible to coordinate the
project/permits so that we don't pay for the encroachment permit until the City has inspected the site and
basement for addtitional requirements. We understand a building permit is required and we would like to move
forward with the building permit and inspections once the plan is approved then pay for the encroachment
permit. The purpose is to avoid paying for the encroachment permit lest there be something unforeseen that is
cost prohibitive.
We would appreciate your input on the above matter. We would also like to request more specific information
as to the screened garbage area requirements (is it required to be screened on two, three or four sides, what type
of screen materials are required, how big, etc.). Also, can take the sign come down and be returned? If so
where?

On behalf of the City of Edmonds Planning Division, I have reviewed your application for an
accessory dwelling unit (ADU) for completeness pursuant to Edmonds Community Development
Code (ECDC) 20.02.002 and 20.21.025. The City has determined that the application meets the
procedural submission requirements and therefore is complete. Please accept this letter as the
City's notice to applicant of determination of completeness pursuant to ECDC 20.02.003. While
the application is procedurally complete, additional information and clarifications are needed for
continued review of the applications.
1. Please provide elevation views of the residence. One of the evaluation criteria for an
ADU is that the single-family appearance and character of the residence is maintained
when viewed from the surrounding neighborhood. Elevation views are needed to assess
this criterion.
2. Clearly identify the three parking spaces being provided for the ADU. While the site
plan shows a new parking pad, it is difficult to determine how the three parking spaces
would fit. Please mark out the three 8 1/2 x 16 1/2rectangular parking spaces on the site
plan. It is also noted the pavers may be installed in the right-of-way. While the
Engineering Division has not submitted review comments on the application yet, note
that Engineering may require that the driveway entrance be paved.
3. Please clarify who will have access to the mechanical\workshop area. If this will be used
by the ADU occupants, the area needs to be included in the ADU area. If the ADU
occupants are not going to be using this area, please note how they will be prevented
from entering the mechanical\workshop space.
Additional review comments may follow as I have not received comments from all other City
department/divisions with review responsibility.

The City will issue a Notice of Application pursuant to ECDC 20.03.002 within two weeks and
request comments from those on the Adjacent Property Owner (APO) list you provided with
your application. The Notice will also be published in the Everett Herald and posted at the
Edmonds Public Library and Public Safety Building. I will also come out and install a small
blue project notification sign at the site as well. Comments will be accepted for fourteen days
from the date the Notice is published.
According to ECDC 20.02.003.D, the above requested information must be submitted within 90
days (or by April 23, 2014) or the application will expire.
