The applicant is proposing to remove three beech trees at 115 3rd Avenue North. Two
of the trees are in close proximity to the building and are impacting site improvements.
The third beech is in a somewhat overgrown area and the applicant would like to
improve the overall look of that side of the house (Attachments 1— 3). Two firs near
the northern property line were initially considered for removal but were eliminated
from the proposal by the applicant.
1. The parcel is located at 115 3rd Avenue North and is zoned Downtown Business, BD-
2 (Downtown Mixed Commercial). The site is developed with a house built in 1901
which has been converted into offices. The surrounding properties are similarly
zoned but while some parcels have been redeveloped, some are still single family
residence conversions (Attachment 4).
2. Although the building on the site is used for office space, because the site has not
been redeveloped, there is no existing landscaping plan for the site on file with the

City of Edmonds. As a result, the applicant provided a landscaping plan showing
generally what is at the site (Attachment 3).
3. The parcel is vegetated with landscaping typical of single family residential parcels.
Two very large chestnut trees dominate the 3rd Street fagade. The north and south
property line areas have a mix of plantings (Attachment 5a and 5b) and lawn grass is
found throughout.
4. The northern beech tree is located in an area where the applicant wants to provide
additional residential -type landscaping including rhododendrons (Attachment 5a).
The beech trees on the south have grown to become very large trees and are close
enough to the building to impact site improvements and make maintenance difficult
(Attachment 5b).
No specific replanting is required. There is sufficient existing vegetation along the
north and south property lines to buffer the site from adjacent development. The
applicant has indicated a desire to improve the appearance of both sides of the
house and may plant landscaping consistent with the residential character of the
site as long as the existing buffers are maintained. If and when the site is
redeveloped, any landscaping will have to be provided in compliance with ECDC
20.13 — Landscaping Requirements.
D. Technical Review
The Engineering Division has reviewed the proposal and asked for four conditions to be
added to the decision (Attachment 6).
E. Decision
Based on the findings, conclusions, and attachments to this report, staff finds that the
design review for file number PLN20140019 is APPROVED with the following
conditions:
This approval is only for the removal of the three beech trees identified on the
landscaping plan (Attachment 3) and shown in the photographs in Attachment 5.
Removal of any other trees requires separate approval. Ivy should be removed from
all remaining trees.
2. Replanting is required but the selection and location of the replacements is up to
the applicant since the site is not being redeveloped as long as the general
appearance of the site remains the same.
3. Trees shall be fell onto private property.
4. Vehicles and equipment shall be located on private property. Should it be necessary
to use the City right-of-way to perform any of this work then the contractor shall
apply for and obtain a right-of-way construction permit in advance of starting work.
5. Contractor/owner is responsible for keeping all debris on site and preventing any
silt laden runoff from leaving the site and/or entering the city storm system.

6. Contractor/owner shall repair/replace any damaged sections of curb/gutter,
sidewalk or other public improvements in City right-of-way per City standards that is
caused by or occurs during the permitted project.

Staff design review is a Type I decision which pursuant to ECDC 20.01.003.B is subject to
judicial appeal. Type I decisions may be appealed by a party of record with standing to
file a land use petition in Snohomish County superior court. Such petition must be filed
within 21 days after issuance of the decision, as provided in Chapter 36.70C RCW.

I would like to remove three, and perhaps four trees on the above property, as described
below.
Trees marked #1 and #2 are located on the north border of the property, as shown in
photograph #1. These trees are not substantial, and we worry a little in a high wind as they
are very close to the house to the north (shown in picture #1). I would like to clean out this
area of the property, which has been long -neglected, and have a more attractive side yard
with shrubs, such as the rhododerons now in place.
The tree marked #3 is very close to the house on this property, and grows over the top of
the house, as shown in pictures #2 & 3.
The fourth tree that I would like to remove is shown in photograph #2, and can be seen on
the south side of the property and the south side of the house. It is lower and you can see
the branches or trunk leading further to the left (southerly). This may be a shrub, but tree
or shrub it leans heavily over the south property line and over the vehicles parked in the
Bank's parking lot. I planned to prune this back, but would prefer removal. It is very close
to the house on the subject property and makes maintenance of the south wall of the house
more difficult.
I have a full-time, 8:30-4:30 job in Seattle, and so it is difficult to readily available to come
to the Planning Department office during your business hours. I can be reached during the
day at 206-446-8611, though I may not be available to the phone during most working
hours. My home phone is 206-546-2705, but again, I am.at work most weekdays. I will
follow-up on any messages left on those phones.
