Proposal: Application for a conditional use permit for a home occupation
Claude and Jacqueline McCoy have applied for a home occupation conditional use
permit in order to see patients at their home at 607 Daley Street (Attachment 1). The
McCoy's are both semi -retired mental health counselors who would like to see between
four and eight patients on Mondays, Tuesdays and Wednesdays (Mr. McCoy on
Mondays, Mrs. McCoy on Tuesdays and Wednesdays). The proposed home occupation
would be a secondary use on the site with the primary use of the property remaining
residential.
Since the proposed home occupation will include visits to the site by customers, an
administrative (Type II) conditional use permit is required in order to establish the home
occupation.

6. Existing Use: The site contains an existing single-family residence.
7. Proposed Use: The applicants have proposed to have a home occupation as a
secondary use in conjunction with the existing single-family residential use in
accordance with Section 16.30.010.6.2 of the Edmonds Community Development
Code (ECDC). The proposed home occupation is for the McCoy's counseling services
and will take place completely inside the residence. No modifications to the home
are proposed.
8. Review Process: Pursuant to ECDC 20.20.010(B) a home occupation that does not
meet one or more of the requirements of subsection 20.20.010(A) may be approved
as a staff conditional use permit (Type II decision) as long as it is found to comply
with the criteria of ECDC 20.20.010(B). As such, staff will review the proposal and
will make the final decision on whether the proposal is consistent with the criteria
found in ECDC 20.20.010(B).

ECDC 20.03 includes the City's regulations for public notice of land use applications. On
August 28, 2014, a "Notice of Application" was posted at the subject site, Public Safety
Complex, Development Services Department, and Public Library (Attachment 7). The
notice was also published in the Herald Newspaper and mailed to residents within 300
feet of the site on August 28 using a mailing list provided by the applicant.
No comments from the public were received.
Review under the State Environmental Policy Act (SEPA) is not required with this
application because the proposal is for a home occupation within an existing single-
family residence and is exempt under WAC 197-11-800 (Categorical Exemptions).
1. Topography: The site is basically flat.
Soils: According to the Soil Survey of Snohomish County Area, Washington, this site
is underlain by "Everett gravelly sand loam, 0-8% slopes."

3. Critical Areas: CRA20060015 — a waiver from further critical area study was granted.
The subject site and surrounding properties are zoned Multiple Residential (RM-1.5) and
are developed with multifamily structures. The Edmonds Center for the Arts is just west
of the site and Civic Park is to the south (Attachment 2).
The Comprehensive Plan designation for this site is "Multi Family— High Density" within
the Downtown Activity Center overlay. The Comprehensive Plan has the following
stated goals and policies for Residential Development that are applicable to this project
(excerpt from Comprehensive Plan pages 72 and 73):
Residential Development
C. Goal. A broad range of housing types and densities should be encouraged in order that a
choice of housing will be available to all Edmonds residents, in accordance with the
following policies:
C.2 Multiple. The City's development policies encourage high quality site and
building design to promote coordinated development and to preserve the trees,
topography and other natural features of the site. Stereotyped, boxy multiple
unit residential (RM) buildings are to be avoided.
C.2.a. Location Policies.
C.2.a.i. RM uses should be located near arterial or collector streets.
C.2.b Compatibility Policies.
C.2.b.i. RM developments should preserve the privacy and view of
surrounding buildings, wherever feasible.
C.2.b.ii. The height of RM buildings that abut single family residential
(RS) zones shall be similar to the height permitted in the
abutting RS zone except where the existing vegetation and/or
change in topography can substantially screen one use from
another.
C.2.b.iii. The design of RM buildings located next to RS zones should be
similar to the design idiom of the single family residence.
C.2.c. General Design Policies.
C.2.c.i. The nonstructural elements of the building (such as decks, lights,
rails, doors, windows and window treatments, materials,
textures and colors) should be coordinated to carry out a unified
design concept.
C.2.c.ii. Site and building plans should be designed to reserve the natural
features (trees, streams, topography, etc.) of the site rather
than forcing the site to meet the needs of the imposed plan.

The goals and policies of the Comprehensive Plan were taken into account when
drafting the home occupation regulations in ECDC 20.20 and the applicable zoning
requirements in ECDC 16.30. As a result, the home occupation criteria such as the
limitations on the numbers of employees and the numbers of vehicles visiting the site
reflect the referenced Comprehensive Plan goals and policies. The subject proposal is
consistent with the goals and policies of the Comprehensive Plan.
1. ECDC 16.30 (Multiple Residential Zone)
ECDC 16.30.000 describes the specific purposes of the multiple residential zones.
These include: 1) to reserve and regulate areas for a variety of housing types, and a
range of greater densities than are available in the single-family residential zones,
while still maintaining a residential environment; and 2) to provide for those
additional uses which complement and area compatible with multiple residential
uses. According to ECDC 16.30.010.B, a home occupation, subject to the
requirements of Chapter 20.20 ECDC, is an allowed secondary use within the
Multiple Residential (RM) zones. As a result, this proposal must comply with the
purposes of the multiple residential zones and the criteria outlined in Chapter 20.20.
Based on staff's review of the specific home occupation criteria (as described in
Section V111.3 of this report), staff feels that the proposal is in compliance with the
purposes and requirements of the multiple residential zones contained within ECDC
16.30.
The existing structure at 607 Daley St. was remodeled into a duplex in 2005
(BLD20051067) but the McCoys occupy both units. There are four existing off-street
parking spaces which were required according to ECDC 17.50.020.A.1 since the
building is technically a duplex. Since the structure is now used as a single family
residence (which requires two parking stalls), there are two other existing off-street
parking stalls for clients which satisfies the home occupation parking requirement in
ECDC 20.20.010.B.7 (Attachments 3 — 5).
a. Chapter 20.20 of the Edmonds Community Development Code (ECDC) provides
the criteria against which home occupations are reviewed. The subject proposal
is for a home occupation that includes visits by customers and that does not
comply with the regulations of ECDC 20.20.010.A in order for a home occupation
to be conducted as a permitted secondary use. A home occupation which does
not meet one or more of the requirements of subsection (A) may be approved by
staff (Conditional Use Permit, Type II decision) if the use will not harm the
character of the surrounding neighborhood as evidenced by meeting all of the
criteria in ECDC 20.20.010.B. Each of the review criteria in subsection (B) are
analyzed below:

1. The temporary and permanent keeping of animals associated with a home
occupation must comply with all provisions of Chapter 5.05 ECC, Animal
Control, and ECDC Title 16.
No animals are proposed with this project.
2. The home occupation will not include storage, display of goods, building
materials and/or the operation of building machinery, commercial vehicles or
other tools, unless it meets all of the following criteria:
a. Is wholly enclosed within a structure or building, and
b. Does not emit noise, odor or heat; and
c. Does not create glare or emit light from the site in violation of the city's
performance criteria.
The McCoys will meet in clients inside the house (Attachment 3).
3. Does not create a condition which injures or endangers the comfort, or pose
health or safety threats to persons on abutting properties or streets.
Meeting with clients in the house for confidential health discussions will not
pose a health and safety threat to the neighborhood.
4. Does not include visits to the site from more than one nonresident employee
per day.
The McCoys are the proprietors and no nonresident employees will be
visiting the subject site.
5. Does not include visits from customers in excess of one vehicle per hour.
In Attachment 3, the applicants have affirmed that Mr. McCoy will see
between four and eight patients on Mondays and Mrs. McCoy will see
between four and eight patients on Tuesdays and Wednesdays.
Appointments are for one hour.
6. Does not include visits from customers between the hours of 9:00 pm and
8:00 am.
While it is assumed that the McCoys will see patients during the day or early
evening, a condition will be added to the decision to that effect.
7. If visits to the site are to be made by either an off -site employee or customer,
on -site parking shall be provided for at least three vehicles.
Refer to Section VIII.2 of this report for analysis of the proposal's compliance
with the parking requirements. Off-street parking is available for at least
four vehicles.
8. No parking or storage is provided for more than one commercial vehicle or
any commercial vehicle over 10,000 pounds licensed gross vehicle weight per
dwelling unit pursuant to ECDC 17.50.100.
No commercial vehicles are proposed for this project.

b. The sale or display of goods is restricted by ECDC 20.20.020.A. This section
states that no goods shall be sold or rendered on the premises except
instructional materials pertinent to the home occupation.
ECDC 20.20.020.13 requires a building permit and a Type II Conditional Use Permit
for any proposed commercial signage in a residential zone. A sign is allowed in
conjunction with a home occupation approval and shall not exceed four square
feet in size. This sign area shall be calculated as part of, not in addition to, the
total sign area permitted on the site (up to 4 square feet in residential zones
pursuant to ECDC 20.60.030.A). No signage is proposed for this project.
This application was reviewed and evaluated by Snohomish County Fire District No. 1 as
well as the City's Building and Engineering Divisions (Attachment 8). Engineering noted
that the information submitted was consistent with Title 18 ECDC and engineering
standards.
Based on the above analysis of the project proposal, it has been determined that the
proposal is consistent with the applicable requirements of the Edmonds Community
Development Code (ECDC), particularly the requirements of the Multiple Residential
(RM-1.5) zone, the on -site parking requirements, and the home occupation
requirements. Appropriate conditions will be added to the permit and no reasons to
deny the permit have been found pursuant to ECDC 20.20.020.C.
Based on the facts, conclusions, and attachments to this report, staff GRANTS the
Conditional Use Permit for File No. PLN20140028 with the following conditions:
1. The applicant must obtain a business license through the City Clerk's Office prior to
operating the home occupation.
The home occupation shall comply with all of the criteria of ECDC 20.20.010(B),
including but not limited:
a. Visits to the site by customers shall not be in excess of one vehicle per hour.
b. Customers shall not visit the site between the hours of 9:00 pm and 8:00 am.
3. The home occupation shall comply with the general regulations of ECDC 20.20.020,
as amended.
4. Individual elements of this project are required to meet all applicable city codes, and
it is the responsibility of the applicant to apply for and obtain all necessary permits.

Pursuant to ECDC 20.07.004, a party of record may submit a written appeal of a Type II
decision to the Development Services Director within 14 days after the date of issuance
of the decision. The appeal shall be made in writing and shall include all required
information stated in ECDC 20.07.004(D) as well as the applicable fee. Appeals are
presented to the Hearing Examiner. The appeal would be heard at an open record
public hearing before the Hearing Examiner according to the requirements of ECDC
Chapter 20.06 and Section 20.07.004.
ECDC 20.05.020 describes the time limits for conditional use permit approval. Unless
the owner obtains a building permit or, if no building permit is required, substantially
commences the use allowed within one year from the date of approval, the conditional
use permit shall expire and be null and void, unless the owner files for an application for
an extension of time before the expiration date. An application for any extension of
time shall be reviewed by the community development director as a Type II decision.

In response to your letter of July 31, 2014 the following is
offered:
1. My wife and I own the property is 607 Daley. About eight or
nine years ago we updated the property to conform to the
city's standards for legal duplex. Upon the completion of that
work we decided to occupy the entire building as our persona-1
residence. There are four off-street parking spaces behind the
premises, which are accessed through the alley. Since my wife
and I occupy the entire premises all those spaces are available
to us. (A site plan is appended to this letter.)
2. My wife and I are both semi retired mental health
counselors. I plan to see four to eight clients on Monday. My
wife plans to see four to eight clients on Tuesdays and
Wednesdays. We will be using one room as an office in the
lower unit. There is a separate lower west side entrance. We
will not be seeing clients simultaneously on the same day. We
see one client per hour. I made a statement on our original
application that our business does not violate the stipulated
requirements for home occupation. It will not harm the
character of the surrounding neighborhood. If you need any
further information to complete our application please contact

On behalf of the City of Edmonds Planning Division, I have reviewed your application for
