Approval of an Accessory Dwelling Unit (ADU) requires compliance with Edmonds Community Development Code (ECDC) Chapters 16.20 and 20.21. Pursuant to ECDC 20.01, an ADU is a Type II decision requiring public notice. The subject site is located within the RS-8 Single -Family Residential zone (Attachment 8). The purposes of the RS — Single -Family Residential zones are to reserve and regulate areas primarily for family living in single-family dwellings and to provide for additional non- residential uses which complement and are compatible with single-family dwelling use. Pursuant to ECDC 16.20.010.D, an Accessory Dwelling Unit (ADU) is an allowed secondary use with a conditional use permit. The proposal is required to comply with the purposes of the single-family residential zone and the criteria outlined in Chapter 20.21. Based on review of the specific ADU criteria (as described in Section C of this report), staff feels that the proposal is in compliance with the purposes of the single-family zone. Section 20.21.030 of the Edmonds Community Development Code provides the criteria by which Accessory Dwelling Units are to be reviewed. In order for the permit to be approved, all of the criteria must be met. The criteria for approval and analysis of each criterion follow: 1. ECDC 20.21.030.A — Permit Required Permit Required. Any person who occupies or permits another person to occupy an attached accessory dwelling unit as a place of residence shall first obtain a permit. The permit shall be reviewed and processed as a Type 11 decision (Staff decision — Notice required). This application for a conditional use permit for an accessory dwelling unit was submitted to the City on July 15, 2014 (Attachment 1). The application was determined to be complete on August 12, 2014 (Attachment 9). On August 20, 2014, a "Notice of Application" was issued in accordance with ECDC 20.03. The notice was mailed to property owners within 300 feet of the subject site based on the adjacent property owners list submitted by the applicant. It was posted at the subject site and at the Public Safety Complex, the Development Services Department, and the Public Library. The notice was also published in the Herald Newspaper. The associated public notice documentation is included as Attachment 10. FWT47161", A single-family dwelling may have no more than one accessory dwelling unit per lot. The proposal will result in only one ADU and therefore is in compliance with the number of units allowed per ECDC 20.21.030.13 (Attachments 5 — 7). Size. In no case shall an accessory dwelling unit be (1) larger than 40 percent of the livable floor area of the principal dwelling, (2) nor more than 800 square feet, (3) nor have more than two bedrooms, provided, if the accessory dwelling unit is completely located on a single floor, the planning manager may allow increased size up to 50 percent of the floor area of the principal dwelling in order to efficiently use all floor area, so long as all other standards set forth in this chapter are met. The existing residence has 2,551 square feet of livable floor area while the ADU is proposed to consist of 1,096 square feet (Attachments 2 — 4). As a result, the ADU would be 43% of the total livable floor area of the primary dwelling. The proposed ADU is located completely on the lower floor of the existing residence. A mechanical/storage area and garage on the lower floor will not be used by the occupants of the ADU (Attachment 6). Since the proposed ADU is below 50% of the floor area of the principal dwelling and located on a single floor, the applicant is allowed to increase the floor area of the ADU in order to efficiently the floor area. The proposed ADU would have two bedrooms. Since it would be less than 50% of the floor area of the principal dwelling but be located on a single floor, the applicant is allowed to increase the floor area of the ADU in order to efficiently the floor area. Staff has determined that the application meets the size criteria. The single-family appearance and character of the residence shall be maintained when viewed from the surrounding neighborhood. The design of the accessory dwelling unit shall be incorporated into the design of the principal dwelling unit and shall be designed to maintain the architectural design, style, appearance, and character of the main building as a single-family residence using matching materials, colors, window style, and roof design. The primary entrance to the accessory dwelling unit shall be located in such a manner as to be unobtrusive when viewed from the street. Whenever possible, new entrances should be placed at the side or rear of the building. Only one electric and one water meter shall be allowed for the entire building, serving both the primary residence and the accessory dwelling unit. Accessory dwelling units must be located within or attached to single-family dwelling units. The existing house faces west and fronts on 881h Avenue West (Attachment 5 — lower drawing). The ADU will be located in the lower level of the home and accessed from the north of the house. A new egress window will be added to the west fagade and an existing walkway will be extended to the north door but no other changes are proposed to the building's exterior (Attachments 2 — 3). Staff finds that the proposed ADU maintains the architectural design, style, appearance, and character of the main building and would not compromise the single-family appearance of the residence; therefore, the subject application complies with the location and appearance criteria. 1111111=0Fn Parking. One off-street parking space in addition to the parking spaces normally required for the principal dwelling shall be required to be provided for the accessory dwelling unit, but in no event less than three spaces per lot. The residence has a three car garage accessed from the south side of the building. At least one additional space could also be created within the existing driveway area (Attachment 3). Scribner Accessory Dwelling Unit File No. PLN20140030 Page 3 of 6 The application will comply with ECDC 20.21.030.E. Occupancy. Either the primary dwelling or the accessory dwelling unit shall be owner - occupied. "Owner -occupied" shall mean a property owner who makes his or her legal residence at the site, as evidenced by voter registration, vehicle registration, or similar means, and actually resides at the site more than six months out of any given year, and at no time receives rent for the owner -occupied unit. The owner(s) shall not rent the designated owner -occupied unit at any time during the pendency of the ADU permit, any such rental shall void the permit. The owner(s) shall not rent any portion of the owner - occupied residence either during the owner(s)' occupancy or while the owner is absent from the owner -occupied unit for any period. In no event shall the total number of occupants exceed one family as defined in this code; provided, however, that if the accessory dwelling unit is occupied by a nurse or other caregiver assisting a disabled person who is an occupant of the principal residence, or the principal residence is occupied by a nuns%aregiver and the accessory dwelling unit is occupied by a disabled person under the nurse's care, the occupancy limit of one family may be increased by one additional unrelated person to a total of one family related by genetics, adoption or marriage plus one unrelated person, or a total of six unrelated persons. In no event shall the total number of occupants exceed one family as defined in this code. The applicant has submitted a notarized affidavit to the City that meets this requirement (Attachment 11). The applicant must also file the Covenant required by ECDC 20.21.025.A.2 with the County Auditor following issuance of the ADU building compliance permit. Safety, Light, Ventilation, Floor Area and Similar Factors. Accessory dwelling units shall comply with all applicable requirements of the Uniform Housing Code and the Uniform Building Code adopted by ECDC Title 19 and shall comply in all respects with the provisions of the Edmonds Community Development Code. No permit for an accessory dwelling unit shall be issued to a nonconforming structure unless that structure is brought into conformance with the then current provisions of this code. The applicant has applied for a building permit to remodel the lower level of the existing house to create the ADU space (BLD20140904). Approval of those plans will indicate compliance with applicable building codes and inspections will verify that the constructed improvements comply with the approved plans. No public comment letters were received on the subject proposal. Scribner Accessory Dwelling Unit File No. PLN20140030 Page 4 of 6 The subject application was reviewed by Snohomish County Fire District #1 as well as the Building and Engineering Divisions. The Fire District did not have any comments on the proposed project (Attachment 10). The Building Division noted that an ADU compliance building permit must be obtained and all work and inspections approved prior to occupancy as an ADU (Attachment 11) — as mentioned above, the applicant has applied for a permit (BLD20140904). Engineering Division noted that "extra parking area" shown on the site plan (Attachment 3) must be located such that an on -site turnaround for vehicles is maintained (Attachment 12) — this requirement will be verified with the building permit. MVITsT9 e Based on statements of fact, conclusions, and attachments in this report, the application for a conditional use permit for an accessory dwelling unit at 19905 88th Avenue West is GRANTED, subject to the following conditions: 1. The Accessory Dwelling Unit Covenant must be filed with the Snohomish County Auditor per ECDC 20.21.025.A.2. This covenant can be obtained from the Planning Division with issuance of the building permit. Prior to occupancy of the ADU, the applicant must either: a. Have the City file the covenant by submitting a $162 processing fee ($90 for the City's recording processing fee and the County's $72 recording fee); OR b. Take the covenant to the County and record it for the $72 recording fee AND return a copy of the recorded covenant to the Edmonds Planning Division with the Auditor's recording sticker on the copy. 2. The ADU cannot be occupied prior to final inspection and grant of occupancy by the City in association with the building permit for the remodel (BLD20140904). 3. This permit shall expire automatically if any of the following issues arise: The Accessory Dwelling Unit is substantially altered and is thus no longer in conformance with the associated building plans approved by the City. b. The subject site ceases to maintain the required number of parking spaces. c. The property owner ceases to reside in either the primary residence or the Accessory Dwelling Unit, the owner -occupied unit is rented, or the current (or future) owner fails to file the affidavit required under ECDC 20.21.025.A.1. 4. The Accessory Dwelling Unit permit shall not be transferable to any site other than the subject site described in the application. The Accessory Dwelling Unit permit is transferable to new owners of the subject property unless there is a violation of any conditions of approval listed above. However, the new owners must file a notarized Accessory Dwelling Unit Affidavit with the City of Edmonds Planning Division indicating they are aware of the requirements for the ADU. The only exterior changes required will be one new egress window located under the front porch on the West side and one existing window removed and lowered on the North side. The proposed A.D.U. meets the criteria of the City of Edmonds Chapter 20.21.030. The proposed ADU is 1096 square feet and 43% of the total existing living space. Although it does not fit the criteria of being under 800 sq. ft. it is designed to best utilized the existing basement space and does not exceed 50 % of the principal dwelling (20.21.030.C). Being within the original footprint of the house and with minimal exterior changes it blends in well with the existing exterior conditions. The main house entry is on the West of the home and the ADU will utilize an existing exterior entry on the North side. An existing walkway will be extended to the ADU entrance from the parking area to provide access. There is an existing three car garage in the structure and room for one additional car to be parked at the south end of the driveway. This additional space shall be designated for the A.D.U. meeting the requirements for on -site parking.
