I. INTRODUCTION
The purpose of this lot line adjustment is to transfer 2,365 square feet of land from
Cheeseman (1540 9th Ave. N — Parcel B) to Faulds (1530 9th Ave. N — Parcel A).
II. FINDINGS AND CONCLUSIONS
A. GENERAL INFORMATION
1. Request: Lot line adjustment
2. Review Process: A lot line adjustment is a Type I decision pursuant to ECDC
20.01.003. The director reviews the project and issues an administrative
decision pursuant to ECDC 20.75.050.C.
3. Owners: Douglas R. Faulds and Donna R. Ernst (Parcel A); Robert E. Cheeseman
and Wendy L. Clarke (Parcel B)

12. Improvements: No improvements are required by the City Engineer with the
proposed lot line adjustment.
State Environmental Policy Act (SEPA) review is not required for lot line adjustments
per WAC 197-11-800(6).
C. TECHNICAL COMMITTEE
In addition to the Planning Division, this application was reviewed by the City's
Engineering Division. Engineering had no comments on the proposal and indicated it
met the requirements of Title 18 ECDC. (Attachment 6)
D. NEIGHBORHOOD CHARACTERISTICS
The project is located in the Bowl, about one mile north of downtown Edmonds.
The subject parcels are zoned Residential Single Family (RS-12) as are the rest of the
parcels in the immediate vicinity.
E. COMPREHENSIVE PLAN COMPLIANCE
The Comprehensive Plan designation for this site is "Single Family Resource". The
existing designation will not change as a result of this project. The current proposal
meets the intent of the Comprehensive Plan.
F. ZONING CODE (ECDC 16.20)
1. Lot Area: The minimum lot area in the RS-12 zone is 12,000 square feet.
2. Lot Width: The minimum lot width in the RS-12 zone is 80 feet.
3. Setbacks: RS-12 setbacks are: 25' from street property lines; 10' from side
property lines; and 25' from rear property lines.
G. ENVIRONMENTAL SETTING
Both parcels gently slope from east to west toward Puget Sound and have received
'waivers' from further critical area study (1530 9th Ave. N — CRA20030074; 1540 9th
Ave. N - CRA20080052)
H. LOT LINE ADJUSTMENT COMPLIANCE ECDC (ECDC 20.75.050)
A lot line adjustment shall be approved unless the proposed adjustment will:
1. Create a new lot, tract, parcel, site, or division;

The proposal will not create a new lot, tract, parcel, site, or division. The
proposal is to send 2,365 sq. ft. of land from one existing, developed parcel to
another (Attachment 2).
2. Reduce the setbacks of existing structures below the minimum required by code
or make existing nonconforming setbacks of existing structures more
nonconforming than before;
The proposal will not reduce the setbacks of existing structures or make existing
structures more nonconforming. Parcel A will gain additional land to the north
of the existing house. Parcel B will lose land to the south of the existing house
but will retain sufficient land to maintain a 11.8' setback from the south property
line. A minimum 10' side setback is required in that location (Attachment 2).
3. Reduce the lot width or lot size below the minimum required for the applicable
zone;
Both the lots will continue to meet the lot width and area requirements for the
zone (Attachment 2).
4. Transform a nonbuildable lot, tract, parcel, site or division into a buildable lot,
tract, parcel, site or division;
Both lots are buildable (each has an existing single family residence and
appurtenances) and will remain so after the adjustment.
5. Would otherwise result in a lot which is in violation of any requirement of the
ECDC.
There is no indication that this proposal is in violation of the Edmonds
Community Development Code. Both lots meet the minimum lot size and width
requirements for the RS-12 zone and minimum setbacks on either side of the
altered lot line will be maintained.
Based on the Findings of Fact, Conclusions, and Attachments to this report, the
following decision is issued by the City of Edmonds Planning Division. The lot line
adjustment, as proposed in Attachment 2, is APPROVED with the following conditions:
1. Prior to submitting survey documents to the Planning Division for 'final review',
please make the following changes:
a. Verify that all references to the City's lot line adjustment file use
PLN20150028.
b. It is the applicant's responsibility to ensure that all documents to be recorded
meet the Snohomish County Auditor's requirements for recording. These
requirements include, but are not limited to, minimum margin requirements,
providing original signatures in black ink, and determining any tax liabilities
with the County Treasurer.

2. After the above changes have been made, submit the revised and signed survey
documents to the Planning Division for 'final review'.
3. Once 'final approval' has been issued by the City, the applicant shall take the
documents to the Snohomish County Auditor's Office for recording.
4. After recording the lot line adjustment, the applicant must provide the Planning
Division with two (2) copies of the recorded documents (with the recording
number shown). The City will not consider the lot line adjustment to have been
completed until this is done.
5. The applicant must file new deeds for each of the parcels with Snohomish
County, as appropriate. The County may not consider the lot line adjustment to
be complete until this is done.
Type I permit decisions may be appealed by a party of record to Snohomish County
Superior Court within 21 days of the date of the decision pursuant to ECDC 20.07.006.
The property owner may, as a result of the decision rendered by the staff, request a
change in the valuation of the property by the Snohomish County Assessor's Office.

pipeline, from its entrance point from the Grantees' property onto
the Grantors' property and extending to the exit point and into the

3rd. The Grantees further agree that In the event the Grantors'
black top driveway should he damaged or destroyed an a result of any
maintenance, repair or reconstruction of the above -mentioned sanitary
sewer pipeline, the Grantees shall repair or reconstruct said
black top driveway in a moner that it shall not appear scarred,
Including possible complete repaving or oveicoating If necessary,
all of which gust be entirely satisfactory to the Grantors. Also
the Grantees shall repair or replam, at their exisanse, curbing,
pipes or other property that Is damaged rr destroyed as a result
of any maintenance, repair or reconstruction.

baddm granted herein.
5th. Material excavated during the Installation, repair or recon-
struction of said sewer shall be placed an Plastic shooting until
back fill Is made. All excess material shall be removed from the
Grantors' property. The Grantees shall remove the turf prior to sewer
trench excavation and shall stores , in the order of Its removal,
on the Grantees' property. Also any bt top soil necessary to
level sold turf, when it is returned to the Grantors' property. r.,ay
be obtainad from the Grantees' property. It shall be the responsibility
of the Grantors to return said turf to the top of the trench as soon
as practicable.
6th. installation, repair or reconstruction of said sanitary
sewer pipeline, including restoration an any of the Grantors'
property which may bed d thereby, shall be completed within
thirty (30) days of c ^fling said installation, repair or
reconstruction, provided that, if the initial Installationand/Of
construellon of the sanitary sewer Pipeline Presently coat lat.d
and/or proposed by the Grantees, is not commenced within one (1)
year f the date of this instrumanto said instrument and the
rights granted and conveyed herein, shall become null and void.

across, over, under and upon the following described lands and premises situated in the Courdy of Sop homtsh ,
State of Washington, to -wit
Together with the right of Ingress to and egress from said lands across adjacent lands of the Grantor, for tho
purpose of constructing, reconstructing, repairing, renewing altering, changing, patrolling and operating said line,
and the right at any time to remove said facilities from said lands
Also the right at all times to cut and/or trim all brush, timber, trees or other growth standing or growing upon
the lands of Grantor which, in the opinion of Grantee, constitute a menace or danger to said line or to persons or
property by reason of proximity to said line. Grantor and the heirs, successors, or assigns of Grantor hereby
covenant and agree not to construct or permit to be constructed any structures of any kind on the easement area
without approval of the District
The Grantor and the heirs, successors or assigns of Grantor covenant and agree not to do any blasting or
discharge any explosives within a distance of three hundred (300) feet of said line without giving reasonable notice
in writing to the Grantee, its successors or assigns, of intention so to do
The rights, title, privileges and authority hereby granted shall continue to be in force until such time as the
Grantee, its successors or assigns, shall permanently remove said poles, wires and appurtenances from said lands,
or shall otherwise permanently abandon said line, at which time all such rights, title, privileges and authority hereby
granted shalt terminate.
The Grantor also covenants to and with the Grantee that Grantor is lawfully seized and possessed of land
aforesaitf, has a good and lawful right and power to sell and convey same, that same are free and clear of
enodri brancAs, except as above indicated, and that Grantor will forever warrant and defend the title to said
-aasement and the quiet possession thereof against the lawful claims and demands of all persons whomsoever
Any mortgage on sajd land held by the Mortgagee is hereby subordinated to the rights herein granted to the
Carantee, but in till -Sthbr respects the said mortgage shall remain unimpaired
