Subject: EDMONDS FISHING PIER REHABILITATION — LETTER OF EXEMPTION
FROM THE REQUIREMENTS OF A SHORELINE SUBSTANTIAL
DEVELOPMENT PERMIT
Dear Ms. Knudsen:
The City of Edmonds Planning Division has reviewed your June 29, 2015 request for an
exemption from the requirement to obtain a Shoreline Substantial Development Permit for the
purposes of repairing the existing Edmonds Fishing Pier structure including replacing and/or
repairing existing utilities and furnishings located on the pier.
Upon review of the application materials, the City has concluded that the proposed repairs to the
Edmonds Fishing Pier is exempt from the need to obtain a Shoreline substantial
Development Permit pursuant to WAC 173-27-040(2)(b) because the work proposed is
normal maintenance or repair of an existing structure.
Piers are specifically defined as a water enjoyment use in ECDC 23.10.045.B.530 and the
existing fishing pier provides public access to the City's shoreline. The project is consistent with
the City of Edmonds Shoreline Master Program (Chapter 23.10 ECDC), particularly the
following goals and regulations:
ECDC 20.10.075 Public access element goal and policies
B.5 With principal access to tidelands existing at public beaches to the north and south,
the city, where practicable, should acquire. and develop safe convenient intermediate
public access for pedestrian access and water access to and use ofpublic tidelands
and beaches.
B.6. Public pedestrian access for neighborhood use should be encouraged.
ECDC 23.10.185 Use regulations — Public access pier or boardwalk
ECDC 23.10.185.B.1 Permitted Uses. This section allows for the development and use of
public access piers or boardwalks to provide public access to and along the shoreline or
associated wetlands.
ECDC 23.10.185.F Certain Substances Prohibited. No part of a public access pier or
boardwalk or other component that may come into contact with the water or wetland may
be treated with or consist of creosote, oil based paints, toxic chemicals, or other
substances that would be harmful to the aquatic environment, unless specifically
permitted and authorized by appropriate state and federal regulatory agencies.
This letter provides an exemption from the need to obtain a Shoreline Substantial Development
Permit from the City of Edmonds; you may wish to contact other State and Federal Agencies to
determine if any further approvals are required.
