Subject: MARINA BEACH PLAY STRUCTURE REPLACEMENT — LETTER OF
EXEMPTION FROM THE REQUIREMENTS OF A SHORELINE SUBSTANTIAL
DEVELOPMENT PERMIT
Dear Ms. Hite:
The City of Edmonds Planning Division has reviewed your April 22, 2016 request for an
exemption from the requirement to obtain a Shoreline Substantial Development Permit for the
purposes of replacing the existing play structure at the Marina Beach Park.
Upon review of the application materials, the City has concluded that the proposed replacement
of the play structure is exempt from the need to obtain a Shoreline substantial Development
Permit pursuant to WAC 173-27-040(2)(b) because the work proposed is normal maintenance or
repair of an existing structure.
Parks and Recreational facilities are permitted uses in all of the City's shoreline environments
according to ECDC 23.10.120. The project is consistent with the City of Edmonds Shoreline
Master Program (Chapter 23.10 ECDC), particularly the following goals and regulations:
ECDC 20.10.080 Recreational element goal and policies
A. Goal. It is the goal of the city to provide substantial recreational opportunities for
the public in shoreline areas through the preservation and expansion of these
opportunities through programs such as acquisition, development and maintenance.
B.3. The city should consider both active and passive in -water, shoreline and upland
recreational needs in development of recreational areas to meet local and regional
needs.
B.S. Recreation facilities in the shoreline area should be restricted to those dependent
upon a shoreline location, or those benefiting from a shoreline or in -water location
that are in the public interest.
B.6. Public recreation facilities should be designed, developed and maintained to respect
the shoreline environment, and minimize the degradation of the shoreline and its
natural systems.
ECDC 23.10.180 Use regulations — Public parks and public recreation facilities.
ECDC 23.10.180.B.1 Permitted Uses. This section allows for the development and use of
a broad range of public parks. The level and scope of the development, nature and extent
of amenities, and type and intensity of activities in and for each park will be determined
by the city based on the physical environment, location, surroundings and needs and
demands of the community.
ECDC 23.10.180D.3 In the urban mixed -use environments, structures may not exceed a
height of 30 feet above average grade.
This letter provides an exemption from the need to obtain a Shoreline Substantial Development
Permit from the City of Edmonds; you may wish to contact other State and Federal Agencies to
determine if any further approvals are required.
