PLN20160033 Staff Report with attachments.pdfCITY OF EDMONDS 121 51h Avenue North, Edmonds WA 98020 Phone: 425.771.0220 • Fax: 425.771.0221 • Web: www.edmondswa.aov DEVELOPMENT SERVICES DEPARTMENT • PLANNING DIVISION Project: Accessory Dwelling Unit (ADU) Permit File Number: PLN20160033 Date of Report: August 23, 2016 Reviewed By: - — Sean Conrad Associate Planner Owner/Applicant: Ken Ketchum A. INTRODUCTION The subject application is for an Accessory Dwelling Unit (ADU) which will be an addition to an existing single-family residence addressed 18424 72od Avenue W. (Attachments 1 and 2). The site is located within the Single -Family Residential, RS-8, zone (Attachment 4). The land use application is included as Attachment 1. The submitted site plan and floor plans are included for reference as Attachment 2. The proposed ADU would be an addition on the east side of the house. The ADU will be approximately 550 square feet in size. This area includes a separate bedroom, bathroom, living room area and kitchen. Because the applicant is proposing to have separate kitchen, bath, and sleeping facilities within the proposed addition, an Accessory Dwelling Unit (ADU) permit is required. Approval of an ADU requires compliance with Edmonds Community Development Code (ECDC) Chapters 16.20 and 20.21. Pursuant to ECDC 20.01, an ADU is a Type II decision requiring public notice. B. COMPLIANCE WITH ECDC CHAPTER 16.20 The subject site is located within the Single -Family Residential, RS-8, zone (Attachment 4). The purpose of the RS - Single -Family Residential zones are to reserve and regulate areas primarily for family living in single-family dwellings and to provide for additional non-residential uses which complement and are compatible with single-family dwellings. Pursuant to ECDC 16.20.010(D), an Accessory Dwelling Unit (ADU) is an allowed secondary use with a conditional use permit. The proposal is required to comply with the purposes of the single-family residential zone and the criteria outlined in ECDC Chapter 20.21. Based on staff s review of the specific ADU criteria (as described in Section C of this report), staff finds that the proposal is in compliance with the purposes of the single-family zone. File No. PLN20160033 Ketchum ADU Page 2 of 6 C. COMPLL4,NCE WITH ECDC CHAPTER 20.21 Section 20.21.030 of the Edmonds Community Development Code (ECDC) provides the criteria by which Accessory Dwelling Units (ADUs) are to be reviewed. In order for the permit to be approved, all of the criteria must be met. The criteria for approval are as follows: (1) Land Use Permit; (2) Number of Units; (3) Size; (4) Location and Appearance; (5) Parking; (6) Occupancy; and (7) Safety, Light, Ventilation, Floor Area, and Similar Factors. The ADU criteria were crafted to ensure that ADUs would comply with Chapter 16.20 of the Edmonds Community Development Code. Detailed explanations of staff's review of each criterion follows. 1. Land Use Permit Required Pursuant to ECDC 20.21.030(A), a land use permit is required for approval of an attached ADU. An application for a land use permit for the subject ADU was submitted to the City on June 28, 2016 (Attachment 1). The proposed site plan and floor plans are included for reference in Attachment 2. The initial submittal also included an ADU owner affidavit (Attachment 3). The application was found to be complete on July 21, 2016 pursuant to ECDC 20.02.002 (Attachment 5). 2. Number of Units The proposal will result in only one ADU. This is in compliance with the number of units allowed per ECDC 20.21.030(B). 3. Size According to ECDC 20.21.030(C), "In no case shall an accessory dwelling unit be (1) larger than 40 percent of the livable floor area of the principal dwelling, (2) nor more than 800 square feet, (3) nor have more than two bedrooms; provided, if the accessory dwelling unit is completely located on a single floor, the planning manager may allow increased size up to 50 percent of the floor area of the principal dwelling in order to efficiently use all floor area, so long as all other standards set forth in this chapter are met." The floor plans are included within Attachment 2. According to the floor plans, the livable area of the ADU is approximately 550 square feet. The livable area includes the ground floor of the ADU and a small portion of the storage area located on the north end of the ADU. With the area of the proposed ADU, this yields a total livable area for the residence of 1,648 square feet. The proposed ADU (550 square feet) would comprise 33% of the total livable floor area (1,648 square feet) of the primary dwelling. The following table describes both the maximum size that Accessory Dwelling Units are allowed to be as well as the proposed size for this application: Maximum Allowed Proposed 40% of livable area of the primary dwelling 33% of livable area of the primary dwelling 2 bedrooms 1 bedroom 800 square feet* 550 square feet *Note: Pursuant to ECDC 20.21.030.C, if the ADU is completely located on a single floor, the Planning Manager may allow increased size up to 50 percent of the floor area of the principal dwelling in order to efficiently use all floor area, so long as all other standards are met. The proposed ADU meets all of the size standards pursuant to ECDC 20.21.030.C. 4. Location and Appearance According to Chapter 20.21.030(D) of the Edmonds Community Development Code: File No. PLN20160033 Ketchum ADU Page 3 of 6 The single-family appearance and character of the residence shall be maintained when viewed from the surrounding neighborhood. The design of the accessory dwelling unit shall be incorporated into the design of the principal dwelling unit and shall be designed to maintain the architectural design, style, appearance, and character of the main building as a single-family residence using matching materials, colors, window style, and roof design. The primary entrance to the accessory dwelling unit shall be located in such a manner as to be unobtrusive when viewed from the street. Whenever possible, new entrances should be placed at the side or rear of the building. Only one electric and one water meter shall be allowed for the entire building, serving both the primary residence and the accessory dwelling unit. Accessory dwelling units must be located within or attached to single-family dwelling units. The front of the residence faces 72nd Avenue W. and is currently a single -story residence. The proposed ADU will be located on the east side of the existing residence, between the residence and 72°d Avenue W. The entrance to the ADU will be from the east side of the ADU and will be visible from the street. However, the placement of the ADU on the east side of the existing residence creates a small courtyard between the ADU and the residence. Although the existing residence will continue to be accessed from the front of the house, from the street only one front entry door will be visible (See elevations in Attachment 2) Therefore, from the street it will appear as single-family residential house and will not draw additional attention to the residence as containing an ADU. The ADU will incorporate Hardie plank siding, exterior colors and window trim to match the existing residence. The outward appearance of the ADU will not be significantly different from the existing residence and not create such a contrast as to draw undue attention to the ADU. The ADU will be connected to the main residence via a covered breezeway. The breezeway will be just less than 7 feet in width. The site plan indicates the connection of the ADU to the main house via a 2x4 trellis. This connection does not meet the definition of "attached" in the city's development code. The Edmonds Community Development code, section 21.05.010, defines an attached structure as "Any building attached by a breezeway, hallway, or other similar connection..." To meet the definition of attached the space between the roof of the house and the roof of the ADU will need to be a solid covering to protect someone from the weather. A condition of approval for the ADU will require the applicant to modify the building plans to show a connection that meets the definition of "attached" under the city code. Staff finds that the proposed ADU maintains the architectural design, style, appearance, and character of the main building and would not compromise the single-family appearance of the residence; therefore, the subject application complies with the location and appearance criteria. 5. Parking ECDC 20.21.030(E) states that one off-street parking space in addition to the two off-street parking spaces normally required for the principal dwelling shall be required to be provided for the Accessory Dwelling Unit. Therefore, a total of three on -site parking spaces are required. The minimum dimensional requirement for a parking stall is a width of 8.5 feet by a length of 16.5 feet. Pursuant to ECDC 18.95.030(B), one tandem space may be provided in order to meet the minimum required parking on RS-zoned lots. As such, one of the three required parking stalls may be tandem with another one of the required stalls. As depicted on the site plan (Attachment 2) the driveway serving the residence is approximately 45 feet in length, measured from the garage door to the east property boundary, and approximately 25-feet wide. This driveway is long enough to fit a tandem parking stall on the south side of the garage with the required third parking stall located in front of the garage. Therefore, parking for at least three cars can be File No. PLN20160033 Ketchum ADU Page 4 of 6 provided for on site, and the applicant has shown compliance with the applicable on -site parking requirements of ECDC 17.50.020(A)(1) and ECDC 20.21.030(E). 6. Occupancy ECDC 20.21.030(F) states that as a condition of approval, the homeowner will be required to sign before a notary, an affidavit regarding their occupancy of one of the units for a minimum of six months of each calendar year. The applicant has submitted a notarized affidavit to the City that meets this requirement (Attachment 3). The applicant must also file the required covenant with the County Auditor following approval of the ADU, which has been added as a condition of approval. This covenant will be provided to the applicant for a signature and recording during the required building/compliance permit application review. 7. Safety, Light, Ventilation, Floor .Area, and Similar Factors ECDC Chapter 20.21.030(G) states that as a condition of approval, the applicant is required to apply for a Compliance Permit and inspection by a City Building Inspector to ensure that the Accessory Dwelling Unit meets the requirements of all life -safety codes and standards. Any conditions or corrections resulting from the inspection must be complied with per code requirements. Any approval of an ADU shall be conditioned to require compliance with the Building Division's inspection requirements. This has been made a condition of approval for the subject ADU permit. D. TECHNICAL REVIEW The subject proposal has been reviewed by the Building Division, Engineering Division, and Snohomish County Fire District No. 1. All comments are included in Attachment 6. The Building Division commented that compliance with all applicable building codes will be assessed during review of the associated building permit application. Compliance with applicable building code requirements has been included as a condition of approval. The Engineering Division provided a memorandum stating that the applicant has demonstrated that a third parking stall can be provided on site. The Engineering Division will review the subsequent building permit for the ADU for compliance with all engineering codes and construction standards. Snohomish County Fire District No. 1 noted that the proposed ADU would not affect the Fire District. As always, any affected divisions/departments may have comments related to the proposal as part of their respective reviews of any associated building permit application(s). E. PUBLIC COMMENTS A "Notice of Application" dated July 29, 2016 with a comment period ending on August 12, 2016 was mailed to property owners within 300 feet of the subject site based on the adjacent property owners list submitted by the applicant. The notice of application was posted on the site, at the Public Safety Complex, Development Services Department, and Library on July 29, 2016. The notice of application was also published in the Herald Newspaper on July 29, 2016. All public notice materials, including the notice, adjacent property owners list, declarations of mailing and posting, and an affidavit of publication are included as Attachment 7. No formal comments were received on the proposed project. Staff did receive several emails and phone calls from neighboring residents requesting information and clarification of the city rules regarding ADU's. This was provided to the residents via email. No further questions or comments were received after the information was provided. File No. PLN20160033 Ketchum ADU Page 5 of 6 F. PLN20160033 Dear Mr. Ketchum: Your land use application for an accessory dwelling unit located at 18424 72°d Avenue West (File No. PLN20160033) is considered complete pursuant to Edmonds Community Development Code (ECDC) 20.02.002. Within the next two weeks I will be notifying your neighbors and the general public, through postings and legal notice in the paper, of your request to construct an accessory dwelling unit on your property. The public and your neighbors will be afforded a two week comment period. Once the comment period is completed, I will continue my review of your application. Please note, however, that although it has been determined that the application meets the procedural submission requirements and is therefore complete, additional information may be needed as city staff continue with review of the application. Staff will contact you as our review continues if additional information is necessary. I have attached the comments received to date from the city's building division and engineering division. Regarding your connection of the ADU to the main house via a 2x4 trellis, this connection does not meet the definition of "attached" in the city's development code. The other option would be to connect the roof of the house with the roof of the ADU. A condition of approval for the ADU will require you to modify the building plans to show a connection that meets the definition of "attached" under the city code. I will be the main staff contact for your application. If you have questions at any point during the review process, you may reach me at (425) 771-0220 or sean.conrad@,edmondswa.goy. A building permit will be required for the modifications to the existing structure and construction of the addition. This permit will also include the establishment of the space as an accessory dwelling unit, as recognized by the International Residential Code (IRC). The IRC definition of Dwelling Unit as amended by the state of Washington requires that all required smoke alarms in the accessory dwelling unit and the primary dwelling unit are interconnected in such a manner that the actuation of one alarm will activate all alarms in both the primary dwelling unit and the accessory dwelling unit. The permit drawings should show compliance with the interconnected smoke alarm requirements as stated above. In lieu of the interconnection of smoke alarms as stated above, the two units may be separated by fire -rated construction (fire -rated walls and doors). If the option for fire -rated walls is proposed, the construction drawings will need to include the approved listing and details for the wall assembly. 4. All other applicable requirements of the building code will be verified under the building permit review and inspections. See City handout P1 for a representative list of requirements.
