Project Description The applicant has proposed to remove four trees at various locations within the Elm Place PRD (Attachments 1- 6). The trees have outgrown their locations and the roots of the trees have begun lifting driveways and growing into foundations. The proposal is to replace the trees at a ratio one-to-one with trees of a more appropriate size for their location. Two of the trees requested for removal are located with the 75-foot buffer of Willow Creek. Sufficient information was submitted on one of the trees located within the buffer to document it as a hazard tree. More information is needed before approval to remove the other tree within the stream buffer may be granted. The applicant has chosen to continue with the permit process for three of the trees and address the fourth tree at a later date. While trees on individual lots are regulated through ECDC 18.45, changes to landscaping within planned residential developments are subject to design review according to ECDC 20.13. C. Findings and Conclusions 1. The trees request for removal are located throughout the Elm Place PRD (Attachment 6). 2. The landscaping for the site was approved by the Architectural Design Board as part of the planned residential development process in 1983 (PRD-1-83 and P-9-83). While Norway Maple, Sweet Gum and Oak trees were originally planned for the PRD, it appears that red maples and cedars were used throughout the development as both street trees and ornamental plantings. 3. 602/604 Elm Place: a. A maple tree between 602 and 604 Elm Place is requested for removal and replacement (Attachment 2). b. The subject tree is located on the edge of the 75-foot buffer of Willow Creek. c. A memorandum from a certified arborist noted that several large roots have been severed close to the trunk potentially rendering the tree unstable. The arborist noted no other mitigation options other than removal given the size of the tree and their proximity to structure. d. Given the arborists memorandum documenting the hazardous nature of this tree, its removal is allowed pursuant to ECDC 23.40.220.C.8.b without the requirement of a critical area report. e. ECDC 23.40.220.C.8.b.iv requires hazard trees within critical areas to be replace with trees that are native an indigenous to the site and a minimum of one to two inches in diameter at breast height (dbh) for deciduous trees and a minimum of six feet in height for evergreen trees as measured from the top of the root ball. The application indicated this tree would be replaced with a "Spring Blast" evergreen spruce. This tree species is not native and indigenous. g. A condition has been added that a replacement tree the is native and indigenous to the site be selected for this replacement tree. 4. 609 Elm Place: a. The roots of a large maple tree on the south side of the residence have wrapped around the water meter and are growing into the foundation (Attachment 3). b. The proposal is to replace this tree with a vine maple or dogwood. 5. 622/624 Elm Place: a. A large maple tree between 622 and 624 Elm Place has begun to damage driveways and roots are growing into a garage (Attachment 4). b. While the arborist memorandum noted the nuisance nature of this tree, sufficient documentation has not been submitted that would allow this tree to be removed under the hazard tree provision of ECDC 23.40.220.C.8.b. d. In an August 22, 2016 letter, the City requested a di$ona>-information regar ing this tree (Attachment 7). In order for approval to be granted, the tree must be documented as a hazard tree by a certified arborist, or a report by a biologist is needed to evaluate the removal and provide recommendations for replacement trees. e. The applicant has indicated a wish to proceed with the permit and evaluate this tree at a later date. f. Removal of this tree is not granted with this application. 6. 637 Elm Place: a. A cedar tree near 637 Elm Place has died (Attachment 5). b. The proposal is to remove the dead cedar and replace it with a Japanese maple. D. Technical Review The Engineering Division reviewed the application and found the proposal to be consistent with Title 18 Edmonds Community Development Code and Engineering standards and requested conditions of approval which have been added to the decision (Attachment 8). E. Decision Based on the findings, conclusions, and attachments to this report, staff finds that the design review for file number PLN20160039 is APPROVED with the following conditions: This approval is valid only for the removal of the trees at 602/604 Elm Place, 609 Elm Place and 637 Elm Place. Removal of any other trees requires separate approval. 2. Replacement tree size shall be consistent with ECDC 20.13.015.13 which are: a. one -and -one -half -inch caliper deciduous trees; b. eight feet minimum height —vine maples and other multi -stemmed trees; c. six feet minimum height— evergreen trees; 3. Replacement trees shall be planted in the general vicinity of the trees removed. 4. The replacement tree for the tree between 602/604 Elm Place must be native and indigenous to the site. Please provide the City of Edmonds Planning Division with the proposed replacement tree for approval. 5. Trees shall be fell onto private property. 6. Vehicles and equipment shall be located on private property. A traffic control plan will be required as part of the right-of-way permit application. 7. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 8. Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk or other public improvements in City right-of-way per City standards that is caused by or occurs during the permitted project. 9. Contractor/owner is responsible for locating all on -site utilities. The water utility purveyor for this site is Olympic View Water and Sewer District and for sewer the purveyor is the City of Edmonds. Please respond to the following items: 1. Willow Creek flows through the Elm Place PRD. Willow Creek is a critical area with a 75-foot buffer pursuant Edmonds Community Development Code (ECDC) 23.90.040.D.1. The image below shows the approximate extent of the 75-buffer on Willow Creek. Two of the trees requested for removal are potentially located within this buffer area. The tree between 602 and 604 Elm Place appears to be right on the edge of the buffer, while the tree between 622 and 624 Elm Place is located within the stream buffer. ECDC 23.40.220.C.8.b Attachment 7 allows the removal of hazard trees within critical areas and critical area buffers without the requirement to prepare a critical areas report. A certified arborist must document that a tree is a hazard tree in order for a tree to be removed under ECDC 23.40.220.C.8.b. 602/604 Elm Place Tree: The application materials included a memorandum from Scott Selby, a certified arborist with Arborwell. The memorandum noted the tree between 602 and 604 Elm Place has had roots severed, potentially making the tree unstable. Mr. Selby noted there was no other mitigation option other than the removal of that tree. Normally, the City prefers documentation of hazard trees on the ISA Tree Risk Assessment Form; however, the City will accept this memorandum as sufficient documentation of the hazardous nature of that tree and no further critical area report will be required for this tree. ECDC 23.40.220.C.8.b also requires that replacement trees be native and indigenous to the area. The proposed replacement tree for the tree between 602 and 604 Elm Place is "spring blast" spruce. This tree is not a native and indigenous tree. Please select a native and indigenous replacement tree for this tree. 622/624 Elm Place Tree: There has been no documentation submitted on the tree between 622 and 624 Elm Place indicating that it is a hazard tree. More information is needed before approval for removal and replacement of this tree may be granted. Either documentation from a certified arborist documenting that this tree is a hazard tree must be submitted; or, if it determined not to be a hazardous tree, then a report from a qualified biologist will be required. The report from the biologist should address the following: 1. Identify acceptable species for the replacement trees. All replacement trees are not required to be of the same species, but must be of species that the biologist deems appropriate. 2. Identify locations of replacement trees. It should be noted that the replacement trees are not restricted to being planted entirely on your property, but could also be planted within the Elm Place common area. The replacement trees must account both for landscaping requirements (i.e. providing screening of your residence from street view) and critical areas requirements (i.e. providing habitat). As such, it is likely that the biologist would recommend planting at least one tree in the location of the existing tree as well as additional trees located closer to the stream. 3. Provide recommendations on how to plant the replacement trees. 4. Include a discussion on how the proposed tree removal and replacement will increase buffer functions in terms of stream and fish habitat protection. Please note this replacement tree will also have to be native and indigenous to the area. Neither the pink dogwood nor Japanese maple tree proposed for replacement is native and indigenous to the area. The information provided is consistent with Title 18 Edmonds Community Development Code & Engineering standards. Please place the following conditions of approval on the permit: 1) Trees shall be fell onto private property. 2) Vehicles and equipment shall be located on private property. Should it be necessary to utilize any portion of the City right-of-way, including the street or sidewalk, to perform any of this work then the contractor shall apply for and obtain a right-of-way construction permit in advance of starting. A traffic control plan will be required as part of the right-of-way permit application. 3) Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 4) Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk or other public improvements in City right-of-way per City standards that is caused by or occurs during the permitted project. 5) Contractor/owner is responsible for locating all on -site utilities. The water utility purveyor for this site is Olympic View Water and Sewer District and for sewer the purveyor is the City of Edmonds.
