I. INTRODUCTION
A. SUMMARY OF PROPOSAL: The purpose of this lot line adjustment is to revert the
subject lots to their boundaries previously approved by the City of Edmonds in the
2002 Corrected Short Subdivision (Snohomish Recording Number 200205315007).
This revision is necessary to resolve discrepancies between the lots as they are
owned and the lots as defined by their tax parcels (see Attachment 1).
B. DECISION ON LOT LINE ADJUSTMENT: Based on the Findings of Fact, Conclusions,
and Attachments to this report, the following decision is issued by the City of
Edmonds Planning Division. The lot line adjustment, as proposed, is APPROVED with
the following conditions:
1. Update the Conditions language on Sheet 1 to state: "Construction of
improvements, which were conditions of approval of Edmonds short plat S-95-
163, have not been completed. Completion of such improvements shall be a
condition of building permit issuance for Lot 2."
2. Change the file number to PLN20170005 on all survey sheets.
3. Submit signed and notarized documents to the Planning Division for final review
and endorsement.
4. Once the documents have been endorsed by the City, the applicant must take
the signed documents to the Snohomish County Auditor's Office for recording.
Please make sure that all documents to be recorded meet the Snohomish County
Auditor's requirements for recording.
5. After recording the lot line adjustment, the applicant must provide the City of
Edmonds Planning Division with two (2) copies of the recorded documents (with
the recording number shown). The City will not consider the lot line adjustment
to have been completed until this is done.
II. FINDINGS AND CONCLUSIONS
A. GENERAL INFORMATION
1. Request: Lot line adjustment
2. Review Process: A lot line adjustment is a Type I decision pursuant to ECDC
20.01.003. The director reviews the project and issues an administrative
decision pursuant to ECDC 20.75.050.C.

8. Existing Use: 16202 72nd contains a single family residence and detached garage.
The other three parcels are currently vacant.
9. Proposed Use: No change but the vacant parcels may be developed in the future
with a single family residence with an approved building permit.
10. Dedications: No dedication of land is required by the City Engineer with the
proposed lot line adjustment.
11. Improvements: No improvements are required by the City Engineer with the
proposed lot line adjustment.
B. SEPA THRESHOLD DETERMINATION
State Environmental Policy Act (SEPA) review is not required for lot line adjustments.
C. TECHNICAL COMMITTEE
In addition to the Planning Division, this application was reviewed by the City's
Engineering Division. It was noted in Attachment 5 that the proposal is consistent
with the requirements of Title 18 ECDC. Engineering did require that the Conditions
language on Sheet 1 be updated to clarify that construction of the remainder of the
subdivision improvements for S-95-163 will be required with the development of Lot
2.

D. NEIGHBORHOOD CHARACTERISTICS
The subject site is located in North Edmonds, less than % mile east of the former
Meadowdale Marina. The subject parcels are zoned Residential Single Family (RS-
12) as are the rest of the parcels in the immediate vicinity.
E. COMPREHENSIVE PLAN COMPLIANCE
The Comprehensive Plan designation for this site is "Single Family Resource". The
existing designation will not change as a result of this project. The current proposal
meets the intent of the Comprehensive Plan.
F. ZONING CODE (ECDC 16.20)
1. Lot Area: The minimum lot area in the RS-12 zone is 12,000 square feet.
2. Lot Width: The minimum lot width in the RS-12 zone is 80 feet.
3. Setbacks: RS-12 setbacks are: 25' from street property lines; 10' from side
property lines; and 25' from rear property lines. Flag lots have all side setbacks.
G. ENVIRONMENTAL SETTING
The parcels sit above the eastern extent of the North Edmonds Earth Subsidence and
Landslide Hazard Area (ESLHA) and are encumbered by a portion of the ESLHA and
its buffer. Steep slopes of varying grade and erosive soils are typical throughout the
site.
H. LOT LINE ADJUSTMENT COMPLIANCE ECDC (ECDC 20.75.050)
A lot line adjustment shall be approved unless the proposed adjustment will:
1. Create a new lot, tract, parcel, site, or division;
The proposal will not create a new lot, tract, parcel, site, or division. The
boundaries of the tax parcels currently do not match the boundaries of the lots
as they are owned. Approval of the subject lot line adjustment (Attachment 2)
would restore the boundaries to those previously approved in 2002 through the
amended S-95-163 (Attachment 6).
2. Reduce the setbacks of existing structures below the minimum required by code
or make existing nonconforming setbacks of existing structures more
nonconforming than before,
The proposal will not reduce the setbacks of existing structures or make existing
structures more nonconforming. Lots 2, 3 and 4 are still vacant. The house on
Lot 1 is nonconforming with respect to the north property line setback (10' side);
this will not be affected by the proposed adjustment (Attachment 2).
3. Reduce the lot width or lot size below the minimum required for the applicable
zone,

Each of the four lots will continue to meet the lot width and size requirements
for the zone (Attachment 2).
4. Transform a nonbuildable lot, tract, parcel, site or division into a buildable lot,
tract, parcel, site or division;
Each of the four lots in the Greenness short plat are buildable (with appropriate
building permits) and will remain so after the adjustment.
5. Would otherwise result in a lot which is in violation of any requirement of the
ECDC.
There is no indication that this proposal is in violation of the Edmonds
Community Development Code. All lots meet the minimum lot size
requirements for the RS-12 zone and have complying lot widths.
III. APPEALS
Type I permit decisions may be appealed by a party of record to Snohomish County
Superior Court within 21 days of the date of the decision pursuant to ECDC 20.07.006.
IV. NOTICE TO THE COUNTY ASSESSOR
The property owner may, as a result of the decision rendered by the staff, request a
change in the valuation of the property by the Snohomish County Assessor's Office.

Surveying LLC, and one 8 1/2" x 11" copy; (3) a title company certification for all
properties involved, which is not more than 30 calendar days old; (4) two checks in the
total amount of $985 for payment of the permit fee and records fee; and (5) a copy of my
letter to you dated March 3, 2015.
The enclosed Land Use Application is a resubmission of Lot Line Adjustment
Application No. PLN20150012. In response to your comments on the prior draft
documents under that application number, Mr. Holmes has revised the short plat
reversion / lot line adjustment.
As indicated in my letter to you dated March 3, 2015, the purpose of this lot line
adjustment is simply to return the subject lots to their boundaries set forth in the 2002
Corrected Short Subdivision (Snohomish Rec. No. 200205315007), which was
previously approved by the City. The goal of this is to harmonize the tax parcels with the
parcels as they are owned and encumbered. We believe this should be a simple process,

Dear Mr. Clugston and Ms. McConnell:

As previously indicated by email and as shown in the enclosed plans, the sole
purpose of this proposed "lot line adjustment" is to revert the subject lots to their
boundaries set forth in the 2002 Corrected Short Subdivision (Snohomish Rec. No.
200205315007), which was previously approved by the City. This reversion is necessary
to resolve discrepancies between the lots as they are owned and the lots as defined by
their tax parcels. A brief history of the ownership of the lots follows to illustrate why the
reversion is necessary.
At the time of the 2002 Corrected Short Subdivision, Lots 2-4 were owned by
Green Tara Incorporated ("GTI"), and Lot 1 was owned by Phillip and Mariam Lehn
("Lehn"). On May 21, 2004, GTI transferred Lots 3 and 4 to Robert Bradley, Jr.
("Bradley") by statutory warranty deed (Snohomish Rec. No. 200405210843).

On September 17, 2004, a Boundary Line Adjustment was recorded (Snohomish
Rec. No. 200409175157). This Boundary Line Adjustment was not signed by Bradley,
who owned Lots 3 and 4, no deeds were delivered effecting any change in the boundaries
near the time of this Boundary Line Adjustment, and the tax parcels remained unchanged.
On September 20, 2007, Bradley transferred Lots 3 and 4 back to GTI by deed in
lieu of foreclosure (Snohomish Rec. No. 200709200040). The next day, GTI granted to
Bradley two deeds of trust — one secured by Lot 3 (Snohomish Rec. No. 200709210167)
and the other secured by Lot 4 (Snohomish Rec. No. 200709210166). In both the deed
in lieu of foreclosure and the deeds of trust, Lots 3 and 4 were described by reference to
the 2002 Short Subdivision and did not reference the 2004 Boundary Line Adjustment.
On September 25, 2007, an "Amended Boundary Line Adjustment" was recorded,
which was a certification by the surveyor who prepared the 2004 Boundary Line
Adjustment, stating that "the property owners' signatures shown on [the 2004 Boundary
Line Adjustment] is now complete." On December 6, 2007, Lehn granted a deed of trust
to Washington Mutual (whose successor is Chase Bank) secured by Lot 1, as described in
the 2004 Boundary Line Adjustment. On August 8, 2009, Lehn and GTI recorded
several quit claim deeds to adjust the boundaries among the four lots and the adjoining
Tract X (Snohomish Rec. Nos. 200809090376, 200809090377, 200809090378,
200809090379, 200809090380). It appears that Snohomish County adjusted the tax
parcels accordingly in April 2009.
Following their execution and recording, no amendment was made to the 2007
deeds of trust granted to Bradley. Again, those deeds of trust did not include any
reference to the 2004 Boundary Line Adjustment (or the 2008 quit claim deeds). In
2014, Bradley foreclosed or executed on Lots 2, 3, and 4. The Sheriff's Deeds refer to
the lots as described in the 2002 Short Subdivision (Snohomish Rec. Nos,
201404150597,201409230109).
As a result of this history, the boundaries of the tax parcels do not match the
boundaries of the lots as they are owned. To remedy this discrepancy, the owners plan as
follows:
The City of Edmonds will approve of the lot line adjustment, i.e.
reversion, which would simply restore the boundaries to those already
approved by the City in the 2002 Short Subdivision.
• The ownership of Lots 2-4 is already based on the 2002 Short Subdivision.
Upon recording of the reversion, GTI will quitclaim to Lehn any interest
in Lot 1, thereby ensuring that the fee ownership of Lot 1 is consistent
with the 2002 Short Subdivision.

• Lehn and Chase Bank will record an amendment to the deed of trust
encumbering Lot 1 to reflect the reversion. [We are concurrently sending
to Chase Bank a form of Amendment to Deed of Trust for its review.]
Again, the goal of this is simply to make uniform the tax parcels, the ownership of
the land, and the encumbrances on the land. We believe this should be a simple process,
since this will merely be a reversion to a configuration already approved by the City. We

Engineering has reviewed the short plat reversion application for the Greenness property at
16202 — 72"d Ave W. The information provided is consistent with Title 18 Edmonds
Community Development Code & Engineering standards. It is requested that the following
be included as a condition of project approval.
Communication has previously been had regarding the need for a condition on the face of the
plat to address the subdivision improvements that have not yet been constructed. Consistent
with these communications the condition provided with the application reads: "Construction
of improvements, which were conditions of approval of Edmonds short plat S-95-163, has not
been completed. Completion of such improvements may be a condition to issuance of
building permits for Lots 2 — 4."
With the use of the word "may" in the last sentence, the application of this condition appears
to be subjective. The improvements will be required and this language should be revised to
provide clarity to future property owners. After looking over the plat documents again and in
light of the access restrictions that have been added to Lots 3-4, it seems appropriate to place
a condition on Lot 2 to complete the required improvements as a condition of building permit
issance.
As such, the following condition shall be placed on the face of the short plat:
"Construction of improvements, which were conditions of approval of Edmonds short plat S-
95-163, have not been completed. Completion of such improvements shall be a condition of
building permit issuance for Lot 2."
