subject to the General Design Review requirements of ECDC Chapter 20.11. Pursuant to ECDC
20.11.010, since the proposal does not require a SEPA threshold determination, the proposal may
be reviewed by staff as an administrative Type I decision, subject to the requirements of ECDC
20.01 and 20.02.
The applicant submitted a land use application form with cover letter (Attachment 1), initial
landscape plan (Attachment 2), and photographs of existing site conditions (Attachment 3) on
May 8, 2017. The application became procedurally complete pursuant to ECDC 20.02.002 on
June 5, 2017, and a letter confirming such was sent to the applicant on June 13, 2017 (Attachment
4). Upon further review of the application, staff found that additional information was necessary
and a letter requesting such information was sent to the applicant on July 6, 2017 (Attachment 5)
with a revised request correcting a typo being sent on July 24, 2017 (Attachment 6). The
applicant responded via email on August 31, 2017 (Attachment 7). Staff found that further
clarification was necessary and sent a second request for additional information on September 20,
2017 (Attachment 8). The applicant responded via email with a revised partial landscape plan on
October 6, 2017 (Attachment 9).
C. Criteria and Comprehensive Plan Compliance
The subject site is located within the "Mixed Use Commercial" designation of the
Comprehensive Plan as well as within the "Medical/Highway 99 Activity Center." Nothing in
this proposal appears to be in conflict with the goals and policies of the Comprehensive Plan.
D. Technical Review
The Engineering Division has reviewed the subject application and provided a memorandum
dated June 14, 2017 approving the proposal with five conditions (Attachment 10). One of these
conditions includes the requirement that a right-of-way permit must be obtained prior to utilizing
the City right-of-way, including the street or sidewalk, to perform any work. If the applicant
finds that such work is necessary, they must contact the Engineering Division for applicable
right-of-way permit requirements. All of the Engineering Division's conditions stated in
Attachment 10 are included as conditions of approval to the subject decision.
E. Public Comments
Pursuant to ECDC 20.01.003(C), public notice is not required for Type I decisions. Thus, public
notice was not required for the subject application. As such, no public comments have been
received in response to the proposal.
F. Findines and Conclusions
a. The subject site is located within the Multi -Family Residential, RM-2.4, zone. The properties
to the north, east and south of the subject site are also located within the RM-2.4 zone, while
the properties to the west across 80"' Ave. W located within the Single -Family Residential,
RS-8, zone.
b. Properties within the vicinity of the site are primarily developed with single- and multi -family
residential uses.
c. RM-zoned properties are subject to the General Design Review requirements of ECDC
Chapter 20.11.
d. A Critical Areas Checklist has not been completed for the subject site; however, there does
not appear to be a conflict between the proposal and the critical areas requirements of ECDC
Chapters 23.40 through 23.90. Therefore, no further critical areas study is required at this
time.

e. Initially, the applicant requested to remove four trees on the property addressed 21721 80"'
Ave. W (two located near the eastern property line and two located near the southwestern
corner of the multi -family building adjacent to the parking area) as well as four trees located
on the property addressed 21721 80"' Ave. W along the western portion of the southern
property line (Attachments 1, 2, and 3). However, in response to staffs requests for
additional information, the applicant modified the proposal to no longer include any work on
the property addressed 21713 80t' Ave. W (Attachment 9). Therefore, the only trees that are
being reviewed for removal under the subject application are the four trees identified on the
property addressed 21721 80"' Ave. W. The locations of these four trees are indicated on the
landscape plans within Attachments 2 and 9.
f. The subject site was initially developed in 1955 with an addition in 1981, which was well
before adoption of the City's current landscaping requirements.
g. Current landscaping requirements are contained within ECDC Chapter 20.13. Although the
current landscaping requirements are different than the landscaping requirements that were in
place at the time of original development of the site, any proposed changes to existing
landscaping are subject to the current code requirements of ECDC 20.13. Thus, any proposed
changes to existing landscaping must strive towards bringing the site closer into compliance
with current landscaping requirements.
h. In accordance with ECDC 20.13.030.13, Type III landscaping would be required along the
eastern side of the subject site. Type III landscaping is intended to create a visual separation
of uses from streets, and visual separation of compatible uses so as to soften the appearance
of streets, parking areas and building elevations. ECDC 20.13.030.0 requires each area of
Type III landscaping buffering a building to contain evergreen and deciduous trees, with no
more than 50 percent being deciduous, a minimum of six feet in height, and planted at
intervals no greater than 30 feet on center in addition to shrubs, a minimum of three and one-
half feet in height and other plant materials, planted so that the ground will be covered within
three years.
i. The applicant has proposed to remove two existing trees (a plum tree and a black walnut tree)
along the eastern side of the subject site (identified as #9 and #10 in the partial landscape plan
included in Attachment 9). In order to comply with the Type III landscape requirements
along the eastern side of the site, the applicant has proposed planting one Leyland cypress
tree near the approximate center of the eastern property line, which would cause the trees
along this property line to be spaced at approximately 30 feet on center with no more than 50
percent being deciduous. The partial landscape plan in Attachment 9 indicates a second
Leyland cypress tree at the northeastern corner of the site; however, this tree is not required in
order to comply with the minimum spacing requirements. In addition to the one proposed
replacement tree, the applicant has also proposed planting emerald n' gold euonymus along
the northern approximate two thirds of the eastern side of the site. This together with the
existing plantings and the addition of the Leyland cypress near the center of the eastern side
of the site will cause the site to become closer in compliance with the Type III landscape
requirements.
j. Upon staff s inspection of the subject site conducted on July 6, 2017, it was found that the
eastern side of the subject site (21721 80t1i Ave. W) is particularly overgrown. The proposal
should help to clean up the landscaping on this site of the site.
k. In accordance with ECDC 20.13.030.E, Type V landscaping is required within parking areas.
As indicated on the initial landscape plan (Attachment 2), the applicant has proposed
removing two trees two trees located near the southwestern corner of the building adjacent to
the parking area. These two trees compensate for the lack of Type V landscaping at the
subject site. Therefore, although meeting the Type V landscape requirements by providing
landscaping within the parking area itself is not feasible with this project, replacing these two

trees at a one-to-one ratio will not bring the site any further out of compliance with the Type
V landscaping requirements. As requested in the applicant's October 6, 2017 response email
(Attachment 9), these two trees are proposed to be replaced at a one-to-one ratio with
Leyland cypress trees.
1. Minimum sizes and spacing of plants at installation are provided within ECDC 20.13.015.
Evergreen trees must be a minimum height of six feet. Small shrubs must be planted at a
minimum spacing of three feet on center. These requirements have been added within the
conditions of approval.
m. The applicant's October 6, 2017 email (Attachment 9) states that he plans to repair/replace
the existing walkway along the northern side of his property. It shall be noted that a permit is
likely required for the work. The applicant should contact the Building Division with the
scope of work to determine permit requirements prior to commencing such work.
G. Decision
Based on the facts, conclusions, and attachments to this report, staff finds that the design review
for file number PLN20170022 is APPROVED with the following conditions:
a. Individual elements of this project are required to meet all applicable city codes, and it is the
responsibility of the applicant to apply for and obtain all necessary permits.
b. No tree cutting nor modifications to the existing landscaping on the property addressed 21713
80"' Ave. W is approved at this time. The owner/applicant may only remove the four trees
identified for removal on the property addressed 21721 80"' Ave. W.
c. One replacement tree (Leyland cypress or similar) a minimum of six feet in height shall be
planted near the center of the eastern side of the site and emerald n' gold euonymus (or
similar shrub) shall be planted at a minimum spacing of three feet on center along the
northern approximate two thirds of the eastern side of the site as depicted in the partial site
plan in Attachment 9.
d. Two replacement trees (Leyland cypress or similar) a minimum of six feet in height shall be
planted in the general vicinity of the two trees to be removed near the southwestern corner of
the building adjacent to the parking area as depicted in the landscape plan in Attachment 2.
e. The Planning Division must be contacted following the approved landscaping modifications
for an inspection.
f. Trees shall be fell onto private property.
g. Vehicles and equipment shall be located on private property. Should it be necessary to utilize
any portion of the City right-of-way, including the street or sidewalk, to perform any of this
work then the contractor shall apply for and obtain a right-of-way construction permit in
advance of starting work. A traffic control plan will be required as part of the right-of-way
permit application.
h. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden
runoff from leaving the site and/or entering the city storm system.
i. Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk or other
public improvements in City right-of-way per City standards that is caused by or occurs
during the permitted project.
j. Contractor/owner is responsible for locating all on -site utilities and any utilities on
neighboring properties that could be impacted by the tree removal. Relocation/revision/repair
to any utilities may require separate permit.
k. Contractor/owner shall obtain any necessary permit(s) prior to repairing/replacing the

The above listed properties are being heavily damaged as a result of oversized trees accompanied by aggressive
root growth. The access walkway for 21721 borders the property line, and is within a couple of feet of the tree
trunks, with the main building structure within 6 feet. I have already had to dig up the sewer main for repairs
AND had the water main repaired this past summer due the destructive roots. This is also creating a liability
issues for the both of us due to safety concerns, as extensive harm has already been done to the walkway
access the units #A & #B at 21721 (6" elevation cracks) as well as the parking lot for 21721 & 21713 (6"
elevation cracks/broken asphalt on what was a flat surface). I have included photos to help illustrate. These 50'
trees are also killing surrounding shrubs and vegetation resulting from the excessive shade.
I spoke with Kernen Lien about this project and he told me that this would be considered as a single project as
long as I was able to get written permission from the property owner of 12713 80th W (see permission from
Doug Hanson included in application).
I propose to have the trees highlighted in pink removed as identified on the attached plan, and, if required,
replace the trees one for one with something that is within code requirements (ideally evergreen) and to "scale"
for the surroundings/environment. The trees/shrubs highlighted in yellow would remain.

Hi Jen,
In the interest of prioritizing, I would initially like to review the 21721 parcel - Attached is a 1/8" scale drawing of the
impacted (eastern) side of that property. The 2 trees that I am hoping to have removed are not included in the drawing.
To get a better feel for the space, I've already cleaned/removed the overgrown brush and berries in the NE corner
and along the east facing fence. In consideration of city preferences and maintenance, my thought is to go with an
Evergreen theme throughout, as there are plenty of deciduous trees in the area. Please see the attached drawing for
your review.
Regarding the 2 trees adjacent to the parking lot referenced in the initial email, I would like to replace those with
Emerald Green Arborvitaes, 1:1.

I received your revised plans via email on August 31, 2017 for the proposed landscape revision to the
properties addressed 21713 and 21721 80t' Ave. W (File No. PLN20170022). Upon reviewing your
proposal, it was found that additional information/clarification will need to be submitted before review of
your application can continue. Please submit the following items at your earliest convenience so that staff
can continue processing your application:
1. Your email states that you would "initially like to review the 21721 parcel." Please confirm
whether this means that you are no longer proposing to modify any of the landscaping on the
property addressed 21713 as part of this application and that any changes proposed to the
landscaping at 21713 80' Ave. W would be applied for under a separate land use application. Or,
were you implying that you are still working on a revised landscape plan for 21713 and want that
reviewed under this same application?
2. Please confirm which trees are proposed for removal on the property addressed 21721 80t' Ave.
W (your original site plan indicated a few trees along the northern side of this site; however, I
believe all of those trees are located on the property addressed 21713. Please provide a clear site
plan confirming exactly which trees are proposed for removal as part of the subject application.
3. Regarding the proposed landscaping changes to the property addressed 21721 80' Ave. W,
emerald green arborvitae cannot be considered a tree for compliance with the Type III
landscaping requirements along the eastern side of the site nor for the required replacement of the
two trees near the parking area. As such, please revise the proposed landscape plan to be
consistent with the following requirements:
a. The eastern side of this property will need to be shown to comply with the requirements
for Type III landscaping, including trees, shrubs and groundcover meeting the sizes and
spacing identified in the Type III landscaping requirements of ECDC 20.13.030.C. This
includes the need for trees (not arborvitae) to be planted at intervals no greater than 30
feet on center. Additionally, no more than 50% of the trees may be deciduous and the
trees must be a minimum of six feet in height. In keeping with your interest to plant a
columnar -type of tree, possibly a weeping Alaskan cedar (or similar species) may be an
appropriate replacement along the eastern side of the site instead of arborvitae. Since
there is an existing pine tree at the southeastern corner of the site, possibly only one new
tree will be necessary along the eastern side in order to meet the 30' on center
requirement. Please measure and confirm that the proposed replacement tree(s) meet the
30' on center requirement.

b. The two trees that are proposed to be removed near the parking area will need to be
replaced at a 1:1 ratio with either evergreen or deciduous trees, not arborvitae. Again,
possibly a weeping Alaskan cedar (or similar) species would be appropriate. Another
option for a smaller landscaping tree that is often used is a vine maple. Please revise your
plans with a proposed replacement species for the two trees to be removed near the
parking area.
Please keep in mind that a complete response to this information request must be received within 90

Thanks for getting back to me. Below are my responses to the request for additional information.
In response to question #1, as much as I would like to include the trees on 21713 in this application, I am not confident
that I could even get required groundcover and shrubs to grow due to the lack of southern exposure (shading from the 6
ft fence and 2 story building on my property). With that said, I think my safest approach is to prune the neighbors trees
that are encroaching on my property, dig up the sidewalk that runs between the fence and my building, remove any
roots that are currently damaging the sidewalk/foundation on my property and repair as needed.
In response to question #2, I've attached a revised drawing showing the location of the trees that I propose to remove
on my property (#9. & #10.). I've also added the existing trees on 21713 (#11. & #12.). All locations are drawn to scale.
There is roughly a 60' spread between the neighbors deciduous tree (#11.) and the stickered Holly on my property (#9.)
Would planting 1 tree at location #10 suffice? (Your voice message last week left me with the understanding that only
one tree would be required).
In response to question #3, 1 would like to propose using Leyland Cypress as my tree choice for all locations. Would
those meet the city landscaping requirements for this application?

Engineering has reviewed the subject landscape modification application. The information
provided is consistent with Title 18 Edmonds Community Development Code & Engineering
standards.
1) Trees shall be fell onto private property.
2) Vehicles and equipment shall be located on private property. Should it be necessary to
utilize any portion of the City right-of-way, including the street or sidewalk, to
perform any of this work then the contractor shall apply for and obtain a right-of-way
construction permit in advance of starting. A traffic control plan will be required
as part of the right-of-way permit application.
3) Contractor/owner is responsible for keeping all debris on site and preventing any silt
laden runoff from leaving the site and/or entering the city storm system.
4) Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk
or other public improvements in City right-of-way per City standards that is caused by
or occurs during the permitted project.
5) Contractor/owner is responsible for locating all on -site utilities and any utilities on
neighboring properties that could be impacted by the tree removal.
Relocation/revision/repair to any utilities may require separate permit.
