INTRODUCTION The owners are proposing to establish a guest house at 20425 Maplewood Dr. in the Single -Family Residential (RS-12) zone (Attachment 2). An existing accessory structure located near the northeast corner of the property will be demolished and replaced with the guest house. A building permit for the proposed guest house is currently under review through permit BLD20170709. Approval of the guest house use, as defined in 21.35.030 of Edmonds Community Development Code (ECDC), requires compliance with the defined criteria of 21.35.030 ECDC and ECDC Chapters 16.20. Pursuant to ECDC 20.01, a guest house is a Type II decision requiring public notice. B. COMPLIANCE WITH ECDC CHAPTER 16.20 The purposes of the Single -Family Residential zones are to reserve and regulate areas primarily for family living in single-family dwellings and to provide for additional non- residential uses which complement and are compatible with single-family dwelling use. Pursuant to ECDC 16.20.010.D.2, a guest house is an allowed secondary use with a conditional use permit. Based on review of the specific guest house criteria (as described in Section C of this report), staff finds that the proposal is in compliance with the purposes of the single-family zone. C. ANALYSIS 1. Facts: a. This lot is located in the Single -Family Residential (RS-12) zone. b. Guest houses are permitted in Single -Family Residential zones with a Conditional Use Permit by section 16.20.010.D.2 of the Edmonds Community Development Code (ECDC). c. Guest houses are defined in ECDC 21.35.030 as follows: Guest house means a detached structure with not more than two bedrooms, accessory to a single-family dwelling, having no kitchen facilities, used primarily for sleeping quarters, not occupied by paying tenants, and located on a lot of at least 20,000 square feet in area. d. The following paragraphs address how the proposal meets the definition of guest house. 1. A guest house must be a detached structure: The proposed guest house will be detached from the existing single-family residence (Attachment 4). Site development standards for the RS-12 zone such as setbacks, height and structural lot coverage will be verified with BLD20170709. 2. A guest house must have no more than two bedrooms: The building floor plan (Attachment 3) shows no more than 2 bedrooms for the proposed guest house. 3. A guest house must be accessory to a single-family dwelling: An accessory use is defined in ECDC 21.05.020 as follows: "Accessory use means a use incidental and subordinate to the use of the main building on the same lot." The proposed guest house is much smaller in area than the primary use, the existing single-family residence. The proposed footprint of the guest house is 599 square feet, while the existing house is 4,605 square feet. 4. A guest house cannot have kitchen facilities: According to the floor plan provided in Attachment 3, no kitchen facilities are proposed. S. The guest house must be used primarily for sleeping quarters: According to the floor plan provided in Attachment 3, the guest house appears to primarily be used as sleeping quarters. 6. The guest house cannot be occupied by paying tenants: This condition means that the guest house cannot be rented out on a short-term (such as a bed and breakfast) or a long-term basis. 7. A guest house can only be located on a lot with at least 20,000 square feet in area: The subject site has approximately 34,587 square feet and complies with this requirement. Backen Guest House File No. PLN20170032 Page 2 of 4 D. PROCESS This application for a conditional use permit for a guest house was submitted to the City on July 7, 2017, (Attachment 1). The application was determined to be complete on August 4, 2017 (Attachment 5). On August 18, 2017, a "Notice of Application" was issued in accordance with ECDC 20.03. The notice was mailed to property owners within 300 feet of the subject site based on the adjacent property owners list submitted by the applicant. It was posted at the subject site and at the Public Safety Complex, the Development Services Department, and the Public Library. The notice was also published in the Herald Newspaper. The associated public notice documentation is included as Attachment 5. No public comment letters were received. E. TECHNICAL REVIEW The subject application was also reviewed by Snohomish County Fire District #1, the Engineering Division, and the Building Division. • The Fire District did not have any comments on the proposed project (Attachment 6). The Engineering Division noted that review of the subject application is consistent with Title 18 Edmonds Community Development Code & Engineering standards. Compliance with Engineering codes and construction standards are reviewed with the building permit application for development of the site. (Attachment 7). The Building Division did not have comments at this time, however review of the project will be conducted during the building permit process. Additional comments may be provided at that time. (Attachment 8). F. DECISION Based on statements of fact, conclusions, and attachments in this report, the application for a conditional use permit for a guest house at 20425 Maplewood Drive is GRANTED, subject to the following conditions: 1. The Guest House permit is transferable to new owners of the subject property unless there is a violation of the following condition. 2.
