Jared,
Thank you for submitting the revised survey addressing the legal description versus the survey
discrepancies noted in the November 13 and December 19, 2018 comments on the recording
documents for the subject short plat. Now that we have a survey that reflects the legal description, it is
apparent other changes to the preliminary short plat are necessary in order for the subdivision to be
consistent with the zoning regulations.
None of the previous surveys for the short plat indicated the sixteen foot private road access easement
that is noted in the legal description. Pursuant to the definition of lot area in ECDC 21.55.020, lot area
excludes access easements. When the access easement area is excluded from Lot 1, the lot area drops
below 12,000 square as required by the RS-12 zone. Lot 1 must be reconfigured so that it contains at
least 12,000 square feet with the access easement excluded from the gross lot area. Note that the
access easement area must also be excluded from the gross lot area of Lot 2 as well. Given the changes
to the exterior boundaries to conform to the legal description and the additional required changes to
Lot 1, a change to the preliminary plat approval must be processed in accordance with ECDC 20.75.110.
A change to a preliminary plat is a Type II process (staff decision with notice) with an application fee of
$880.
For the change application, please submit the following:
1. Land Use Application Form
2. Adjacent Property Owners List
3. $880 application fee
4. Revised preliminary plat with all the information required by ECDC 20.75.060. Additionally, on
the revised preliminary plat please show the native vegetation area required by ECDC
23.90.040.C.
