INTRODUCTION The purpose of this lot line adjustment is to reposition the line between two developed parcels addressed as 7011 (Lot A) and 7007 (Lot B) Lake Ballinger way (Attachments 1-2). The proposed lot line adjustment would result in the conveyance of approximately 182 gross square feet from Lot B to Lot A. The intent of this adjustment is to make Lot A and the existing house on it, less nonconforming. The following is staff's analysis and decision on the proposal. II. FINDINGS AND CONCLUSIONS A. GENERAL INFORMATION 1. Request: The applicant is proposing to adjust the boundary line between two existing parcels, Lot A (7011 Lake Ballinger Way) and Lot B (7007 Lake Ballinger Way). Lot A and B are both currently developed with a single family residence. 2. Review Process: A lot line adjustment is a Type I decision pursuant to Edmonds Community Development Code (ECDC) 20.01.003. The director or his designee reviews the project and issues an administrative decision pursuant to ECDC 20.75.050.C. 3. Owners: Paul Trieu (7011 Lake Ballinger Way — Lot A) Steven and Kathryn Hinsch (7077 Lake Ballinger Way — Lot B). 4. Applicant: Paul Trieu 5. Tax Parcel Numbers: Lot A —Parcel No. 00488800801100 Lot B — Parcel No. 00488800801200 6. Location: 7011 Lake Ballenger Way (Lot A) and 7007 Lake Ballinger Way (Lot B), Edmonds WA 98026 (Attachment 9) 7. Zonin : RSW-12 zone (Attachment 9). Note: All Edmonds Community Development Code (ECDC) citations can be accessed online at www.edmondswa.gov. 8. Acreage / Square Footage: The lot line adjustment will result in the conveyance of approximately 182 square feet from Lot B to Lot A. 9. Existing Use: Parcels A and B are both currently developed with a single family residence. The surrounding area is currently developed with single family residential uses. 10. Proposed Use: No change at this time. 11. Shoreline Management: The subject property is located within shoreline jurisdiction in the Shoreline Residential III shoreline environment. Since the lot line adjustment is not a development proposal nor a subdivision, the proposal is exempt for the shoreline permitting requirements. 12. Access: Access will remain via separate driveways off of Lake Ballinger Way. 13. Dedications: No dedication of land is required by the City Engineer with the proposal. 14. Improvements: No improvements are required by the City Engineer in association with the proposal. B. SEPA THRESHOLD DETERMINATION Review under the State Environmental Policy Act (SEPA) is not required for lot line adjustments pursuant to WAC 197-11-800 (6)(f) (Land use decisions). C. TECHNICAL COMMITTEE The application materials were reviewed by the City's Engineering Division of the Public Works Department. The Engineering Division did have preliminary comments on the proposal (Attachment 4). Following review of the revised plans (Attachment 5), the Engineering Division requested additional documentation regarding the sewer easement recorded with the City of Mountlake Terrace. On May 22, 2019, Engineering found the proposal to be consistent with Title 18 ECDC and Engineering standards. In a memo dated May 22, 2019 from the Engineering Division the following has been noted; "A sewer easement to Mountlake Terrace on the subject and neighboring parcels is recorded with Snohomish County. The City of Edmonds Utilities Engineer will seek transfer of said easement at a later date." (Attachment 8). D. NEIGHBORHOOD CHARACTERISTICS This site is located in a single-family residential neighborhood in Edmonds. Refer to Attachment 9 for a zoning and vicinity map indicating the zoning of surrounding properties. Majority of the properties within the vicinity of the subject site are developed with single- family residences and are located within the Single -Family Residential RSW-12 zone. E. COMPREHENSIVE PLAN COMPLIANCE The Comprehensive Plan designation for the subject parcels is "Single Family — Resource." There is no proposed change to the existing designation. The current proposal meets the intent of the Comprehensive Plan. F. ZONING CODE COMPLIANCE (ECDC 16.20) 1. Gross: 15,353 sq. ft. 00488800801200 * Pursuant to ECDC 21.55.020, net lot area shall normally exclude any street rights -of -way and access easements. 2. Lot Width: There is no minimum required lot width for the RSW-12 zone. 3. Corner Lot Determination: Neither lot is considered a corner lot. 4. Fla2 Lot Determination: Neither lot is considered a flag lot. 5. Setbacks: The subject properties are located in the Single -Family Residential, RSW-12 zone. Setbacks for the RSW-12 zone are contained in ECDC 16.20.030 and are as follows: Minimum Street Minimum Side Minimum Rear Zone Setback Setback Setback RSW-12 15' 10, 35' The required setbacks for Parcels A and B are a 35 feet from the ordinary high water mark of Lake Ballinger, 10 feet from the east and west property lines and 15 feet from the southern property line. The proposed lot line adjust will make the side setback from the existing house on Lot A less nonconforming. Currently the existing house is 0.15 feet east of the property boundary. Following the lot line adjustment the corner of the existing house on Lot A will be approximate 4 feet west on the new property line. The residence on Lot B will continue to comply with the 10-foot side setback after the lot line adjustment. None of the other setbacks will be impacted by the lot line adjustment. G. ENVIRONMENTAL ASSESSMENT The southern portion subject site slopes downwards generally from south to north. The central and northern portions of the site are relatively level. The subject sites abut Lake Ballinger. The lake itself is considered a wetland and the immediate area landward of the lake is suspected wetland. According to FEMA Flood Insurance Rate Map panel 1315, the northern portion of the site is located within the 100-year flood plain, which qualifies the site as a Frequently Flooded Area. A critical area reconnaissance was conducted for the property located at 7011 Lake Ballinger Way (Lot A) under File No. CRA20170077. The determination found that Lot A contains slopes that qualify as an Erosion Hazard area. According to the City LiDAR data the majority of Lot B located at 7007 Lake Ballinger Way contains the same topography as Lot A. Trieu Lot Line Adjustment File No. PLN20190007 Page 3 of 5 There appears to be no particular topographical consideration driving the lot line adjustment. Therefore, no further critical areas study is required at this time. Further critical areas determination and/or studies may be required at the time of a future development proposal, land use activity, and/or construction on either property. H. LOT LINE ADJUSTMENT COMPLIANCE (ECDC 20.75.050) ECDC 20.75.050.0 states that the lot line adjustment shall be approved unless the proposed adjustment will: 1. Create a new lot, tract, parcel, site, or division; The proposed lot line adjustment will not result in a new lot, tract, parcel, site or division. There are two existing parcels, and the proposal will result in two parcels. 2. Reduce the setbacks of existing structures below the minimum required by code or make existing nonconforming setbacks of existing structures more nonconforming than before; Setbacks have been shown on the proposed plans and the existing structures will not be below the minimum required by code and will not make existing nonconforming setbacks of existing structures more nonconforming than before. 3. Reduce the lot width or lot size below the minimum required for the applicable zone; The proposal will not reduce the lot area nor the lot width of either lot below the minimum required by the zone. 4. Transform a nonbuildable lot, tract, parcel, site or division into a buildable lot, tract, parcel, site or division, - The proposed lot line adjustment will not transform a nonbuildable lot, tract, parcel, site or division into a buildable lot, tract, parcel, site or division. The proposal will not change the existing access to/from the subject parcels and will not alter the existing development of these parcels. The proposal will retain two buildable parcels. 5. Would otherwise result in a lot which is in violation of any requirement of the ECDC. There is no indication that this proposal would result in a lot that is in violation of the Edmonds Community Development Code. III. DECISION Based on the Findings of Fact, Conclusions, and Attachments to this report, the following decision is issued by the City of Edmonds Planning Division. The lot line adjustment, as proposed, is APPROVED with the following conditions: 1. Prior to submitting documents to the Planning Division for "Final Review," please make the following changes: a. Verify that all references to the City's lot line adjustment file use PLN20190007. b. It is the applicant's responsibility to ensure that all documents to be recorded meet the Snohomish County Auditor's requirements for recording. These requirements include, but are not limited to, minimum margin requirements, provision of a County Treasurer tax statement, and all signatures original and in black ink. c. Label the lots on sheet 2 Lot A and Lot B. d. Include the gross and net lot area for Lot A. Trieu Lot Line Adjustment File No. PLN20190007 Page 4 of 5 2. After the above changes have been made, submit revised documents to the Planning Division for final review. 3. Once final approval has been issued from the City, the applicant shall take the documents to the Snohomish County Auditor's Office for recording. 4. After recording the lot line adjustment, the applicant must provide the City of Edmonds Planning Division with TWO (2) copies of the recorded map (with the recording number shown). The City will not consider the lot line adjustment to have been completed until this is done. The applicant must file new deeds for each of the parcels with Snohomish County, as appropriate. The County may not consider the lot line adjustment to have been completed until this is done. IV. APPEALS Type I permit decisions may be appealed by a party of record to Snohomish County superior court within 21 days of the date of the decision pursuant to ECDC 20.07.006. V. NOTICE TO THE COUNTY ASSESSOR The property owner may, as a result of the decision rendered by the staff, request a change in the valuation of the property by the Snohomish County Assessor's Office. May 10, 2019 comments: Per comments from Engineering dated March 21, 2019, please provide confirmation of an easement to City of Edmonds. The easement referenced with the resubmitted documents is to the City of Mountlake Terrace, not the City of Edmonds. Please revise the lot line adjustment documents to include the granting of a 20-foot wide public sewer easement to the City of Edmonds from the western property boundary of the subject parcel to the eastern property boundary of the neighboring parcel, with the sewer main centered within the easement area or provide proof of an existing easement and reference the recording document accordingly. March 21, 2019 comments: City maps indicate a sewer main runs east to west through the subject property. The map below provides an approximate location of the sewer main and actual location should be confirmed on site. I was not able to find confirmation of a sewer easement through the subject properties (7011 & 7007 Lk Ballinger Way).
