Project Description The Church is proposing to remove one fir tree. C. Findings and Conclusions 1. Edmonds Presbyterian Church is located at 22600 9611 Ave. W. The 3+ acre site is zoned Single Family Residential, RS-8. Surrounding properties are zoned similarly but smaller and developed with single family residences. 2. The church site was developed in 1963 and annexed by the City of Edmonds in 1995. Landscaping on the site is dominated by large evergreen trees near the east and west property lines with ornamentals nearer the building. Lawn grass is found across the site. 3. The subject fir tree is near the western property line and is insect -infested and in poor condition. 4. Removal of trees on single-family zoned properties that are subdividable into more than one additional lot requires a permit pursuant to Chapter 18.45 of the Edmonds Community Development Code (ECDC). In this case, the permit is a Type I staff design review of a landscape plan modification done in accordance with the landscaping chapter, ECDC 20.13. Tree replacement is required per ECDC 18.45, which must meet the standards in ECDC 20.13. Type II landscaping, which is intended to create a visual separation between similar uses, would be appropriate along the western property line. According to ECDC 20.13.030.13, Type II landscaping includes: a. Evergreen and deciduous trees, with no more than 30 percent being deciduous, a minimum of six feet in height, and planted at intervals no greater than 20 feet on center; and b. Shrubs, a minimum of three and one-half feet in height and other plant materials, planted so that the ground will be covered within three years. 6. Much of the western property line is densely treed but there is a blank area near the northwest corner of the site where additional landscaping would be appropriate to bring the landscaping along the full length of the property line closer to the Type II standard. 7. The applicant has requested to postpone tree replacement until a later date because a larger church remodel project is being considered. A condition is included to require future replacement. D. Technical Review The Engineering Division reviewed the proposal and recommended several conditions that have been included with the decision. Decision Based on the findings, conclusions and attachments to this report, the design review in file number PLN20190042 is approved with the following conditions: 1. This permit is only for the removal the one fir tree identified on Attachments 3 & 4. Consistent with Section 20.11.050 ECDC (General Design Review), design review decisions are valid for 18 months from the date of the approval with the opportunity for a one-time 12 month extension. If the subject fir is removed as allowed in this approval, replacement trees at a 3:1 ratio must be installed near the northwest corner of the site prior to the expiration of this permit. The applicant must work with staff to determine the appropriate replacement species of vegetation to be consistent with Type II landscaping. If the church applies for a building permit which includes a landscaping plan prepared in accordance with ECDC 20.13 during the time of validity of this permit, this replacement condition shall become void. 3. At installation, replacement vegetation must be consistent with the size and spacing criteria in ECDC 20.13.015. 4. Trees must be fell onto private property. 5. Vehicles and equipment must be located on private property. Should it be necessary to utilize any portion of the City right-of-way, including the street or sidewalk, to perform any of this work then the contractor must apply for and obtain Page 2 of 3 File No. PLN20190042 Administrative Design Review Edmonds Presbyterian Church Landscape Modification a right-of-way construction permit in advance of starting work. A traffic control plan will be required as part of the right-of-way permit application. 6. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 7. Contractor/owner must repair/replace any damaged sections of curb/gutter, sidewalk or other public improvements in City right-of-way per City standards that is caused by or occurs during the permitted project. 8. Contractor/owner is responsible for locating all on -site utilities and any utilities on neighboring properties that could be impacted by the tree removal. Engineering comments G. Appeals Staff design review is a Type I decision which pursuant to ECDC 20.01.003.13 is subject to judicial appeal. Type I decisions may be appealed by a party of record with standing to file a land use petition in Snohomish County superior court. Such petition must be filed within 21 days after issuance of the decision, as provided in Chapter 36.70C RCW. It was inspected by Edmonds Tree Service on Jun 17, 2019 and determined a potential hazard if not removed. I was forwarded a response to Edmonds Tree Service from Michael Clugston of your department. See context below: I got Steve's voicemail message. The Doug fir tree wasn't on that old permit so a new is needed. To make a submittal, we'll need: 1) Completed land use application 2) Cover letter describing the complete scope of work 3) Photo of the tree(s) 4) Updated landscape plan showing the tree(s) to be removed and replacements at 3:1 (could be like for like but any native evergreen trees would enhance the buffer in that location on the site) 5) $285 review fee Mike Attached please find photographs of the subject tree and surrounding area. Edmonds Presbyterian Church is currently working with an architect to make changes to the footprint of the church. The permitting and groundbreaking may be as long as two years from now. We request a deferral of the planting of the replacement trees until we have a better idea of where they would be planted and not be disturbed by construction.
