INTRODUCTION An application was submitted on September 3, 2019 on behalf of Brett and Pamela Gaspers and Colin and Caroline Eccles for a lot line adjustment. The lot line adjustment is between three parcels 00513100010510 (Lot A/Brett and Pamela Gaspers), parcel 00513100010512 (Lot B/Colin and Caroline Eccles), and parcel 00513100010513 (Lot C/ Brett and Pamela Gaspers (Attachment 1-3). The proposed lot line adjustment would remove the overlap of 330 gross square feet between Lot A and B, the conveyance of approximately 5,822 gross square feet from Lot C to Lot A, and the conveyance of approximately 9,623 gross square feet from Lot C to Lot B. The following is staff s analysis and decision on the proposal. II. FINDINGS AND CONCLUSIONS A. GENERAL INFORMATION 1. Request: The applicant is proposing to adjust the boundary line between three existing parcels, Lot A (16623 741 Place West), Lot B (16611 74" Place West), and Lot C (unaddressed). Lots A and B are both currently developed with a single family residence. Lot C is undeveloped. 2. Review Process: A lot line adjustment is a Type I decision pursuant to Edmonds Community Development Code (ECDC) 20.01.003. The director or his designee reviews the project and issues an administrative decision pursuant to ECDC 20.75.050.C. 3. Owners: Brett and Pamela Gaspers (Lots A and C) and Colin and Caroline Eccles (Lot B). 4. Applicant: Brett and Pamela Gaspers and Colin and Caroline Eccles Note: All Edmonds Community Development Code (ECDC) citations can be accessed online at wivrv.edmondsiva.Qov. 5. Location and Tax Parcel Numbers: Lot A — Parcel No. 00513100010510, 16623 74' PI W Lot B — Parcel No. 00513100010512, 16611 74" PI W Lot C — Parcel No. 00513100010513, unaddressed 6. Zoning: RS-20 (Attachment 8). 7. Acreage / Square Footage: The proposed lot line adjustment would remove the overlap of 330 gross square feet between Lot A and B, the conveyance of approximately 5,822 gross square feet from Lot C to Lot A, and the conveyance of approximately 9,623 gross square feet from Lot C to Lot B. 8. Existing Use: Parcels A and B are both currently developed with a single family residence. Parcel C is undeveloped. The surrounding area is currently developed with single family residential uses. 9. Proposed Use: No change at this time. 10. Shoreline Management: The subject parcels are not located within shoreline jurisdiction. Therefore, the proposal is not subject to Shorelines of the State regulations. 11. Access: No change to access at this time. 12. Dedications: No dedication of land is required by the City Engineer with the proposal. 13. Improvements: No improvements are required by the City Engineer in association with the proposal. B. SEPA THRESHOLD DETERMINATION Review under the State Environmental Policy Act (SEPA) is not required for lot line adjustments pursuant to WAC 197-11-800 (6)(f) (Land use decisions). C. TECHNICAL COMMITTEE The application materials were reviewed by the City's Engineering Division of the Public Works Department. The Engineering Division did have preliminary comments on the proposal (Attachment 5). Following review of associated submitted items, the Engineering Division requested additional documentation regarding the sewer easement on Lot C (Attachment 6). On October 15, 2019, Engineering found the proposal to be consistent with Title 18 ECDC and Engineering standards (Attachment 7). D. NEIGHBORHOOD CHARACTERISTICS This site is located in a single-family residential neighborhood in Edmonds. Refer to Attachment 8 for a zoning and vicinity map indicating the zoning of surrounding properties. Majority of the properties within the vicinity of the subject site are developed with single- family residences and are located within the Single -Family Residential RS-20 zone. E. COMPREHENSIVE PLAN COMPLIANCE The Comprehensive Plan designation for the subject parcels is "Single Family Resource." There is no proposed change to the existing designation. The current proposal meets the intent of the Comprehensive Plan. Gaspers/Eccles Lot Line Adjustment File No. PLN20190047 Page 2 of 5 F. ZONING CODE COMPLIANCE (ECDC 16.20) 1. Lot Area: The minimum required net lot area for the RS-20 zone is 20,000 square feet. Gross: 0 sq. ft. 00513100010513 * Pursuant to ECDC 21.55.020, net lot area shall normally exclude any street rights -of -way and access easements. 2. Setbacks: The subject properties are located in the Single -Family Residential, RS-20 zone. Setbacks for the RS-20 zone are contained in ECDC 16.20.030 and are as follows: Zone Min. Lot Area Min. ENVIRONMENTAL ASSESSMENT The easternmost portion of Parcels A and B are relatively flat. Slopes increase on these two parcels, to slopes of 25% to 37%, sloping down from the center of the property to the west. Parcel C has east to west slopes up to 49%. According to USGS soils data, the area is underlain by Alderwood Gravelly sandy loams, 8-15% slopes and Alderwood Gravelly sandy loams, 15 - 25% slopes. There appears to be no particular topographical consideration driving the lot line adjustment. Therefore, no further critical areas study is required at this time. Further critical areas determination and/or studies may be required at the time of a future development proposal, land use activity, and/or construction on either property. LOT LINE ADJUSTMENT COMPLIANCE (ECDC 20.75.050) ECDC 20.75.050.0 states that the lot line adjustment shall be approved unless the proposed adjustment will: 1. Create a new lot, tract, parcel, site, or division; The proposed lot line adjustment will not result in a new lot, tract, parcel, site or division. There are three existing parcels, and the proposal will result in two parcels. 2. Reduce the setbacks of existing structures below the minimum required by code or make existing nonconforming setbacks of existing structures more nonconforming than before; Setbacks have been shown on the proposed plans and the existing structures will not be below the minimum required by code and will not make existing nonconforming setbacks of existing structures more nonconforming than before. 3. Reduce the lot width or lot size below the minimum required for the applicable zone; The proposal will not reduce the lot area nor the lot width of either lot below the minimum required by the zone. 4. Transform a nonbuildable lot, tract, parcel, site or division into a buildable lot, tract, parcel, site or division, - The proposed lot line adjustment will not transform a nonbuildable lot, tract, parcel, site or division into a buildable lot, tract, parcel, site or division. The proposal will not change the existing access to/from the subject parcels and will not alter the existing development of these parcels. The proposal will retain two buildable parcels. 5. Would otherwise result in a lot which is in violation of any requirement of the ECDC. There is no indication that this proposal would result in a lot that is in violation of the Edmonds Community Development Code. III. DECISION Based on the Findings of Fact, Conclusions, and Attachments to this report, the following decision is issued by the City of Edmonds Planning Division. The lot line adjustment, as proposed, is APPROVED with the following conditions: 1. Prior to submitting documents to the Planning Division for "Final Review," please make the following changes: a. Verify that all references to the City's lot line adjustment file use PLN20190047. b. It is the applicant's responsibility to ensure that all documents to be recorded meet the Snohomish County Auditor's requirements for recording. These requirements include, but are not limited to, minimum margin requirements, provision of a County Treasurer tax statement, and all signatures original and in black ink. c. Include the gross and net (if applicable) lot area on Site Plans before recording. 2. After the above changes have been made, submit revised documents to the Planning Division for final review. 3. Once final approval has been issued from the City, the applicant shall take the documents to the Snohomish County Auditor's Office for recording. After recording the lot line adjustment, the applicant must provide the City of Edmonds Planning Division with TWO (2) copies of the recorded map (with the recording number shown). The City will not consider the lot line adjustment to have been completed until this is done. The applicant must file new deeds for each of the parcels with Snohomish County, as appropriate. The County may not consider the lot line adjustment to have been completed until this is done. IV. APPEALS Type I permit decisions may be appealed by a party of record to Snohomish County superior court within 21 days of the date of the decision pursuant to ECDC 20.07.006. V. NOTICE TO THE COUNTY ASSESSOR The property owner may, as a result of the decision rendered by the staff, request a change in the valuation of the property by the Snohomish County Assessor's Office.
