Project Description:
Project is an existing single-family house constructed in 1947. The subject parcel has two existing single-
family houses constructed on it; the subject house is the one to the east/in the middle of the lot, on
158th St. SW. The owners intend to short plat the lot in the near future, but in the meantime would like
to do some foundation repair and add on to the subject house. Based on our survey, the house
encroaches into the 158th St SW Right of way. The owner would like to enclose an existing porch located
on the east side of the house, as well as add a second story over the north half of the house and a new
free-standing garage building to the east of the subject house.
The future short plat will subdivide the parcel into three lots, one for each of the existing houses as well
as a third lot on the east end/uphill. Due to the grade change on the east side of the lot, it is expected
that the eastern most lot will be accessed from 72"d Ave W., and that 158th St. SW will not be extended
further than its current location.
List of Questions:
What are the requirements for an existing house that encroaches into an unimproved Right of
way?
Can a nonconforming structure be added onto if that part of the structure is not within the
setback?
The proposed garage will be built close to the toe of the steep slope. What setback
requirements are there from the toe of a slope to a structure?
