INTRODUCTION The applicant has applied for a noise variance (Attachment 1) for 1 evening to complete work that requires a power outage in the vicinity of 110 Main Street and temporary lane closure on Main Street. The work proposed at this location has been approved under a separate right-of-way construction permit, ENG20180008, but the applicant has requested that work at this specific location be approved during the hours 9:00pm — 3:00am, which is outside the normally approved hours for construction. The following is staff s analysis and decision on the proposal. II. FINDINGS AND CONCLUSIONS A. GENERAL INFORMATION 1. Request: The applicant is requesting a noise variance for work proposed as part of an overhead to underground conversion project. 2. Review Process: A noise variance is a Type I decision pursuant to ECDC 20.01.003. The director or his/her designee reviews the project and issues an administrative decision pursuant to ECDC 20.75.050.C. 3. Project Owners: Snohomish County PUD 4. Applicant: Snohomish County PUD, Debra Lawson 5. Location: In the vicinity of 110 Main Street 6. Activities, Equipment and Factors: Refer to Attachments 1 and 2 Page 1 of 3 B. PUBLIC CONVENIENCE — Will the work result in significant delays for transportation, services, or other customer needs if done only during the day and within the hour restrictions set out in other parts of ECC Chapter 5.30? The proposed work requires a power outage for approximately 2 hours, while work activities will take approximately 6 hours. The outage will effect both residential and commercial properties and according to the applicant, all customers preferred a late night power outage. The proposed lane closures could effect both ferry traffic (along Main Street) and trash haulers (through the alley). Performing the work during the evening would eliminate disruption to this traffic. C. PUBLIC SAFETY —Does working at night significantly improve safety conditions for the traveling public and/or construction workers? As the proposed lane closure is on a ferry route, the closure at night will impact fewer pedestrians and vehicles on this route. The applicant has indicated that night work is common for their Lineman and safety procedures are followed for night work. Proper flagging and traffic control will be in place according to the plan approved by the City under the associated right-of-way construction permit. D. PUBLIC EXPOSURE —What will be the setting for any proposed work outside of regular hours? Is it located on an arterial street or in a mostly residential area? The work will take place in Main Street, along a designated ferry route, and within adjacent alleys. The surrounding properties are predominately commercial with some multi -family. E. PUBLIC COSTS —Does a limited amount of authorized work outside of regular hours established by this chapter save the public significant cost compared to daytime work? As the majority of the customers effected by the power outage are commercial properties, performing the work at night would allow businesses to remain open during normal business hours. F. NOISE REDUCTION MEASURES — Have all reasonable steps been taken to reduce the impact of any necessary noise outside the standard hours? The proposed work will not include construction activities, so the noise will be limited to vehicles, worker communication and the use of tools to perform maintenance. The work on Main Street will require use of a manlift, however, work within the alley which may have a larger impact on residential units will not require use of a manlift. All workers will be on the ground and in close proximity to each other. III. DECISION Based on the Findings of Fact and Conclusions, the following decision is issued by the City of Edmonds Development Services Department. The noise variance, is APPROVED with the following conditions: Page 2 of 3 1. The noise variance is limited to the hours of 9pm-3am. 2. The noise variance is granted for work on a Monday, Tuesday, Wednesday, and/or Thursday nights, except no work shall be performed on a federal holiday. The City shall be notified 24- hrs in advance of work start. 3. Construction activity and associated traffic control shall be performed consistent with separately approved right-of-way construction permit. 4. The grant of a variance shall not relieve any person from the requirements of ECC 5.30.130 relating to public disturbance noises. IV. APPEALS Type I permit decisions may be appealed by a party of record to Snohomish County superior court within 21 days of the date of the decision pursuant to ECDC 20.07.006. V. Sounds originating frorn temporary construction sites as a result of construction activity are exempt from the provisions of this chapter, but only during the hours of 7:00 a.m. to 6:00 p.m. on weekdays and 10:00 a.m. to 6:00 p.m. on Saturdays, excluding Sundays and federal holidays. 5.30.120 Variances. A. Variances may be granted to any person from any requirement of ECC 5.30.040 (maximum permissible sound levels) or 5.30.110 if findings are made that immediate compliance with such requirement cannot be achieved because of special circumstances rendering irnmediate compliance unreasonable in light of economic or physical factors, encroachment upon an existing noise source or because of non -availability of feasible technology or control methods. B. Any such variance or renewal thereof shall be granted only for the minimum time period found to be necessary under the facts and circumstances. C. Variances shall be processed as a Type 1 permit procedure under ECDC 20.01.003.6, while using the criteria found in subsection A of this section. Factors to be balanced in the process include those identified as follows: 1. Public convenience —Will the work result in significant delays for transportation, services, or other customer needs if done only during the day and within the hour restrictions set out in other parts of this chapter? 2. Public Safety — Does working outside of normally allowed significantly improve safety conditions for the traveling public and/or construction workers? 3. Public exposure - What will be the setting for any proposed work outside of regular hours? Is it located on an arterial street or in a mostly residential area? 4. Public cost — Does a limited amount of authorized outside of regular hours established by this chapter save the public significant cost compared to daytime work? 5. Noise reduction measures -- Have all reasonable steps been taken to reduce the impact of any necessary noise outside the standard hours? Answering this question needs to include evaluation of (1) limiting the night time or early morning work to only that necessary to reasonably mitigate the issues identified above, (2) use of quiet generators and quiet pumps (as available), (3) drilling and placing of piles instead of driving them, as well as use of other techniques, design choices, and acoustic control equipment and strategies necessary to minimize the night -lime or early morning impacts from construction noise. D. The grant of a variance shall not relieve any person from the requirements of ECC 5.30.130 relating to public disturbance noises. A Temporary Construction Site is defined as the location of a development -related construction project being performed under a City -issued permit, where required. Procedures: For Private Development -related Projects, applications for a noise variance shall be submitted to the Development Services Department no later than 2 weeks prior to the requested activity, or as otherwise deemed appropriate by the director. An earlier date is strongly recommended because approval could take longer if necessary if information is unclear or missing or the department needs additional time to consider relevant factors. Applications must be accompanied by documentation and rationale sufficient to identify the date(s) and time for which the variance is being requested and to demonstrate compliance with the criteria set forth in the ordinance. The director or designee shall render a determination based on the authority under ECC 5.30.120. Approval or denial shall be in writing. Fees: The fee amount shall be that as established in the current department fee schedule for a Type 1 Staff Decision (currently $285 which includes a technology fee) and is payable upon application. Refunds will not be available once a determination has been made, whether approval or denial. This block is bordered by 1" Street and 2nd Street and Main Street and lames Street. The outage will be approximately 2 hours with total work tirne estimated to be 6 hours. Our vehicles will be set up on Main Street as seen in the traffic plan. Performing work outside of normal hours, during non -peak traffic periods, will create less disruption to traffic patterns. During the work period we will need to block access to the alley. Working outside of normal hours will create less of an inconvenience to residential residents. Businesses will be closed, so no employees or customers will be effected during off -hours This outage will effect both residential and commercial businesses. I have been in contact with all effected parties regarding the upcoming outage. This communication was made either in person, by phone or through email. All customers agreed that a late night outage would create the least amount of inconvenience. Residential residents preferred the outage on a Friday or Saturday night. The commercial businesses prefer an outage no earlier than 9pm. There is one business that stated a preference for Friday night. I have spoken to all property managers of the commercial buildings effected and we will be coordinating notification of the outage when a date is set. Public Safety: Work outside of daylight hours always requires extra precautions for District workers. We have many safety procedure that are followed during night work. This is a common work situation for our Linemen. We will be blocking off all work areas from pedestrian traffic to ensure public safety during the work period. We will use proper flagging and traffic planning procedures. A traffic plan has been submitted to the City of Edmonds for this work. Public Exposure: This work will take place in the Right of Way, either on Main Street as indicated or in the alley off Main Street between 211 Ave N and 1S` Ave N. The work area is mixed use, with predominately commercial, but some multi family. Public Cost: The majority of customers effected by the outage are commercial. They would lose production and sales if the outage was taken during normal business hours. Working at night will save them money. Noise Reduction: This work will not include construction so the noise will come from vehicles, worker communication and the use of tools to perform maintenance. Our trucks will need to be idling to power the manlift and provide lighting. The majority of the work period will be the set up on Main Street which should provide minimal impact to the residential customers. The work in the alley should be under 1 hour and will not require the use of a manlift. All workers will be on the ground and in close proximity to each other. That will be done at a later date. I'm phasing the work on this project to minimize outages and disruptions. Phase 1 work consists of removing the underground cables from pole 358 feeding vault A-3001. Once the underground feed has been removed we will move to vault A-25400 and close the normally open conductors to re -energize A-3001. This is a permanent change to our system and will complete the underground maintenance at this location. Please let me know if you have any questions. Hi Debra, I am processing a noise variance application for PUD and am hoping you can clarify the work being performed under the ROW permit during normal working hours vs work being performed outside of normal working hours with the approval of a noise variance. Both the ROW permit application and noise variance application state no construction activity will be performed and the work is for maintenance only. In looking at the plans and TCP, they state Phase 1 of OH to UG conversion project. A pole has been shown to be removed on the plan, which would constitute construction activity, but maybe this is meant for a later phase? Can you please clarify the work to be performed and which portion of the work is proposed during normal working hours vs. outside normal work hours. Thankyou!
