ReasonableAccommodation-Covenant.pdf Return Recorded Instrument To: City of Edmonds – Clerk’s Office th 121 5 Avenue North, Edmonds WA 98020 REASONABLE ACCOMMODATION COVENANT th Property Address: 8504 198 Street SW, Edmonds Washington Assessor’s Parcel Number: 00558700002400 Legal Description: ROBERT E THOMAS ADD BLK 000 D-00 - LOT 24 RICHARD TAUBER Grantor: Property Owner Grantee: City of Edmonds Related Permit Numbers: STF-2009-16 and BLD-2009-283 This covenant executed this date in favor of the City of Edmonds/Grantee (herein “City”) by the undersigned Owners/Grantor of the within/described real property (owner): WITNESSETH WHEREAS, undersigned is the owner of or has a substantial beneficial interest in the real property addressed in the records of the Edmonds Development Services Department th 8504 198 Street SW As described in legal description (above) and plot plan (file BLD-2009-283); and WHEREAS, the owner has obtained approval of land use and construction permits for the property from the City; and WHEREAS, the Edmonds Community Development Code (ECDC) Chapter 17.05 requires as a condition of the issuance of land use and construction permits that this covenant be signed, acknowledged, and recorded in the records of Snohomish County; NOW, THEREFORE, the owner agrees as follows: 1.Owner will inform his successors and assigns of the property described above that a reasonable accommodation has been granted pursuant to ECDC 17.05.040 to allow the construction of a carport to provide safe and covered access from the driveway to the house. 2.Owner will inform his successors and assigns of the property described above that the carport shown in file BLD-2009-283 is constructed within the required setbacks and causes the total required onsite parking to be reduced from two down to one space. 3.Owner will inform his successors and assigns of the property described above that the reasonable accommodation is personal to the Owner and shall not run with the land. 4.Owner will inform the City Building Official in writing within 30 days of any change in property ownership. 5.Owner shall remove the carport within three months if the carport is no longer required for accessible ingress/egress. In the event that the carport is no longer required for accessible ingress/egress, Owner shall obtain all required demolition permits for the removal of the carport prior to commencing that work. 6.Owner shall obtain a complete building permit for the carport in accordance with all construction codes and ordinances in effect on the date of the application for the building permit. Any and all deficiencies noted during inspection of the carport shall be corrected within 60 days of notification.
