You may not be aware but the City, working in conjunction with the County Building Department, resolved a code violation case against a previous owner who attempted to create two dwelling units on this property. I have included a City letter written to the prior owner that is a good synopsis of the permitting history. The resolution of the enforcement case was that the north building and garage were designated as the single family dwelling unit and the front building nearest the street was designated as storage (note, code required removal of the kitchen so that it could not be classified as a dwelling). With regard to your current business license application .it appears that you are attempting to use the front building nearest the street as an office which is a permitted use in an RS -8 zone, provided that no customers or employees visit the property for the purpose of conducting busihess and that you physically reside at this property during the life of the business. If you intend to have employees or customers visit the business, a Conditional Use Permit (CUP) would be required. Please review the attached handout to make sure you meet all other criteria for administrative review of a home occupation permit. You requested a letter to take with you to Snohomish County so that you would not be directed back to the City of Edmonds. We suggest that you speak directly with Neil Anderson and John Roney regarding your zoning violation and County building permit. On the referenced site you currently have a small older building ("old building") nearest 232nd Street SW which you told us, has been, and is currently being used as a residence. You also have a "new addition" to an existing two -car garage on the north side of the property. This new addition is permitted under County Building permit #97-105649AB as an accessory building, specifically a "garage". You have admitted to us that you are actually constructing this new addition as 'a single family dwelling unit. Snohomish County officials have verified by field inspection that the "new add itiorl' is not a garage but is indeed a dwelling unit. A letter was issued by the County informing you of this zoning and building permit violation. You have stated to us that you do not wish to remove or alter the existing work in order to make the "new addition" comply to the approved garage plan on file with the County. You do understand however,. that by doing so it would enable the County to grant final approval on the garage permit. ' You are also reluctant to obtain a City of Edmonds building permit to convert the front "old building" into a storage shed because you do not wish to displace the tenants currently living in this house. The .City of Edmonds has no authority to revise an active permit in another jurisdiction; therefore, we cannot accept any revision to your County building permit. Parker August 7, 1998 Page 2 The City of Edmonds can accept a building permit application for the "old building" and we have informed you that to solve the zoning problem of two residences on the site we would accept an application to remove the kitchen and toilet facilities from the "old building" in order to convert it into a storage building. Once this conversion permit was issued you would have 180 days to complete the work and call the City Building Inspector for inspection. Once the building is inspected and granted final approval by the City it would be our recommendation to take this permit and inspection report to the County to prove that you no longer have an existing dwelling unit on site. This should resolve the County zoning violation of two dwelling units on one single family site however, the County Inspector may also want to verify this by inspection. We strongly urge you to apply for this permit as a good faith effort to attempt to resolve the zoning violation. Then to resolve the building permit violation, you should make a written request to Mr. Ray Allshouse to revise your garage plans and permit with the County. Mr. Allshouse can inform you what additional information would be required for the County to approve converting the garage into a dwelling unit. Because there will be only. one residence on the property the County will consider accepting your revisions to the accessory building permit to convert it into a dwelling unit. Regarding the mobile home which was removed as a condition of the County accessory building permit, Snohomish County has determined that they cannot grant non -conforming status (per letter from John Roney, dated April 13, 1998). The City of Edmonds also accepts this. determination. Therefore, only one residence is permitted on this lot by either the City or the County. Regardless of which jurisdiction ultimately resolves the zoning violation the end result is the same for you which is -- only one dwelling unit can exist on this site. It is true that the City of Edmonds Council will be discussing accessory dwelling units in the near future for a possible zoning code change. However, until a new ordinance is adopted by the City the current zoning code prohibits two dwelling units on one single family site. Also, the intent of the Planning Board's recommendation, as provided to you on August 6, 1998 appears to be to only allow accessory dwelling units which from the street cannot be distinguished from single-family residences, so it is doubtful that either the "new addition" or the "old building" would be allowed to be considered an accessory dwelling unit. As you may know, the City Council recently passed Ordinance 3300, which allowed an amnesty period for nonconforming and illegal accessory dwelling units to be registered in order to provide for their inspection and to bring those units into conformance with life safety codes. This ordinance created section 17.40.025.0 in the Edmonds Community Development Code regarding illegal Accessory Dwelling Units. This section states "ADU's which were not legal uses at the date constructed may be registered during the registration period set forth in paragraph A. above..." Subsection 2 states "The provisions of Section C shall apply to both attached and detached accessory dwelling units, provided, however, that such ADUs shall be registered and permitted to continue subject to the provisions of this section only if they were constructed in good faith by construction completed prior to December 31, 1999." With regards to the Parkers property, a determination had been made that neither Snohomish County nor City of Edmonds recognized a right for two units to exist on the site (see the attached letter, dated August 7, 1998). The Parkers chose to apply for a building permit (BP#990055) to convert the smaller, older building from use as a residence into storage (see attached). The work to convert the structure to storage was signed off on the building inspector on April 1, 1999, as shown on the back of the building permit. Therefore, an accessory dwelling unit did not exist as of December 31, 1999. The author of the amnesty ordinance was asked if the City Council had intended to allow accessory dwelling units that had been abated to be registered under the amnesty period. The author stated it was an issue to take up with the City Council Community Services Committee. He went on to say that "good faith" was intended to mean a use that was initiated in the belief that it was legal. He also said that the ordinance contemplates a use that exists currently. The abated units don't qualify for both reasons. However, if the committee wanted to they could bring the issue back to City Council for their consideration to allow abated units to be registered. Therefore, because it appears that the unit was initially created in violation of the ordinances and not in good faith, and because the unit did not exist as of December 31, 1999, the City would have to deny an application to register the abated accessory dwelling unit. I might point out that the Parkers have not yet made an application for the accessory dwelling unit under the amnesty program. There is also the issue of our accessory dwelling unit codes requiring the owner to live in either the primary or accessory dwelling unit for at least six months out of the year. I understand that PARKER.DOC ® Incorporated August 11, 1890 Sister City - Hekinan, Japan Mr. Jim Johanson August 17, 2000 Page 2 the Parkers do not currently live at the subject property, but they are considering moving to the property. You have some additional questions in your letter. In response to question number one I am providing a copy of the complaint that was filed. My understanding of the situation is that the structure was issued a stop -work order after a Snohomish County inspector performed a routine inspection and determined that the structure was not being built in conformance with the plans. Your second question deals with why the Parkers do not qualify for a conditional use permit for detached dwellings. The single family residential zone allows conditional uses for guest houses and accessory dwelling units (ECDC 16.20.010.D.2 and 4). A guest house is a detached structure with not more than two bedrooms, having no kitchen facilities, not occupied by paying tenants, and located on a lot of at least 20,000 square feet in area (ECDC 21.35.030). The Parkers do not qualify for this since their lot is only 13,500 square feet, and it would probably not serve their purposes anyway. The accessory dwelling unit that is allowed though the conditional use permit process has to meet the criteria in ECDC 20.21, which include that the single-family appearance and character of the residence shall be maintained. ... Accessory dwelling units must be located within or attached to single-family dwelling units." Using the smaller, older building as a separate unit would not meet this criteria. The only way we currently allow detached structures to be considered accessory dwelling units is through the amnesty program, and as detailed above, the Parkers property does not qualify under that program. Your third question was if a variance was possible and likely, not only for size but for dates as well. I am not sure what the issue of size would be unless it would be to allow a guest house on a smaller lot. I could imagine that the dates variance would be to allow a structure that existed in 1998 instead of 1999. If you review the variance criteria, I think it would be difficult to show how special circumstances relating to the property should allow the Parkers to rent out an outbuilding when none of their neighbors could do the same thing. The same would be true of many of the other criteria. Because variances can be requested for any requirement of the zoning ordinance (ECDC Titles 16 and 17) except use and procedural requirements, it appears that it would be possible to request a variance. However, I cannot think of any rationale that would make variance approval likely. I hope that this answers your questions. My clients and I are still confused as to exactly why the City of Edmonds will not allow an Accessory Dwelling Unit on the property. We are asking you to send us a letter citing the specific reasons why the City is denying the application for an Accessory Dwelling Unit. Additionally, my clients would also like to know the following: F 1. The nature of a complaint that has followed them from Snohomish County; 2. Why they do not qualify for a conditional use permit for detached dwellings; and 3. If a variance is possible and likely, not only for size but for dates as well. After reviewing our permit information file for tax parcel 362703=1-029-0009, it is questionable that a nonconfooning use situation existed allowing two residences on lot addressed as 9515 232nd St, SW prior to the. Edmonds annexation. Our records indicate the property was zoned to 88400 an April 16, 1956, On April 15, 1957, the 88400 scone provisions were amended which restricted single family residential development to one dwelling per (ot. Our records do not reflect when the 10'x55' single wide mobile home was placed on the site. In order to be able to demonstrate that a nonconforming use situation existed permitting two single family dwellings to exist on one lot, it would be necessary for the property owner to document that the two dwellings existed on the site before April 15, 1057. If this could be established, then I believe a nonconforming status would have been recognized by the county. This infourralion, however, has never been submitted to our office. The placement of a mobile home on a lot in Snohomish County did not require a building permit until 1970. A mobile )ionic was required to have a minimum width of eight feel and length of 32 feet_ The 88400 zone was amended to prohibit mobile homes for use as permanent single family dwellings on January 31, 1966. The code: was later amended in the. early '1980's to allow double wide units in the 86400 zone. filenum» «getdate» Page 1 It is my opinion that when the caunty issued the two permits to replace the existing single wide mobile home on the site (permit no. 269172 of 1994 & permit no. 255938 of 1992), that we were under the assumption that the single wide mobile horse was the only dwelling on the lot. The plot pians and permit applications for the proposed double wide mobile home projects never mentioned another existing residence on the site. I have enclosed these applications for your review. If we aware of another residence on the site, the applications should have contained notes reflecting some type of documentation or verification regarding the ability to replace a legally established nonconforming residence. It is my understanding that the condition listed on the most recent permit, 97- 105649AB, requiring the removal of the single wide unit was due to the fact that the plot plan for that project now identifies the structure in the southwest corner of the lot as a dwelling. This information raised a concern as to whether or not the single wide mobile home was legal. Information to establish a nonconforming situation was never presented and permit counter staff then requested that the mobile be removed as a permit condition. According to the permit application file, Mr. Parker acknowledged the condition on the plot plan. If the property were still under the jurisdiction of Snohomish County, the property owner could possibly convert the storage/shop building to a detached accessory apartment provided the proposal complied with the accessory apartment provisions.
