SUMMARY OF PROPOSAL AND PROCESS Prestige Care, Inc. is proposing to construct a new skilled nursing facility to replace their existing facility at 21008 76th Avenue West. The scope of the redevelopment triggered State Environmental Policy Act (SEPA) review; therefore, design review by the Architectural Design Board (ADB) was required (PLN20130076) as is a conditional use permit (CUP) for the nursing facility use (PLN20130075). The design review and conditional use permit review are considered Type III -B decisions under Edmonds Community Development Code (ECDC) 20.01.003 and both permits have been consolidated for review pursuant to ECDC 20.01.002.B. When projects are consolidated like this, the ADB reviews the proposed development without a public hearing and makes a recommendation to the Hearing Examiner, who subsequently holds a public hearing and makes the final decision on the proposal. The Architectural Design Board held a public meeting and reviewed the design of the proposed redevelopment on March 5, 2014. The minutes from that meeting are included as Attachment 10. Much of the background information and analysis regarding code and comprehensive plan compliance was reviewed in the staff report for the Design Board in Attachment 9 —that information will not be duplicated as part of this staff report. This report will focus on the ADB's design recommendation along with analysis of the conditional use permit for the nursing facility use. ADB meeting sign in sheet A "Notice of Public Hearing' was published in the Herald Newspaper, posted at the subject site, as well as the Public Safety Complex, Community Development Department, and the Library on March 13, 2014. Notice of the public hearing was also mailed to property owners within 300 feet of the site (Attachment 11). The City has complied with the noticing provisions of ECDC 20.03. PUBLIC COMMENTS As of the writing of this staff report, only one public comment has been received for either the design review of the redevelopment or the conditional use permit for the skilled nursing facility use. Snohomish County PUD noted that the utility has existing capacity to serve the proposed development but that any upgrades to facilities would be the responsibility of the developer (Attachment 12). Cynthia Ratliff added her name to the sign in sheet at the ADB meeting on March 5 (Attachment 13) and so is considered to be an interested party rather than a party of record until she provides specific comment on the project. V. DESIGN REVIEW — ECDC 20.10 The Architectural Design Board held a public meeting and reviewed the design of the proposed redevelopment on March 5, 2014 and unanimously recommended approval of the project with the following conditions (Attachment 10, page 5): 1. THE TRANSFORMER AND HOTBOX SHOWN AT THE STREET FRONT ALONG 76TH AVENUE WEST SHALL BE BURIED OR RELOCATED TO THE INTERIOR OF THE SITE AND SCREENED WITH VEGETATION. IF AN ALTERNATIVE LOCATION CANNOT BE FOUND AND THE UTILITY COMPANY REQUIRES THE TRANSFORMER OR HOTBOX TO BE AT THE STREET, THE FEATURE SHALL BE SCREENED, PAINTED AND/OR CAMOUFLAGED IN ORDER TO MINIMIZE ITS VISUAL IMPACT. 2. THE APPLICANT SHALL WORK WITH THE PARKS DEPARTMENT AND ENGINEERING DIVISION TO IDENTIFY AN APPROPRIATE STREET TREE FOR THE TYPE IV LANDSCAPING ISLAND ADJACENT TO 76TH AVENUE WEST. 3. THE APPLICANT MUST APPLY FOR AND OBTAIN ALL NECESSARY PERMITS. THIS APPLICATION IS SUBJECT TO THE REQUIREMENTS IN THE EDMONDS COMMUNITY DEVELOPMENT CODE. IT IS UP TO THE APPLICANT TO ENSURE COMPLIANCE WITH THE VARIOUS PROVISIONS CONTAINED IN THESE ORDINANCES. 4. THE COLORS AND MATERIALS WILL BE GENERALLY CONSISTENT WITH THOSE SHOWN IN THE RENDERING PRESENTED AT THE ARCHITECTURAL DESIGN BOARD MEETING (ATTACHMENT 6B OF THE STAFF REPORT). IF THEY ARE FOUND BY STAFF TO NOT BE GENERALLY CONSISTENT, THE MATERIALS WILL BE BROUGHT BEFORE THE BOARD FOR ADDITIONAL REVIEW. With the exception of one change, staff recommends that these conditions be adopted in the Hearing Examiner's decision. In staff's report to the ADB (Attachment 9, Page 19), the first sentence in Condition #1 did not include the phrase "... with vegetation." Requiring the screening be done only "with vegetation" does not provide the developer with the flexibility to screen with alternatives like low walls or fencing in possible Prestige Care Skilled Nursing Facility PLN20130075 & PLN20130076 Page 3 of 6 combination with vegetation. It is suggested that the phrase "with vegetation" be removed from the final condition. The term "skilled nursing facility" is not specifically defined in the Edmonds Community Development Code. However, the use is most similar to a hospital, convalescent home, rest home or sanitarium which are identified as primary uses requiring a conditional use permit in the Residential Multifamily (RM -2.4) zone (ECDC 16.30.010.C.4). The subject site was zoned "Multiple Residential, Low Density" in 1964 when the existing facility was permitted and developed under building permit BLD19640370. The zoning code then defined "nursing, convalescent and rest home, home for the aged, and sanitarium" as primary uses but a conditional use permit was not required at that time. As a result, there is no conditional use permit for the existing facility while one is now required for the use since the site is being completely redeveloped. A. Pursuant to ECDC 20.05.010, a conditional use permit may not be approved unless all of the following findings can be made: A. That the proposed use is consistent with the Comprehensive Plan. Staff feels that the proposal is consistent with the goals and objectives for the "Mixed Use Commercial" designation as well as the design guidance found in the Community Culture and Urban Design Element. Refer to Section G of Attachment 9, pages 4 —12, for a detailed discussion on how this proposal is consistent with the Comprehensive Plan. B. Zoning Ordinance. That the proposed use, and its location, is consistent with the purposes of the zoning ordinance and the purposes of the zoneF district in which the use is to be located, and that the proposed use will meet all applicable requirements of the zoning ordinance. The purposes of the RM zone are identified in ECDC 16.30.000: A. To reserve and regulate areas for a variety of housing types, and a range of greater densities than are available in the single-family residential zone, while still maintaining a residential environment, B. To provide for those additional uses which complement and are compatible with multiple residential uses. A skilled nursing facility, while not a strictly a multiple residential use, does have a short-term residential aspect similar to that of a hospital or convalescent home. A conditional use permit is required for a skilled nursing facility to ensure the more intense nature of the use complements and is compatible with multiple residential uses. Prestige Care Skilled Nursing Facility PLN20130075 & PLN20130076 Page 4 of 6 Refer to Section H in Attachment 9, pages 12 — 18, for a discussion on how the proposal meets the development standards of the RM zone and related zoning requirements. C. Not Detrimental. That the use, as approved or conditionally approved, will not be significantly detrimental to the public health, safety and welfare, and to nearby private property or improvements unless the use is a public necessity. An approved skilled nursing facility use has been at the current location for 50 years. Re-establishing the same use at a modernized site in a more attractive building would not appear to be detrimental to the public health, safety and welfare nor to nearby private property. D. Transferability. The hearing examiner shall determine whether the conditional use permit shall run with the land or shall be personal. If it runs with the land and the hearing examiner finds it in the public interest, the hearing examiner may require that it be recorded in the form of a covenant with the Snohomish County auditor. The Hearing Examiner may also determine whether the conditional use permit may or may not be used by a subsequent user of the same property. The Applicant requested that the conditional use permit run with the land as long as the conditions of approval are still met (Attachment 1). B. Staff feels the proposal is consistent with the conditional use criteria for approval listed ECDC 20.05. Based on the analysis in and the attachments to this report, staff feels the proposal is consistent with the conditional use approval criteria in ECDC 20.05.010 while the design of the site and building are consistent with design standards in ECDC 20.11 and the Urban Design Element in the Comprehensive Plan. Therefore, staff recommends that the Hearing Examiner APPROVE the design review (PLN20130076) and conditional use permit for the skilled nursing facility (PLN20130075) with the following conditions: 1. The transformer and hotbox shown at the street front along 76th Avenue West shall be buried or relocated to the interior of the site and screened. If an alternative location cannot be found and the utility company requires the transformer or hotbox to be at the street, the feature shall be screened, painted and/or camouflaged in order to minimize its visual impact. 2. The Applicant shall work with the Parks Department and Engineering Division to identify an appropriate street tree for the Type IV landscaping island adjacent to 76th Avenue West. This application is subject to the requirements in the Edmonds Community Development Code. It is up to the Applicant to ensure compliance with the various provisions contained in these ordinances. 4. The colors and materials will be generally consistent with those shown in the rendering presented at the Architectural Design Board meeting (Attachment 6b). If they are found by staff to not be generally consistent, the materials will be brought before the Board for additional review. 5. The conditional use permit for the skilled nursing facility (PLN20130075) shall run with the land as long as the conditions of approval continue to be met and the approved design (PLN20130076) and use (PLN20130075) are maintained. Architectural Design review: The proposal satisfies the applicable requirements and standards of the Comprehensive Plan and Edmonds Community Development Code as noted below: A. We are removing a building that is outdated and not visually appealing with a new aesthetically pleasing facility with and nice integration of design to the neighboring community with both residential design feel and nice site landscaping. B. This building improves the physical appearance of the City of Edmonds by bringing in a nice well designed appealing building to the neighboring community. It will enhance the Single Family Residential feel .of Edmonds by utilizing a single. story design; gable roofs, ` exposed wood trusses, stone and an overall Northwest residential feel to the facility and site C' Our design objective include, Rroviding ADA pedestrian access to site. We have limited to (2) vehicle entrances off of 76t W with new ADA vehicle ROW drive entrances. These entrances are existing, but we are making them ADA compliant so it is safer for pedestrians passing by. There will also be a new 7'-0" wide Sidewalk along 76th Ave. W to improve . accessibility for bikes and pedestrians and make the ROW safer. The parking is at the rear of the building and the'residential building fagade main view will be along 76th Ave W and not be obstructed by a parking tot. There will be an open courtyard within the building for patients and patient visitors to help enhance the indoor "outdoor aspects of the site. Pedestrian safety has been taken into account by providing a pedestrian sidewalk that goes directly from 76th Ave W to the main entrance which is very close the ROW sidewalk. There is existing access to buses close by on 76th Ave W. We have met all the site landscape and building setbacks and landscaped the site so that the building feels like part of the neighborhood. Green spaces are provided around the site to break up the parking lot. The main elevation is nicely landscaped in front of the building: Even though this is one larger building the building is broken up with many steps in the building, change in materials, and carefully designed gable roofs to make it feel like it has many separate spaces within the building. The -scale is similar to surrounding residential buildings. There is a nice covered pedestrian and vehicle drop off entrance for both the main facility, and'the PT space within the skilled nursing facility. At both main entrances pedestrians will go from.covered exterior space into an air lock and into the lobby for a nice safe transition to the building. The site is safely illuminated with 8 pole lights and LED down lights that will be shielded so as not to allow lighting to spill off site and affect the neighboring residences. Wall pack down lights will be provided at the perimeter of the building so that the. space will be well lit and secure to maintain the safety of both the skilled nursing facility but also the surrounding residential properties. Signage for the facility will be off of 76th Ave W and this will also be well lit so visitors know where they are going and help to safely direct vehicles to the site. The signage will be designed to direct people to the site but not take over and dominate the site. The signage will not block or obstruct the site from views and feel of the building. The dumpster and generator enclosure will be screened with 6'4' CMU walls. This will help to keep the building the key view of the site and not utilities or less desirable but functionally required aspects of the building., Landscaping buffers and screens will be utilized as well where we border residential uses per the City of Edmonds Municipal code. This will allow privacy especially where the facility abuts the Single Family Residential zone. ` D. Please see the elevations to help depict -how we.are breaking up the building visually with not only jogs and steps but also roof planes and materials. The building is broke_ n up into at ..least (3) different gable roofs elements each side. We are using Cultured Stone, Staggered Fiber Cement Board horizontal siding, Board and Batten Siding, Fiber Cement Board Shingle Siding,. and Composition Laminate Roofing. The different materials will have different colors, stains, and paints to provide more visual interest. The tallest point of the building is 26'-4" at the top of a ridge so this single story facility will not be taller than the residential neighbors which are mostly 2 story residences, condos; or apartments. We have helped to create human scale to the building, through the lower roof planes at the residential wings and the pedestrian friendly covered entrances as you approach and enter the building. The windows are taller at the visitor areas and are a little lower and more private at the resident, wings to help break up the views, of the building. Also some clerestory windows will be used- to bring light into circulation and dining areas that will be beneficial to residents and visitors. F. Gina Janicek 'Cover Letter for ADR and CUP December 11, 2013 Conditional Use Permit: Below is the criteria statement that addresses how the project meets,each of the criteria of ECDC 20.05.010. - Comprehensive Plan. The Comprehensive Plan for this project is Multi -Use -Commercial Plan designation with a plan overlay of Medical/ Highway activity center. The proposal is consistent with the Comprehensive plan as a Skilled Nursing Facility as it is a Medical Care Facility,which ties into the Commercial Plan Designation. It supports surrounding residential uses as well since it is a place to rehabilitate and recover from injuries. The new building/ use is also just replacing an existing use on -the site that is -currently there and has not created any issues within the comprehensive plan. Zoning Ordinance. The'zoning for this site is RM -2.4 Multiple Residential. The purposes of the zone district in which the use is to be located in is to reserve and regulate areas for a variety of housing types, and a range of greater densities than are available in the single- family residential zone, while- still maintaining a residential environment. Also to provide for those additional uses which complement and are compatible with multiple residential uses., This is a skilled nursing facility which will.have (80) beds. This facility is for short term care to help people rehabilitate for 3-4 months so they cari go back to their own residences and - also provides some long term care where people would resided at the facility that need more care. This facility is set up to look and feel like a residential condo or apartment building so the patients feel like they are at home. This use will tie into the residential multi -family feel ofthe surrounding area and -the zoning regulations. This facility also provides greater density per the zoning requirements. The building and use is very compatible and complimentary to the Multiple Residential feel of the neighborhood. The new building that is proposed use will meet all applicable requirements of the Zoning Ordinance. -Not Detrimental. This skilled nursing facility, as approved or conditionally approved, will not be significantly detrimental to the public health safety, and welfare' to nearby private property. This facility is a skilled nursing facility for patient care which is a residential facility for -patients to reside and be taken care of either short term, or longterm care. It feels and looks like a residential condo or apartment complex. The site wilt have safe pedestrian access. The site will be well "lighted to maintain security and safety of the property but at the same time not allow site lighting to negatively impact neighbors. It is also an existing use that will remain the same but within a brand new building. . -Transferability. We are requesting that the Conditional Use Permit shall be transferable with the land as long as the conditions of the approval are still met. We can record notice of this in the form of a covenant with the Snohomish County Auditor if,required by the Hearing Examiner. We feel,. that the Prestige Care, Inc. Skilled Nursing Facility will be a nice addition to the RM -2.4 zone and is compliant with the criteria for this zone. We have strived to design this facility to meet the City of Edmond requirements for Architectural Design Review.and have this facility fitting nicely with in the existing surrounding community. Process: Consolidated Type III -B decision Page 2 of 19 Prestige Care Skilled Nursing Facility PLN20130075 & PLN20130076 Review under the State Environmental Policy Act (SEPA) is required for this project because the proposed project exceeds 4,000 square feet of commercial space and 20 new parking spaces. A SEPA Determination of Nonsignificance was issued on February 11, 2014 (Attachment 3). No appeals of the SEPA determination were received. A "Notice of Application, Public Meeting and SEPA Threshold Determination" was published in the Herald Newspaper, posted at the subject site, as well as the Public Safety Complex, Community Development Department, and the Library on September 16, 2013. Notices were also mailed to property owners within 300 feet of the site. The City has complied with the noticing provisions of ECDC 20.03 (Public Notice). See Attachment 4 for public notice documentation and applicant correspondence. This application was reviewed and evaluated by Fire District #1 as well as the Building and Engineering Divisions (Attachments 5). Each group, in addition to Planning, Public Works and others, will review the associated building permit for compliance with all applicable codes. 1. Topography: The site is basically level. 2. Soils: According to the Soil Survey of Snohomish County Area, Washington, the soils on the site consists of "Alderwood Urban Land Complex, 2 - 8% slopes'. 3. Critical Areas: There are no critical areas on or adjacent to the site according to critical area determination CRA19930288. 4. Wildlife: Wildlife associated with the property is typical of an urban environment including song birds and small mammals. 5. Vegetation: The site has typical urban residential -type landscaping with a couple dozen small -to -medium evergreen and deciduous trees. 6. Shoreline: The subject property is not located within shoreline jurisdiction. North and east of the subject site are multifamily -zoned and developed parcels. To the south, around the intersection of 76th Avenue and 212th are small businesses on parcels zoned Neighborhood Business (BN). Edmonds-Woodway High School is at the southwest corner of the intersection. To the west are single- and multi -family zoned and developed parcels. COMPREHENSIVE PLAN The Comprehensive Plan designation for this site is "Mixed Use Commercial" within the Medical/Highway 99 Activity Center overlay. There is no general or specific guidance for the Mixed Use Commercial designation but the Comprehensive Plan states the following about the Activity Center and includes several goals and objectives applicable to this project: The Medical/Highway 99 activity center is intended to encourage the development of a pedestrian and transit oriented area focused on two master planned developments, Stevens Hospital and Edmonds-Woodway High School, with a related high-intensity development corridor along Highway 99. • Provide for an aesthetically pleasing business and residential community consisting of a mixed use, pedestrian friendly atmosphere of attractively designed and landscaped surroundings and inter -connected development; • To provide a buffer between the high-intensity, high-rise commercial areas along SR 99 and the established neighborhoods and public facilities west of 75th Avenue West, • To provide a pleasant experience for pedestrians and motorists along major streets and in a planned activity center, and provide a gateway along 212th Street SW into the City of Edmonds, • A.1. Provide street trees, buffers, and landscape treatments which encourage and support an attractive mixed use pattern of development characterized by pedestrian walkways and centralized parking. Use these same features, in concert with site and building design, to provide a transition from higher -intensity mixed use development to nearby single family residential areas. • A.5. Support a mix of uses without encroaching into single family neighborhoods. Uses adjoining single family neighborhoods should provide transitions between more intensive uses areas through a combination of building design, landscaping and visual buffering, and pedestrian -scale streetscape design. The proposal is subject to the design standards of the Comprehensive Plan's Urban Design Element. The following analysis relates the project to the goals and objectives for site design, building form, and building facade as identified in the Comprehensive Plan's Urban Design chapter (pages 92-98). C.1. Design Objectives for Vehicular Access. C.1.a. Reduce the numbers of driveways (curb cuts) in order to improve pedestrian, bicycle and auto safety by reducing the number of potential points of conflict. C.1.b. Provide safe routes for disabled people. C.1.c. Improve streetscape character to enhance pedestrian activity in retail/multi-family/ commercial areas. Create adequate parking for each development, but keep the cars from dominating the streetscape. C.2.b. Improve pedestrian access from the street by locating buildings closer to the street and defining the street edge. C.2.c. Improve the project's visibility from the street by placing parking to side and rear. C.2.d. Provide direct pedestrian access from street, sidewalk, and parking. C.2.e. Integrate pedestrian and vehicular access between adjacent developments. Comments: The location and layout of the proposed parking will remain fairly similar to today (Attachments 6a and 6k). However, eight parking spaces that are currently located between the existing building and 76th Avenue West (Attachment 61) will be relocated toward the interior of the site with the other of the parking stalls. A new walking path will provide pedestrians direct access from the sidewalk. New landscaping will prohibit pedestrian and vehicular access between adjacent developments, which is preferred in this case due to the proximity of single- and multi -family residential development. C.3. Design Objectives for Pedestrian Connections Offsite. C.3.a. Design the site access and circulation routes with pedestrians' comfort and ease of access in mind. C.3.b. Create parking lots and building service ways that are efficient and safe for both automobiles and pedestrians. C.3.c. Provide direct and safe access along, through and to driveways and adjacent developments or city streets. C.3.d. Encourage the use of mass transit by providing easy access to pleasant waiting areas. Comments: The design of the pedestrian connections will not change much but will be improved with new paving and materials. The building entry is clearly marked and pedestrians could enter via the parking lot or sidewalk using the entry path. The entry near 76th Avenue West will be covered, which will provide a protected waiting area for people choosing to use public transportation. C.4 Design Objectives for Garage Entry/Door Locations C.4.a Ensure pedestrian safety by allowing cars the space to pull out of a garage without blocking the sidewalk. Comments: Not applicable — no garage or parking structure is proposed. C.S. Design Objectives for Building Entry Location. C.S.a. Create an active, safe and lively street -edge. C.S.b. Create a pedestrian friendly environment. C.S.c. Provide outdoor active spaces at entry to retail/commercial uses. C.S.d. Provide semi-public/private seating area at multi family and commercial entries to increase activity along the street. Comments: There are two main building entries — a covered drop-off area at the southeast corner of the building and the entry on the south fagade to the parking lot (Attachments 6a and 6b). Two secondary entries for loading are proposed on the east fagade of the building. The open timber designs on the main entries create focal points for visitors looking to enter the premises. There is no proposed retail/commercial use so increasing pedestrian activity is not a priority. C.6. Design Objectives for Setbacks. C.6.a. To create and maintain the landscape and site characteristics of each neighborhood area. C.6.b. To create a common street frontage view with enough repetition to tie each site to its neighbor. C.6.c. To provide enough space for wide, comfortable and safer pedestrian routes to encourage travel by foot. C.6.d. To encourage transition areas between public streets and private building entries where a variety of activities and amenities can occur. Comments: Because the parcel is zoned RM -2.4, there is a minimum required 15 -foot setback from the street property line along 76th Avenue West so no buildings nor structures greater than three feet tall may be located in that area. No parking is shown in the setback area but the access drive along 76th is shown to be replaced largely within its existing location (Attachments 6a & 6k). Attachment 6g shows the use of landscaping types called for in ECDC 20.13 (Landscaping Requirements). C.7. Design Objectives for Open Space. C. 7.a. To create green spaces to enhance the visual attributes of the development and encourage outdoor interaction. C.7.b. To provide places for residents and visitors to meet and to interact. Comments: The applicant has proposed to use various forms, materials, textures, colors and patterns in the building design to create a visually appealing project that fits well within the scale and character of Edmonds (Attachments 6b — 6d). The residential appearance of the building will blend in well with the residential areas to the north and west of the site. C.9. Design Objectives for Weather Protection. C.9.a. Provide a covered walkway for pedestrians traveling along public sidewalks in downtown. C.9.b. Protect shoppers and residents from rain or snow. C.9.c. Provide a covered waiting area and walkway for pedestrians entering a building, coming from parking spaces and the public sidewalk in all areas of the City. Comments: The proposed covered entries will provide visitors a safe way to enter and exit the building. There are large eaves along the varied roofline that will also enhance weather protection. Building setbacks are required so there is no covered pedestrian pathway proposed. C.10. Design Objectives for Lighting. C.10.a. Provide adequate illumination in all areas used by automobiles, bicycles and pedestrians, including building entries, walkways, parking areas, circulation areas and other open spaces to ensure a feeling of security. C.10.b. Minimize potential for light to reflect or spill off-site. C.10.c. Create a sense of welcome and activity. C.10.d. Provide adequate lighting forsignage panels. Their location and shielding will result in very low light intensities at the site's boundaries as shown on the photometric drawings in Attachments 6i & 6j while providing adequate illumination within the parking lot and access drives. C.11. Design Objectives for Signage. C.11.a. Protect the streetscape from becoming cluttered. C.11.b. Minimize distraction from the overuse of advertisement elements. C.11.c. Provide clear signage for each distinct property. C.11.d. Use graphics/symbols to reduce the need to have large letters. C.11.e. Minimize potential for view blockage. C.11.f. Comments: No signage has been specifically proposed although it appears a freestanding sign may be envisioned next to the pedestrian entry path by the southeast driveway at 76th Avenue (Attachment 6g). There is an existing, nonconforming sign in that approximate location (Attachment 2). All signage must meet the requirements of the sign code in ECDC 20.60, the locational requirements of the zoning code in ECDC 16.30, and the nonconforming requirements in ECDC 17.40.040. C.12. Design Objectives for Site Utilities, Storage, Trash and Mechanical. C.12.a. Hide unsightly utility boxes, outdoor storage of equipment, supplies, garbage, recycling and composting. C.12.b. Minimize noise and odor. C.12.c. Minimize visual intrusion. C.12.d. Minimize need for access/paving to utility areas Comments: Trash and recycling will be located interior to the site near at the southeast corner of the parking lot (Attachment 6a). The facility will be fenced and screened by landscaping. A transformer and a hot box are shown adjacent to the sidewalk at 76th Avenue. The applicant noted in a response letter to staff on January 14 (part of Attachment 4) that the transformer would be relocated and screened or buried and likewise for the hotbox. A condition will be proposed to require these features to be moved or buried or at least effectively screened or painted should the utility company require them to be in the locations shown on Attachment 6a. Integrate buildings into their site by stepping the mass of the building along steep sloping sites. Comments: The site is flat and the proposed building will replace an existing skilled nursing facility. The use is compatible with the neighborhood (with a conditional use permit) and the site's landscaping will be updated. Beside some medium-sized trees, the existing landscaping at the site is minimal with no other known significant features available for preservation. C.14. Design Objectives for Landscape Buffers. The organization and combinations of window types provide variation in a facade as well as provide light and air to the interior. Small windows are more typically utilitarian in function, such as bathroom or stairway windows, etc. and can be grouped to provide more articulation in the facade. Comments: The many windows proposed on each fagade which will let in light and define the building as more residential than commercial (Attachments 6c & 6d). E.3. Design Objectives for Variation in Facade Materials. The materials that make up the exterior facades of a building also help define the scale and style of the structure and provide variation in the facade to help reduce the bulk of larger buildings. From the foundation to the roof eaves, a variety of building materials can reduce the scale and help define a building's style and allows the design of a building to respond to its context and client's needs. Comments: There is a variety in the fagade materials (Attachments 6b & 6c). A mix of exposed timbers, fiber cement board siding, board and batten siding, cultured stone veneer, fiber cement shingle siding, and cedar trim make up a diverse set of materials. This mix helps reduce the scale of the building. Although the building is only one single story, the roof is varied along each fagade, which helps to further break up the mass of the building. E.4. Design Objectives for Accent Materials/Colors/Trim. Applied ornament, various materials and colors applied to a facade as well as various decorative trim/surrounds provide variation in the scale, style and Page 11 of 19 Prestige Care Skilled Nursing Facility PLN20130075 & PLN20130076 appearance of every building facade. The objective is to encourage new development that provides: ® Compatibility with the surrounding neighborhood. ® Visual interest and variety in building forms. ® Reduces the visual impacts of larger building masses. • Allows identity and individuality of a project within a neighborhood. Comments: Adjacent existing structures are larger in height and scale. The building to the south is a two-story commercial building constructed in 1987 while the building to the north is a large multifamily building constructed in 1968. The existing Prestige Care building was constructed in 1964. As buildings continue to be replaced in this neighborhood, the new Prestige Care building will appear to be compatible with the surrounding neighborhood, which is currently transitioning from a mix of mid-century to new buildings. With conditions, staff feels that the proposal satisfies the referenced goals, policies and objectives of the Comprehensive Plan. 1. Zoning Standards A. The subject property is zoned RM -2.4 (Multi -Family Residential). B. ECDC 16.30.010 — Multi -Family Zone Uses The subject application is for a "Skilled Nursing Facility". The uses most closely associated with a skilled nursing facility identified in.ECDC 16.30.010 are convalescent or rest homes which are primary uses requiring a conditional use permit. The applicant has applied for a conditional use permit under PLN20130075. Design review of the Prestige Care facility has been consolidated with the conditional use permit pursuant to ECDC 20.01.002.B. The ADB will hold a public meeting on the design aspects and make a recommendation to the Hearing Examiner who will issue the final decision on the conditional use and design review. C. Site Development Standards Site development standards for the RM -2.4 zone contained in ECDC 16.30.030.A are summarized in the table below: 1 Roof only may extend five feet above the stated height limit if all portions of the roof above the stated height limit have a slope of four inches in 12 inches or greater. However, the elevation view on Attachment 6c indicates the building will be 24 feet 10 % inches in height. No pitched roofs are proposed above 25 feet. As a result, it appears the proposed structure will be compliant with the height requirements of the RM -2.4 zone. Setbacks: As shown on Attachment 6a, the proposed structure will be located 10 feet from the northern property line (side setback), 15 feet from the western property line (rear setback) and about 35 feet from the eastern property line (street setback). The proposed structure appears to meet the setback requirements of the RM -2.4 zone. Coverage: The subject property is 2.29 acres (99,836 square feet). With a proposed building coverage of about 43,391 square feet, structural lot coverage would be 43.65 percent. As proposed, it appears the new Prestige Care facility will meet the development standards for the RM -2.4 zone; compliance with the development standards will be confirmed during the building permit review process. 2. ECDC 17.50 Off Street Parking Regulations ECDC 17.50.020.A.3 requires one space per three beds for nursing homes. The Prestige Care facility is proposed to have 80 beds. At one space per three beds, 27 parking spaces are required. The site plan (Attachment 6a) indicates 59 parking spaces will be provided. The proposed development appears consistent with the off street parking requirements of ECDC 17.50. 3. ECDC 20.11 General Design Review ECDC 20.11.030 lists the criteria for Building Design and Site Treatment that must be met. A. ECDC 20.11.030.A. Building Design. No one architectural style is required. The building shall be designed to comply with the purposes of this chapter and to avoid conflict with the existing and planned character of the nearby area. All elements cfLbuilding design shall form an integrated development, harmonious in scale, line and mass. The following are included as elements of building design: 1. All exterior building components, including windows, doors, eaves, and parapets; Comments: The proposal uses a variety of exterior elements which contribute to an attractive, residential feel for the building (Attachments 6b & 6c). 2. Colors, which should avoid excessive brilliance or brightness except where that would enhance the character of the area, Comments: No brilliant colors are proposed (Attachment 6b). 3. Mechanical equipment or other utility hardware on the roof, grounds or buildings should be screened from view from the street level, Comments: Rooftop mechanical equipment is proposed to be screened by a parapet (Attachment 6e). A transformer and hot box are shown on Attachment 6a adjacent to 76th Avenue West but these must either be moved, buried, screened or Page 13 of 19 Prestige Care Skilled Nursing Facility PLN20130075 & PLN20130076 painted in order to minimize their visual impact. Trash and recycling facilities are screened and buffered near the southeast corner of the parking lot, interior to the site. 4. Long, massive, unbroken or monotonous buildings shall be avoided in order to comply with the purposes of this chapter and the design objectives of the comprehensive plan. This criterion is meant to describe the entire building. All elements of the design of a building including the massing, building forms, architectural details and finish materials contribute to whether or not a building is found to be long, massive, unbroken or monotonous. Comments: The proposed building is not long, massive, unbroken nor monotonous. A variety of forms, materials, colors and details contribute to an attractive, residential feel for the building (Attachments 6b — 6d). 5. All signs should conform to the general design theme of the development. Comments: No signs have been specifically proposed. All signage must meet the requirements of ECDC 20.60 and should use similar materials to those used throughout the rest of the development. Staff feels the project is consistent with design criteria contained within ECDC 20.11.030.A. B. ECDC 20.11.030.8. Site Treatment. The existing character of the site and the nearby area should be the starting point for the design of the building and all site treatment. The following are elements of site treatment: Grading, vegetation removal and other changes to the site shall be minimized where natural beauty exists. Large cut and fill and impervious surfaces should be avoided. Comments: Because the site is nearly level, grading will be minimal. A number of medium-sized trees will be removed as part of the project but new landscaping will be installed._ Much of the site will be covered with impervious surface (roof, drive aisles, parking lot, etc.) but all stormwater generated from the development will be managed on the site (Attachment 6n). 2. Landscape treatment shall be provided to enhance the building design and other site improvements. Comments: A variety of native trees, shrubs are groundcovers are proposed around the building and within the parking lot which will enhance the building design and other site improvements (Attachment 6g). These areas will be watered by an automatic irrigation system. 3. Landscape treatment shall be provided to buffer the development from surrounding property where conflict may result, such as parking facilities near yard spaces, streets or residential units, and different building heights, design or color. Comments: The proposed landscaping will serve to soften the building facades and access drives while screening the parking lot and trash facilities. Page 14 of 19 Prestige Care Skilled Nursing Facility PLN20130075 & PLN20130076 4. Landscaping that could be damaged by pedestrians or vehicles should be protected by curbing or similar devices. Comments: Vegetation adjacent to the access drives and in the parking lot area will be protected by curbing. 5. Service yards, and other areas where trash or litter may accumulate, shall be screened with planting or fences or walls which are compatible with natural materials. Comments: The trash enclosure at the southeast corner of the parking lot will be fenced and screened with vegetation (Attachments 6a & 6g). 6. All screening should be effective in the winter as well as the summer. Comments: Plantings will consist of evergreen and deciduous trees and shrubs that will provide year-round screening and interest. 7. Materials such as wood, brick, stone and gravel (as opposed to asphalt or concrete) may be substituted for planting in areas unsuitable for plant growth. Comments: The proposed landscape plan does show a 'dry stream bed' extending from the sidewalk to access drive north of the southern drive entrance (Attachment 6g). It is unknown whether this area is unsuitable for plant growth but there is a similar rock feature on the existing site which provides interest (Attachment 2). 8. Exterior lighting shall be the minimum necessary for safety and security. Excessive brightness shall be avoided. All lighting shall be low-rise and directed downward onto the site. Lighting standards and patterns shall be compatible with the overall design theme. Comments: The type and location of the proposed lighting will result in very low intensities at the site boundary but sufficient lighting in the parking and drive aisles (Attachments 6h — 6j). Staff feels the proposal is consistent with design criteria contained within ECDC 20.11.030.13. 4. ECDC 20.13 Landscaping Requirements ECDC 20.13 contains specific landscaping requirements for new developments, which the ADB may alter in accordance with the design review chapter. Landscaping types II, III, IV and V are appropriate for this development. Attachment 6f is a tree survey and retention plan while Attachment 6g is the proposed landscaping plan. A. ECDC 20.13.030.13 describes Type II landscaping as: Type 11 Landscaping. Type 11 landscaping is intended to create a visual separation between similar uses. Evergreen and deciduous trees, with no more than 30 percent being deciduous, a minimum of six feet in height, and planted at intervals no greater than 20 feet on center, and 2. Shrubs, a minimum of three and one-half feet in height and other plant materials, planted so that the ground will be covered within three years. Along the west property line adjacent to the single-family zoned property to the northwest, the applicant is proposing to plant 12 trees at approximately 15 feet on center. 75% percent of the trees are evergreen species (cedar and pine) and three of the trees are deciduous (vine maple). The landscape plan also identifies shrubs and ground cover along this property line. The proposed landscaping appears consistent with the requirements for Type II landscaping. B. ECDC 20.13.030.0 describes Type III landscaping as: Type III landscaping is intended to provide visual separation of uses from streets, and visual separation of compatible uses so as to soften the appearance of streets, parking areas and building elevations. 1. Evergreen and deciduous trees, with no more than 50 percent being deciduous, a minimum of six feet in height, and planted at intervals no greater than 30 feet on center; and 2. If planted to buffer a building elevation, shrubs, a minimum of three and one-half feet in height, and living ground cover planted so that the ground will be covered within three years; or 3. If planted to buffer a parking area, access, or site development other than a building, any of the following alternatives may be used unless otherwise noted: a. Shrubs, a minimum of three and one-half feet in height, and living ground cover must be planted so that the ground will be covered within three years. b. Earth -mounding, an average of three and one-half feet in height, planted with shrubs or living ground cover so that the ground will be covered within three years. This alternative,may not be used in a downtown or waterfront area. c. A combination of earth mounding, opaque fences and shrubs to produce a visual barrier at least three and one-half feet in height. Along the remaining interior lot lines are a proposed mixture of evergreen and deciduous trees planted at approximately 10 feet on center. Less than 50 percent of the trees are deciduous. Shrubs and ground cover are also proposed within the perimeter landscaping. It appears that the proposed landscaping along the northern, southern, and portions of the western property (the portion along RM zoned property) is consistent with the Type III landscaping requirements. Page 16 of 19 Prestige Care Skilled Nursing Facility PLN20130075 & PLN20130076 C. ECDC 20.13.030.D describes Type IV landscaping as: Type IV landscaping is intended to provide visual relief where clear sight is desired to see signage or into adjacent space for safety concerns. 1. Trees shall be deciduous and planted 25 feet on center and the trunk shall be free of branches below six feet in height. 2. Plant materials which will cover the ground within three years, and which will not exceed three and one-half feet in height. Type IV landscaping is primarily provided in an island of landscaping in the center of the property's frontage along 76th Avenue: This landscape island is approximately 24 feet wide at the southern end while narrowing to approximately four feet at the northern end. Two existing spruce trees on the south end will be retained and a dry creek landscape feature expanded to connect to the sidewalk. The applicant has proposed to plant Pyrus calleryana'Chanticleer' (Callery pear) as the tree species on the northern end of the island. This tree species produces a small, round inedible fruit. Given this tree's location adjacent to the sidewalk and the potential maintenance issues with dropped fruit, the applicant should work with the Parks Department and Engineering Division to identify a more appropriate street tree than the Pyrus calleryana 'Chanticleer'. D. ECDC 20.13.030.E describes Type V landscaping as: Type V landscaping is intended to provide visual relief and shade in parking areas. 1. Required Amount. a. If the parking area contains no more than 50 parking spaces, at least 17.5 square feet of landscape development must be provided as described in subsection (E)(2) of this section for each parking stall proposed. b. If the parking area contains more than 99 parking spaces, at least 35 square feet of landscape development must be provided as described in subsection (E)(2) of this section for each parking stall proposed. c. If the parking area contains more than 50 but less than 100 parking spaces, the director — or his designee — shall determine the required amount of landscaping by interpolating between 17.5 and 35 square feet for each parking stall proposed. The area must be landscaped as described in subsection (E)(2) of this section. 2. Design. a. Each area of landscaping must contain at least 150 square feet of area and must be at least four feet in any direction exclusive of vehicle overhang. The area must contain at least one tree a minimum of six feet in height and with a minimum size of one and one-half inches in caliper if deciduous. The remaining ground area must be landscaped with plant materials, decorative mulch or unit pavers. Page 17 of 19 Prestige Care Skilled Nursing Facility PLN20130075 & PLN20130076 b. A landscaped area must be placed at the interior ends of each parking row in a multiple lane parking area. This area must be at least four feet wide and must extend the length of the adjacent parking stall. c. Up to 100 percent of the trees proposed for the parking area may be deciduous. d. Bioswales integrated into parking lot designs are strongly encouraged. e. The minimum area per planter is 64 square feet. f. The maximum area per planter is 1,500 square feet for parking lots greater than 12,000 square feet. Planters shall be spread throughout the parking lot. g. Shade trees are required at the rate of a minimum of one per planter and/or one per 150 square feet of planter. Since 59 parking spaces are proposed, the amount of Type V landscaping must be interpolated and so 20.65 sq. ft. of landscaping per parking space is required (1,218 sq. ft. total). Attachment 6g currently shows 17.5 sq. ft. of landscaping per space (1,033 sq. ft. total). The proposal is shown to provide greater than 1,210 square feet of Type V landscaping. While the proposed Type V landscaping appears to be just shy of the required amount of landscaping, staff feels the provided landscaping meets the intent of the Type V landscaping requirements. As noted in ECDC 20.13.000, the ADB is permitted to interpret and modify the requirements of the landscape chapter. In the end, the parking lot is generally well -screened by the exterior landscaping while landscape islands are provided for the parking spaces in the interior of the site. Staff feels with the proposed recommendations that the proposed landscaping generally consistent with the requirements of ECDC 20.13. No public comments have been received as of the date of this report. fillllivill:11 0 117-1 • Pursuant to ECDC 20.11.020, when recommending approval of proposed development applications, the ADB must find that the proposed development is consistent with the criteria listed in ECDC 20.11.030 (General Design Review), the Comprehensive Plan, and the zoning ordinance. The proposed facility will be approximately 48,000 square feet and located on a site that is zoned Multi -Family (RM -2.4). Surrounding development in the neighborhood includes single- family and multi -family residential development, small commercial businesses, and Edmonds-Woodway High School. The subject site is relatively flat, and there are no critical areas on or adjacent to the site. Ms. Machuga explained that the proposed use requires a conditional -use permit, which has been consolidated with the subject design review application. The ADB will make a recommendation on the design of the project to the Hearing Examiner. The Hearing Examiner will hold a public hearing and issue the final decision on the design of the project, together with the decision on the conditional -use permit. Ms. Machuga reminded the Board that the proposal is subject to the General Design Review Criteria of Edmonds Community Development -Code (ECDC) 20.11, as well as the Urban Design Guidelines of the Comprehensive Plan. She referred the Board to the Staff Report, which includes a detailed analysis of the proposal's compliance with the applicable design standards and guidelines. She specifically noted the following: ® The proposal provides a walking path that directly connects pedestrians to the building from the sidewalk along 76th Avenue West. ® The proposal includes two prominently -designed main building entries. ® The proposal uses a wide variety of forms, materials, textures, colors and building patterns. This includes materials that are more common of Northwest architecture and residential development, such as gables, exposed wood, a stone veneer base with fiberboard siding, and vinyl windows. ® The building will be a single story, which is compatible in scale with surrounding buildings.. ® The roofline will be varied and will include a parapet intended to screen rooftop -mounted mechanical equipment. ® A variety of native trees, shrubs and groundcover will be provided around the building and within the parking area, which will soften the appearance of the building and other site improvements. Ms. Machuga advised that, when reviewing the project for compliance with the applicable design standards, staff's main concern was related to the screening of a transformer and hotbox that are shown on the east side of the site adjacent to the sidewalk at 76h Avenue. The applicant noted in a response letter to staff that the transformer and hotbox could be relocated and/or screened. Staff has included a recommended condition requiring these features to be moved, buried, or at least effectively screened or painted should the utility company require them to be in the loc`dtlons shown on the site plan. Ms. Machuga commented that, based on staff s review, it appears the project will comply with the applicable site development standards of the RM -2.4 zone, as well as the on-site parking requirements. However, this will be verified at the time of the detailed building permit application. Ms. Machuga referred the Board to the Staff Report, which provides an, analysis of the proposal's compliance with the applicable landscaping requirements of ECDC 20.13. The proposal was found to comply with the required landscaping types with two exceptions: ® The proposed Chanticleer trees adjacent to 76th Avenue West produce a small round fruit, which would not be desirable adjacent to the right-of-way. As such, a recommended condition of approval was added requiring the applicant to work with the Parks Department and Engineering Division to identify an appropriate tree to be planted in this location. The proposal provides slightly under the minimum amount of Type V landscaping required within the parking area. However, staff feels that the proposed landscaping would still meet the intent of the Type V landscaping Architectural Design Board Meeting Minutes of Regular Meeting March 5, 2014 Page 2 of 5 requirements. She reminded the Board that, pursuant to ECDC 20.13.000, they may interpret and modify the requirements of the landscape chapter to allow this slight reduction. Ms. Machuga reported that a State Environmental Policy Act (SEPA) Determination of Non -Significance (DNS) was issued on the proposal on February 1141, and no appeals were received. No public comments have been received to date regarding the subject proposal, aside from a letter from Snohomish County Public Utility District (PUD) stating that the district presently has sufficient electric system capacity to serve the proposed development, but the facilities may require some upgrades. In conclusion, Ms. Machuga recommended the Board recommend approval to the Hearing Examiner of the proposed Prestige Care skilled nursing facility with the three conditions outlined in the Staff Report to address the location of the transformer and hotbox and the appropriate type of street tree, as well as clarify that the applicant must apply for and obtain all necessary permits and meet the requirements outlined in the ECDC. Board Member Schaefer asked if the applicant is proposing any signs as part of the application. Ms. Machuga answered that no sign designs have been presented for this design review. A separate application would be required for any signs located on the site, and the signs would be subject to the Design Review Criteria and applicable sign code requirements. Board Member Schaefer asked if the applicant provided material and color samples. Ms. Machuga answered that no color or materials boards were provided, but Attachment 6b of the Staff Report illustrates the applicant's basic intent. Chair Gootee asked if staff has had any dialogue with the applicant regarding the need to relocate the hotbox and transformer. Ms. Machuga said Mr. Clugston spoke with the applicant about this concern, and the applicant submitted a letter indicating a willingness to meet the additional condition recommended by staff. Peter Carletti, Carletti Architects, P.S., Mount Vernon, WA, said he was present to represent the applicant. He explained that the delivery of skilled nursing care has changed significantly since the existing building was constructed. The existing building is 32,000 square feet and has 89 beds. The new facility will be roughly 48,000 square feet and provide 80 beds. He explained that more space is required per bed to meet the requirements set forth by the Department of Health for size of open space, dining areas, bathrooms, etc. In addition to the new size requirements, Prestige Care is also looking at how it can consolidate the building to perform better for future clients. They originally considered opportunities to remodel the existing facility, and they met with City staff to discuss ideas and options. After learning that significant changes would require the facility to be upgraded to meet all current City code,requirements, including those for stormwater and utilities, it was determined that the best approach was to demolish the existing building and start over. Mr. Carletti observed that the existing building looks very dated and has outlived its useful life. The neighborhood is in transition, with new medical and commercial uses being created. However, there are also residential uses in the vicinity, and the proposal represents an attempt to pay particular attention to the residential character of the area. While the existing building is designed to be a long-term, skilled nursing facility, the new facility would be designed primarily for short-term stays for rehabilitation. Mr. Carletti displayed a colored rendering of the proposed project to illustrate the types .of materials and colors the applicant is proposing to use. He advised that the applicant is proposing to use a composition shingle roof that is black with some grey and brown tones mixed in and vinyl windows. The proposal includes Hardi Plank siding and shingles that will be placed straight rather than staggered, and cedar trim at the comers and windows. There will be exposed wood trusses with bracketing at the primary entrances, as well as a wainscot veneer of cultured stone. A parapet cap would be used to screen.all rooftop equipment from view. Mr. Carletti referred the Board to the preliminary landscape plan (Attachment 6g) and the inventory of existing trees. He advised that they have done their best to retain as many existing trees as possible. He also referred to the photometric Architectural Design Board Meeting Minutes of Regular Meeting March 5, 2014 Page 3 of 5 plan (Attachment 6h), which meets or exceeds the City's code requirements and would result in very little impact to adjacent properties. Board Member Schaefer asked if the roof gables would extend out beyond the wall in all locations. Mr. Carletti answered that there would be at least a two -foot overhang all the way around the building. The Board expressed concern that the application does not specifically call out the colors that will be used on the new building. Mr. Carletti noted that this was not a requirement of the application, but he summarized that the applicant. anticipates using standard Northwest earth tone colors (i.e. grey, beige and brown), with an accent of red similar to terracotta in color. They will avoid using white trim, which is difficult to maintain on cedar. He suggested that if the Board is concerned about color, they could require the applicant to submit sample materials and colors as a condition of final approval. Rather than requiring the applicant to come back to the ADB with color samples, Ms. Machuga suggested the Board add a condition that stipulates the colors should be Northwest earth tones of beige, and grays, with a red accent color. If the applicant's final submittal is inconsistent with these colors, additional ADB review would be required. Chair Gootee asked how the applicant plans to address staffs concerns about'the hotbox and transformer. Mr. Carletti reported that in recent discussions with the applicant's electrical engineer, it was agreed that the transformer would be moved further back on the site and screened. Paul Rasmussen, Senior Project Manager, Prestige Care, Inc., Vancouver, WA, reported that he met with representatives from Snohomish County PUD earlier in the day. While they do not support putting the transformer in a vault, they agreed that it could be moved closer to the building and screened. They specifically discussed locating the transformer near the the northeast comer of the building. The generator would be located near the southeast corner and screened. Mr. Rasmussen acknowledged that the generator would create noise, but he pointed out that it would only be used as a back up during power outages. Monthly testing of the equipment could take place on weekdays during normal business hours to minimize impacts to adjacent properties. Vice Chair Guenther pointed out that landscaping and fencing could be used to muffle the noise. Board Member Schaefer pointed out that the south side of the subject property would be raised about two feet, which could have an impact on adjacent properties if car lights from the parking area shine in that direction. He suggested the applicant provide denser vegetation in this location to mitigate potential impacts. Ms. Machuga noted that the landscape plan (Attachment 6g) identifies more vegetation in this area than what is called out in the siteeplan. As proposed, the applicant would provide Type III landscaping in this location, which includes a combination ofshrubs and trees. Board Member Schaefer agreed that would be adequate to address his concern. Board Member Schaefer said the applicant's description of the facility helps him understand why a larger number of parking spaces are needed. Mr. Carletti clarified that the new facility would be different than a standard nursing home that provides long-term care to clients. Because the new facility's clients would be short-term patients, it is anticipated that more visitors will come to the site. Board Member Schaefer asked how many of the parking spaces would be utilized by staff. Mr. Rasmussen answered that there would be approximately 25 employees per shift, but there will be some overlap during shift changes. He emphasized that adequate parking will be important for the type of clientele the new facility will serve. There will be 28 beds in private rooms and 46 beds in semi private rooms. There will also be three rooms (2 beds each) set up for bariatric care, which Edmonds Swedish Hospital has specifically requested. While the Board indicated support for the proposed project, they also expressed concern about the lack of clarity regarding the colors that would be used for the building materials. They liked the colors shown on Attachment 6b, but noted that the applicant has not made a final decision about what the colors would be. They agreed it would be appropriate to add a condition that provides guidance to staff to ensure the colors are consistent with the Board's intent without requiring additional Board review.
