S-09-04 Dear Mr. Smith, GARY HAAKENSON MAYOR While the above application was determined to be technically complete on January 12, some additional clarification is needed on several items before we can complete our review. Enclosed you will find separate letters from the Building and Engineering Divisions describing their concerns. Planning has identified the following issues: 1. Please indicate the top and toe of any retaining walls shown within property line setback areas on Lots I and 2. Retaining walls may not be above three feet and be located in a required setback according to ECDC 21.90.150, Structure, "Structure means a combination of materials constructed and erected permanently on the ground or attached to something having a permanent location on the ground. Not included are residential fences less than six feet in height, retaining walls, rockeries, and similar improvements of a minor character less than three feet in height." 2. Please show the extent of the existing wood fence in the middle of Lot 2 and all other fencing on both parcels and indicate the heights of those features. 3. Please indicate the extent of setback encroachment of the steps off the south side of the house on Lot 1. According to ECDC 16.20.040.C, Porches and Decks, "Uncovered and unenclosed porches, steps, patios, and decks may project into a required setback not more than one-third of the required setback, or four feet, whichever is less; provided, that they are no more than 30 inches above ground level at any point." 4. As a point of reference, the compost shed located on Lot 2 will have to be removed or moved to comply with the setback requirements for the lot.
