Subject: REQUEST FOR ADDITIONAL INFORMATION FOR YOUR
ACCESSORY DWELLING UNIT (ADU) APPLICATION LOCATED AT
22027 — 961h Ave W. FILE NO. PLN20190046
Mr. Groset,
Staff has reviewed the application material regarding the Conditional Use Permit (CUP) for an
ADU located at 22027 961h Ave. W. During staff s continued review of your application, it has
been determined that additional information/clarification is necessary. Please provide responses
to the following items at your earliest convenience so that staffs review of the proposal may
continue:
1. Number of Units: Per ECDC 20.21.030.13 no more than one ADU is permitted for the
subject site. The current proposed plans appear to contain multiple dwelling units which
is not consistent with ECDC 20.21.030. The second floor contains living space which
includes 2 bedrooms, full bath, stacked washer and dryer along with dishwasher, fridge
and full-size kitchen sink with a separate access door off the main floor. The second floor
also contains the proposed ADU. The main floor contains bedrooms, full bath, full-size
kitchen sink, fridge, dishwasher, cooktop, and a washer and dryer along with a separate
entry from the main porch. In addition, the proposed detached garage contains a full bath
along with two rooms labeled as office spaces.
Per ECDC 20.21.030.13 staff is unable to approve more than one ADU, please revise the
plans so that it is clear that only one independent living space is proposed and one ADU
is proposed.
2. Short Plat: Per our records a final short plat has not yet been submitted for the
preliminary approved two (2) lot short plat. The proposed single family dwelling,
detached garage and ADU may not be issued for the subject property until a final short
plat has been submitted to the City for review and approval.
3. Property owner documentation: Per ECDC 20.21.0301, either the primary dwelling or
the accessory dwelling unit shall be owner -occupied. "Owner -occupied" shall mean a
property owner who makes his or her legal residence at the site, as evidenced by voter
registration, vehicle registration, or similar means, and resides at the site more than six
months out of any given year, and at no time receives rent for the owner -occupied unit.
Currently you do not own the property, please see comment #3 above regarding the final
short plat. Updated ownership documentation will be required prior to ADU approval.
Please submit the above information to the Planning Division as soon as possible so that staff
may continue processing your application. According to ECDC 20.02.003.D the above
requested information must be submitted within 90 days (or by January 6, 2020) or the
application will expire.
