SUBJECT: Reasonable Accommodation Request, File # STF20120016
Dear Ms. Barnes:
Thank you for submitting an application for a reasonable accommodation request, pursuant to
st
ECDC Chapter 17.05,for a carport to be located within the street setback at 9520 231 Place
SW in the Single-Family Residential (RS-8) zone. I am the Planner assigned to your project and I
have reviewed your application on behalf of the Planning Division. I do have a few questions
and comments to make before I can issue a decision.
1.Land Use Application Form: Please fill out, sign, and turn in the attached land use
application form. This is a generic form that begins every land use application process. I
started to fill out a portion of it for you, but please sign and complete the rest to the best of
your ability.
2.Exact Request:The RS-8 zone has a required 25’ street setback and a 7.5’ side setback and
the maximum height of accessory structures is 15’. Please indicate how you are (or are not)
meeting these requirements. For example, is your reasonable accommodation request for
the front street setback only? Or, are you also requesting a side setback and a height
accommodation – and why? The site plan that you submitted does not have any
dimensions on it so I was unable to determine the exact request you are seeking. I know
that you would like to keep the carport that was erected, however, I need to know what
specific exemptions to the code you are seeking.
3.Building Permit: One of the requirements is that you follow through withobtaining your
building permit for the carport structure. The building department will need to check to
make sure the structure is safe and meets their various codes and requirements. The
engineering division will also review your application, as well as myself on behalf of the
planning division. Please contact a Permit Coordinator at 425.771.0220 if you have any
questions about this required process. I’m enclosing an application form and the handout
on how to apply for an accessory structure permit.
4.Critical Areas Determination: Because we’ve never issued a “critical areas determination”
for your property, we’ll need to have this determination on file at (or prior to) your building
permit submittal. This critical areas permit process is for all properties in Edmonds and one
day we’ll have a determination for every parcel. Because the determination runs with the
property, there is only a one-time fee (currently $155). Please enclose a check payable to
the “City of Edmonds” (we also accept Visa, MasterCard, and cash at our Development
Services counter) as well as a completed and signed critical areas determination form.
Planning staff will go out to your property within two weeks of submittal and determine if
there are any critical areas (steep slopes, wetlands, and streams) on or adjacent to your
property. The purpose of this process is to “flag” parcels in our database that DO have
critical areas so that we can determine if buffers or studies (like biologist reports or
geotechnical reports) would be required based on the scope of work proposed. Luckily, I
don’t see any critical areas on your site in any of our maps, but we do need to go out and do
an official inspection and make an official determination, which is triggered by the
requirement for a building permit application for the carport structure.
5.Reasonable Accommodation Covenant: Once I have all of the information that I need to
make a decision, a covenant will need to be filed at the County Auditor’s office. Either I can
record the covenant for you (the City Clerk’s office will require a $20 administrative fee to
be added to the County’s recording feeof $72), or you can recorded it at the County
yourself and return a copy to me–whichever you prefer. If you have questions about
where to find a notary public, please contact me. I will begin drafting the covenant once I
receive the above additional information.
