Dear Fred,
I received your letter of September 21, 2009, regarding the proposed encroachments into the
setback as part of building permit BLD -2009-0506. I appreciate your position; however, I must
enforce the code as it is written. The Edmonds Community Development Code is clear on how
decks and porches may project into a required setback in a single family zone. According to
ECDC 16.20.040.C:
Porches and Decks. Uncovered and unenclosed porches, steps, patios, and decks may
project into a required setback not more than one-third of the required setback, or four
feet, whichever is less; provided, that they are no more than 30 inches above ground
level at any point.
As you have noted, the key difference between the Edmonds code and those examples which you
have provided for reference is that both "uncovered and unenclosed" structures are regulated in
the Edmonds code as opposed to simply "uncovered" structures.
