FOR CLASSICO HOMES SHORT PLAT, FILE NO. S-2004-113
Dear Mr. Schmaus:
The Engineering and Planning Divisions have reviewed the above draft recording documents, and it
was found that the following information, corrections, or clarifications will need to be addressed
before review can continue:
1.Final short plat review requires a title report prepared within 30 days of submittal. The title
report that was submitted has an effective date of January 12, 2009, which was last year. I am
not sure if the year was a typo or if it was an old report. Please contact your title company to
either provide an updated title report or to provide evidence that the date on the report
submitted had a typo and that it was actually prepared on January 12, 2010.
2.Exception #5 of the title report states “An inspection of the subject property is being made to
determine potential lien rights and survey requirements, if any, and other extended coverage
matters with a supplemental report to follow.” Please provide a copy of this supplemental
report.
3.On Sheet 1, the second two paragraphs under the “Dedication” heading (both starting with
“Further, the undersigned owners of the land…”) can be removed since these two paragraphs
effectively provide the same statements as the hold harmless agreement.
4.The names for the owner signatures on Sheet 1 should be the same as those listed on the title
report. Therefore, correct the spelling of “Schmans” to “Schmaus” and change “Joe” to
“Joseph”. This should be corrected on the signature line under the “Dedication” heading as
well as within the notary’s block in the “Acknowledgements” section.
5.On Sheet 1, under the “Acknowledgements” section, correct the second notary block for Karen
Fiorito to state “…she signed the instruments and acknowledged it to be her free…” (the
corrected words are underlined).
6.On Sheet 1, under the “Approvals” heading, add space for the date by correcting both approval
statements as follows: “This _____ day of ________________, 2010.”
7.On Sheet 1, relocate the “Utility Easement Provisions” section to be just above the “Storm
Detention System and Utilities Easement” section, and move the “Maintenance Agreement”
section below the “Ingress, Egress and Utilities Easement” section so that the recording
documents have all of the easement provisions listed in one place first and then the
maintenance provisions listed just after the easement provisions.
8.On Sheet 1, under the “Storm Detention System and Utilities Easement” heading, correct the
easement description to state that the easement is also for water, and correct the description to
state that the easement is on the southerly 20’ of Lot 1 (as shown on the approved civils).
9.On Sheet 1, under the “Ingress, Egress and Utilities Easement” heading, correct the easement
to be along the southerly 20’ of Lot 1. Also, remove the word “that” from the description as
follows: “under and across that the southerly 20 feet of Lot 1.”
10.On Sheet 1, near the sections for the other easement provisions, add easement provisions for an
easement to PUD for the power to Lot 2. It appears that this easement will fall outside of the
20’ access and utility easement, so an additional easement will need to be provided.
11.On Sheet 1, under the “Maintenance Agreement” heading, provide maintenance provisions for
the sanitary sewer and water service lines running within the easement.
12.On Sheet 1, add a section titled “Conditions” and include the following two conditions:
a.“Conditions of approval must be met and can be found in the final approval for the
short subdivision located in File No. S-2004-113 in the City of Edmonds Planning
Division.” This statement can be removed from Sheet 2 where it is currently located.
b.“Owner(s) of Lots 1 and 2 shall monitor and maintain proper erosion control on all
slopes prior to, during, and after all construction consistent with the geotechnical
report by Associated Earth Sciences dated January 15, 2010.”
13.The title report indicates that the site contains an existing PUD easement (AFN
#200911190453). This easement must be shown on the recording documents.
14.Five trees are shown on the adjacent property to the south on the map on Sheet 2. Since these
trees are not located on the subject site, they do not need to be shown on the recording
documents. Thus, please remove the trees from the map and remove the “Tree Descriptions”
section just under the map on Sheet 2.
15.On Sheet 2, correct the access and utility easement on the southern portion of Lot 1 to be 20’ in
width instead of 15’ as shown on the approved civils.
16.Correct the net area of Lot 1 shown on Sheet 2 from 6,300 s.f. to 6,000 s.f. to reflect the
correction of the width of the access easement from 15’ to 20’.
17.The approved civils show a PUD utility trench running just north of the 20’ access and utility
easement on Lot 1. Please provide an easement for PUD on the map on Sheet 2 and include a
description and maintenance provisions under the appropriate headings on Sheet 1.
18.On Sheet 2, change the heading “Legal Description” to “Original Legal Description”.
19.On Sheet 2, please use a different line type to represent the western boundary of the 20’ storm
detention and utilities easement running along the eastern side of Lot 1. Since the line type that
is currently used is the same as the line type for the right-of-way to the north, it looks like the
easement extends off of the subject site. A change to the line type for the easement will help to
make the boundaries of the easement clearer and to separate the boundaries of the easement
from the boundaries of the right-of-way.
20.The utility lines shown within the right-of-way on Sheet 2 are incorrectly located. These utility
lines are not required to be shown on the recording documents, so you may either remove the
utility lines shown within the right-of-way or correct the lines so that they are accurate.
21.The width of the right-of-way adjacent to the subject site scales out at 60’; however, city
records indicate a 40’ right-of-way. Please verify the right-of-way width and revise the map on
Sheet 2 as necessary.
22.Note that all signatures and notary blocks on the final recording document must be made in
black ink.
