S-2004-113 Dear Mr. Schmaus: The Engineering and Planning Divisions have reviewed your updated draft recording documents. It is recommended the recording documents be revised consistent with the comments below in an effort to further clarify easement and utility ownership and maintenance. 1.The first paragraph of the “Maintenance Agreement” section states, “Maintenance of any private storm detention system constructed or installed upon or within the above easement…” In order to clarify which of the “above” easements this maintenance provision is referring to, please update the first sentence to state “Maintenance of any private storm detention system constructed or installed upon or within the storm detention easement…”. 2.The second paragraph of the “Maintenance Agreement” states “Maintenance of the sanitary sewer and water service lines constructed or installed upon or within the above easement…” In order to clarify which of the above easements this maintenance provision is referring to, this paragraph should be updated to be more specific. Also, this paragraph should be more specific in stating which utilities within each easement each lot is responsible for the maintenance of. One way to re-word the second paragraph to accomplish this would be as follows: “Sewer for Lot 1 is located within the storm detention system and utilities easement along the easterly 20’ of Lot 1. Maintenance and costs of said maintenance or reconstruction shall be the responsibility of the present and future owners of Lot 1, their heirs, successors and assigns. Water and sewer for Lot 2 is located within the ingress, egress and utilities easement along the southerly 20’ of Lot 1. Maintenance and costs of said maintenance or reconstruction shall be the responsibility of the present and future owners of Lot 2, their heirs, successors and assigns.” In addition, you may choose to add general maintenance language such as “Maintenance, repair and/or reconstruction of any and all other utilities not specifically identified above and located within the storm detention system and utilities easement or the ingress, egress and utilities easement and the costs associated with said maintenance, repair and/or reconstruction shall be borne jointly and equally by the owners of Lots 1 and 2, except no owners shall be responsible for said maintenance, repair, and/or reconstruction of that portion of the commonly used utility system located upstream from the point of connection of that respective lot owner.” 3.Note that all signatures and notary blocks on the final recording document must be made in black ink. Please update your recording documents as you see fit and submit the updated copies to a Planner, Monday through Friday between 8:00am and 4:30pm.
