FOR KGJST LLC SHORT PLAT, FILE NO. S-2006-137
Dear Mr. McKee and Mr. Clark:
The Engineering Division and I have reviewed the above draft recording documents, and it
was found that the following information, corrections, or clarifications will need to be
addressed before review can continue:
1.Correct the file numbers on the top of Page 1 and in the first item under the “Conditions
of Approval” heading from S-2006-115 to S-2006-137.
2.It appears that Shawn’s name is spelt incorrectly on the recording documents. It is spelt
as “Shaun” under the “Declaration” heading as well as within the first notary block.
3.I understand that both of you are the only ones who will be signing the documents for
recording. If this is correct, please remove the third signature line under the
“Declaration” heading. If a third individual will be signing, please describe and add a
third notary block. Additionally, since you have listed Shawn Clark’s name under the
first signature line, you may wish to list David McKee’s name under the second
signature line.
4.Correct the notary blocks to reflect the individuals signing. The first notary block says
“…to be the individuals…and acknowledged that they signed the same as their free and
voluntary act…”. However, since this notary block is for Shawn Clark’s signature, it
individual…and acknowledged that he signed the same as his
should read “…to be the
free and voluntary act…” Additionally, since the second notary block is for Dave
McKee’s signature, it should be changed from “…that she signed the same as her free
and voluntary act…” to “that he signed the same as his free and voluntary act…”.
5.Under the “Conditions of Approval” heading, include the two restrictions from the title
report (the easements to the City of Edmonds and to PUD).
6.Under the “Hold Harmless Agreement” heading, the word “successor’s” in the second
line should be changed to “successors”, and the word “constructions” in the last line
should be change to “construction”.
7.Add an Easement Provisions section to your recording documents, where the location
and purpose of all new easements must be described (see sample). Note that this
section should also state which lot(s) the easement(s) benefit.
8.Add an Easement Maintenance section to your recording documents, where the
ownership and maintenance responsibilities of each new easement must be described
(see sample).
9.There are two typos under the “Existing Legal Description” heading. In the last line,
please correct the spelling of the words “page” and “Snohomish”.
10.Please provide an as-built of your site improvements so that staff can review for
consistency with the final documents. If you have any questions on the requirements
for an as-built, please contact Jeanie McConnell, Engineering Program Manager, at
(425) 771-0220, ext. 1338.
11.Move the total parcel area for the original lot (20,814 sq. ft./0.478 acres) out of Parcel
A so that it does not cause confusion over the area of Parcel A.
12.Since the driveway has been relocated on the site, please remove the outline of the old
driveway from the plans.
13.Show the extent of the PUD easement (AFN #200805130601) on the plans.
14.The original plans contained an asterisk next to the slopes easement to the City of
Edmonds stating “easement condemned in Snohomish County Superior Court and the
terms and conditions thereof.” Please add a similar note back to Page 2 to show that
this easement previously existed and that it is not a new easement created with the
subdivision.
15.The plans state that the area of Parcel B is 8,993 sq. ft., but the net area (total area
excluding the area of the access easement) is not provided. Therefore, please indicate
both the gross and net lot areas on Parcel B (i.e. gross = 8,993 sq. ft, net = X sq. ft.).
Note that as approved with the modification request for the subdivision, the net area of
Parcel B cannot be below 7,420 square feet.
16.Please have your surveyor stamp and sign Page 2 of the recording documents.
17.Under the “Auditor’s Certificate” heading on Page 2, correct the year to 2008.
18.Remember that all signatures on the final documents must be made in black ink,
including the notary signatures.
Please make the above changes and submit your updated recording documents to a Planner,
Monday through Friday, excluding Wednesdays, between 8:00 am and 4:30 pm. If you have
